Polaris RZR XP Turbo Recall Class Action Lawsuit

Polaris RZR XP Turbo Recall Class Action Lawsuit incident lawyer attorney recall defective product

Polaris has expanded their recall on the Polaris RZR Turbo Recreational Off-Road Vehicles (ROVs) to include RZR XP Turbo and RZR XP 4 Turbo models from 2016. There is a possibility of the vehicle’s engine overheating, which is a fire hazard if the turbo system’s drain tube comes loose.

The recalled vehicles were sold in blue, gray, red, and orange with a two or four-seat configuration. The RZR logo is printed on the rear box or on the rear fenders, and “Turbo” is printed on the hood or on the front fenders. The vehicles were sold from August 2015 through July 2016 through Polaris dealers nationwide.

The manufacturer has advised all consumers to stop driving their vehicles immediately. They are offering a free repair service, along with an extended warranty and a discount towards a new vehicle. Frankly, these remedies are insufficient for anyone who’s already sustained injuries from a defective RZR XP Turbo. Keep in mind that 19 accidents have been reported so far, including severe burn injuries to a child from a fire that caused 15 acres of forest land to be destroyed.

Polaris owes accident victims much more than a discount and free repair service, but going up against a major retailer takes considerable skill and experience. Normandie Law Firm can help you obtain justice in the form of monetary compensation. Please reach out to us to discuss your rights and legal options during a free case review.

Possible Injuries from a Defective ROV Engine

Overheating inside a vehicle’s engine can cause various injuries to an unsuspecting victim, primarily burns to the skin and the underlying tissues. The worst of these injuries damage the deepest layer of your skin, along with the bones, muscles, and nerves. This can leave you with permanent skin and nerve damage. Victims may also end up with extensive scarring and disfigurement, which can cause significant emotional trauma.

If the fire from a defective engine causes an explosion, injuries may occur from the impact of the blast or falling debris. Possible injuries from these situations include broken bones, fractures, and head injuries, including concussion and traumatic brain injury.

Steps to Take if You’ve been Injured by a Polaris ROV

Most people are unaware of the steps they should take after an accident, and as a result, they end up losing out on the compensation they deserve from the responsible party. Our goal is to protect your interests from day one, which is why we recommend the following steps:

    • To preserve as much evidence as possible, take photos of the accident scene and the injuries you’ve sustained.
    • Ask for written statements from witnesses or get their contact information so you can ask them for a statement later.
    • Get to a hospital right away so that a doctor can treat and document your injuries.
    • Call Polaris to notify them of the accident, but refuse to give a recorded statement if they ask for one. In addition, say no to any offers for a free repair, refund, or anything else to remedy the problem until you’ve spoken with an attorney.
    • Safeguard all documents and items that support your right to compensation, like medical records, witness statements, and what you were wearing at the time of the accident.
    • Obtain representation from a seasoned ROV accident injury lawyer.

Is There a Class Action Lawsuit on these Cases?

Class action lawsuits or mass torts are very common when there is a mass recall, since it’s likely that many people have been harmed by the same product. Joining a class action can be an effective way for all these victims to obtain justice at the same time. Of course, you also have the option of suing Polaris on your own, so you should discuss both of these actions with a class action lawyer at our office. No matter which path you choose, you can count on us to fight tirelessly for your rights and ensure that justice is served by the manufacturer. To schedule a free case evaluation, contact our office as soon as possible.

Average Settlement Value for Defective Product Lawsuits

Determining what you can receive from a defective product lawsuit is a complicated process due to the losses you may be entitled to. These include medical costs, missed wages, mental anguish, and other economic and non-economic damages. That’s why at the end of the day, there is no such thing as an “average” settlement value. For the majority of claims that are settled by our attorneys, an ROV or ATV accident case is worth around $125,000 to over $3 million, though what you can recover may be lower or higher than these amounts.

How Long do I have to File a Lawsuit?

All legal actions involving injuries from an accident are governed by a statute of limitations. This means you have a limited amount of time to file a claim against the responsible party. If you’ve been harmed by a defective product, you must initiate the legal process within 2 years of the accident date. If you are past the 2-year window, you will most likely lose the right to sue Polaris, as the courts are very strict when it comes to filing deadlines. Don’t miss out on the right to seek compensation from an ORV manufacturer; contact us right away to get started on an accident injury claim.
