What is the Legal Basis of a Lawsuit Against A Hotel or Apartment Building for a Bed Bug Infestation

The vast majority of bed bug cases are based on a negligence legal theory for establishing liability on the part of a hotel or apartment building owner. There are several elements that need to be shown in order to prove negligence in the court of law.

1. The defendant owed a duty to the injured victim.

2. The defendants breach his duty of care by failing to provide for sanitary living or workplace environment.

3. The breach of the duty resulted in the hotel room or apartment unit being infected by bedbugs.

4. The bed bug infestation resulted in physical harm to the tenant or hotel room guest.

Types of Damages and Injuries That Can be Recovered for bed Bugs Under California Law

Victims of bed bug infestations are legal entitled to receive the following:

  • All medical costs – doctors visits, treatment of wounds and infections, hospital and emergency room costs.
  • All future medical and rehabilitation expenses including revision surgery.
  • Pain and suffering including emotional distress due to bedbug bites.
  • Loss income and loss of future earning capacity.
  • All destroyed and damages property.
  • Return of rent or hotel room visit costs.

Hi, I recently stayed at a hotel where I got bitten all over my body by bed bugs. I have pictures of the bites. I had to move rooms, but to a room that is one the same floor as the old one which, I was later informed by a desk employee, they had brought people in to spray for bugs a day or two prior to my arrival. I was not informed of this when I checked in. The new room they moved me to smells bad, and the incident was very disruptive to my trip here for the Electronics Expo, at which I work as a journalist. I leave for Santa Fe today, but I wanted to find out if there was some kind of action I could pursue, especially because they still want to charge me for all but one night of my stay. Would you please let me know if I have a case or if there is some action I could take to recover my money from the hotel? Thank you for your time.
