Rexair Recalls Rainbow SRX Vacuums due to Fire and Burn Risks

Rexair Recalls Rainbow SRX Vacuums lawyer attorney sue compensation lawsuit

On June 17, 2020, Rexair issued a recall for their Rainbow SRX Vacuums. According to the product recall, number 20-138, the vacuum’s circuit board can spark, which represents a fire and burn risk to consumers. The recall has affected approximately 38,000 units of the product in the U.S.

The recall includes the Rainbow SRX vacuum cleaner with water-based filtration. The recalled vacuums are model number RHCS19 Type 120 and have serial numbers ranging from 22003399 through 22077889. The affected vacuums are predominantly black (although they have a blue trim) and have a rubber trim around the base. Both the right and left front panels of the vacuum have the “SRX” logo. The affected vacuums also have a clear water basin at the base.

The defective vacuums were available at independent authorized Rainbow distributors around the nation for approximately $3,200 each. The vacuums were sold from June 2019 through June 2020.

According to the recall, there have been at least two reports of the vacuum catching fire. Allegedly, there have been no reports of injuries. The company is urging affected consumers to unplug and stop using the vacuum; consumers are also urged to contact a Rainbow distributer for a free repair.

Were you and your family directly harmed because of the defective vacuum? If your vacuum caught fire, resulting in burns and property damage, you might have grounds to take legal action. Instead of contacting a distributor for a free repair, you should contact a lawyer to learn more about your right to pursue a product liability claim. You might have grounds to hold the company accountable for the harm that you or a member of your family suffered; you could even hold the company accountable for any property damage associated with the defective product.

Are you interested in learning more about your right to pursue a claim against Rexair or any other company that negligently made a defective product available and contributed to the harm that you and your family suffered? If so, do not hesitate to seek legal assistance with the experts at Normandie Law Firm as soon as possible. Understanding the Severity of the Fire and Burn Risk

As explained above, the recalled vacuums’ circuit board can spark, possibly resulting in a fire. Whenever a product can start a fire, there is a significant risk of burn injuries, smoke inhalation injuries, and even property damage. Consumers could suffer burn injuries ranging in severity. Burn injuries can affect skin, nerves, muscles, and even bones; they can result in the permanent loss of sensation/function in addition to amputations, in severe cases. In addition to burn injuries, the fire could lead to smoke inhalation injuries, which include oxygen deprivation, internal burns, loss of consciousness, brain damage, and even death. Property damage is also possible. Regardless of the damages resulting from the defective product, it is important that affected consumers know that the harm suffered could have been prevented – if the company would have ensured that their product was safe prior to releasing it to the public.

Product Liability – You Could Pursue a Claim

What can you do after suffering harm due to a defective product? If you or a member of your family suffered harm associated with a defective product, you might have grounds to sue. You could file a product liability claim against the company that negligently contributed to the harm that you or your family suffered. This is based on the concept of product liability.

What determines your right to sue? You are owed a duty of care; if the duty of care is breached and leads to the harm you suffered, you could sue. In other words, all companies owe their consumers a duty of care – they have the duty to ensure that all their products are safe for their consumers to use. Companies that fail to ensure that their products are safe and fail to test/inspect as well as identify/address the hazards present in their products are breaching their duty of care. The breached duty of care can contribute to incidents (such as fires), which could directly contribute to harm.

When the harm that a consumer suffers can be directly attributed to a breached duty of care (a defective product), the company could be liable for all the harm suffered. This means that affected consumers could pursue claims against the at-fault company. If you would like to learn more about product liability and your right to pursue a claim, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.

    Can I Be Compensated?

If you and your family suffered harm associated with the defective vacuum, you might have grounds to recover compensation – if your product liability claim is successful. Based on your claim’s details, you might be eligible to recover compensation for some of the following:

    • Medical bills
    • Lost income
    • Pain and suffering
    • Property damage
    • Loss of consortium
    • Funeral and burial costs
    • Punitive damages

Although you could be eligible to recover some of the types of compensation listed above, the exact type and amount you could recover will always be based on the details surrounding your product liability claim. Because of that, you should seek legal assistance immediately. Our lawyers are ready to evaluate your claim and help you recover the highest amount of compensation available for your claim. If you are ready to learn more about the compensation that you could recover if your product liability claim against Rexair or any other negligent company, do not hesitate to contact our firm today.

File Your Claim Within the Time Limit

If you are thinking about pursuing a product liability claim for the harm that you or a member of your family suffered, it is essential that you file your claim promptly to preserve your right to sue. All claims are subject to a statute of limitations, meaning that there is a deadline to sue. If claims are not filed on time, claimants will lose their right to sue. How long do you have to pursue your claim? In California, product liability claims are subject to a two-year statute of limitations, which means that claimants only have two years to sue. However, exceptions could apply (and toll or pause the time available to sue). To ensure that you have a thorough understanding of the statute of limitations that applies to your claim, do not hesitate to seek legal assistance with the product liability lawyers at our firm as soon as possible.
