Republic Wireless Issues Recall for Relay Charging Cables due to Overheating and Burn Risks

Republic Wireless Issues Recall for Relay Charging Cables sue liable incident lawyer attorney compensation

On June 17, 2020, Republic Wireless issued a recall for their Charging Cable for Relay Screenless Communication Devices. According to the recall (number 20-139), the charging cables can overheat and melt (at least partially); this poses a burn hazard to consumers. Approximately 15,000 products have been affected.

The affected charging cables were sold both individually and with Relay Screenless Communication devices. The charging cables are three feet long; they have a USB Type-A male connection on one end and a charging head on the other end. The charging head consists of a 5-pin pattern that makes it possible to charge the Republic Relay device. The charging head is magnetized to ensure that the pins connect to the contacts on the device. The charging cables included in the recall do not have the Relay logo on the back of the charging head. The recall includes to both cables charged with Relay devices and sold separately.

The individual charging cables were available online via Relaygo.com for approximately $15 each from May 2018 through May 2019. The cables that were sold along with relay devices were available via Relaygo.com, Target.com, and Amazon.com for prices ranging from $49 through $100 starting in May 2018.

According to the company, there have been at least two reports of the charging cables overheating; however, the company claims that no injuries have been reported.

The company is urging all consumers affected by the recall to immediately stop using the charging cables and contact them for a free replacement. Republic Wireless is directly contacting all affected consumers with active accounts with more information on replacement charging cables. Consumers who purchased a Relay device but do not have active accounts are being urged to contact the company to determine whether they have a charging cable affected by the recall and to get a free replacement.

For many consumers, the recall is simply an inconvenience. These are the consumers that should follow the recommendations made by the company. What if you or a member of your family actually suffered harm associated with a defective product? If the defective product directly contributed to the harm suffered, you should not agree to a free replacement. Instead, you should consider the possibility of pursuing a claim and fighting for the right to recover the compensation that you are owed. The Overheating and Burn Risks Associated with the Defective Charging Cables

As explained above, the recalled charging cables can overheat and melt, resulting in a burn risk to consumers. Most people might assume that they would be able to quickly identify an overheated/melted charging cable before potentially suffering a burn. However, consumers use products under the assumption that they are safe for normal use. Because the product can overheat, even the slightest touch could result in a burn. Burns can affect the layers of the skin, the muscles, and the nerves, for example. Although burns can often result in only permanent scarring, it is possible for burns to lead to the loss of feeling in the affected area as well as the loss of function. Regardless of the specific harm resulting from the defective product, the harm could have been avoided – if the company would have ensured that the product was safe prior to releasing it to the public.

Product Liability and Your Right to File a Claim

All companies owe their consumers a duty of care – a duty to only release products that are safe for consumer use. When effectively exercising this duty of care, companies test and inspect their products to be able to identify and address any hazards present. This ensures that, when released to consumers, products are free of any hazards. However, companies can fail to ensure the safety of their products and breach their duty of care; this results in consumers being recklessly put at risk of suffering harm. Defective products can cause incidents, which could contribute to the harm that consumers suffer. What does this mean? Based on a concept of product liability, companies could be liable for all the harm directly caused by a defective product. Therefore, if you were owed a duty of care (that was breached) and harmed by a defective product, the company that released the defective product could be liable for all harm suffered. This means that you could sue a company for the harm caused by a defective product.

    • Medical expenses
    • Lost income
    • Pain and suffering
    • Property damage
    • Punitive damages

    What Should I Do?

To prepare to sue, there are a number of things that you should do to prepare to pursue a claim against the company that negligently contributed to the harm that you suffered.

    Consider the following recommendations:

    • Take photos of any visible injuries caused by the defective product
    • Take photos of the defective product
    • Seek medical care for all injuries suffered
    • Contact the company to report the defect and the harm suffered

    • Do not agree to a free repair or replacement
    • Do not agree to a refund

    • Gather any surveillance video that might have captured the incident

How Long Do I have to Sue?

Although you might have grounds to sue, you must act promptly to ensure that you preserve your right to file your product liability claim. All claims, including product liability claim, are subject to a statute of limitations. A statute of limitations determines the specific length of time that claimants have to pursue their claims – if claimants do not file their claims on time, they could lose their right to sue. What statute of limitations applies to your claim? How long do you have to sue? In California, product liability claims are normally subject to a two-year statute of limitations; this means that claimants will only have two years to sue. However, it is possible for exceptions to apply (which could pause the applicable deadline). To ensure that you have a thorough understanding of the time that you have to pursue your claim do not hesitate to seek legal assistance with our experts immediately.
