Polaris RZR ROVs Recall – Class Action Lawsuit

polaris rzr vehicle recall product liability lawyer injury attorney sue compensation
On November 19, 2020, Polaris recalled a number of different models of their RZR recreational off-highway vehicles (ROVs). Based on the recall, number 21-709, the clutch on the affected ROVs can fail; this defect represents a risk of injury to consumers. The recall has allegedly affected 18,400 units of the ROVs in the U.S. alone.

The following ROVs are included in the recall:

    • 2020 RZR PRO XP
    • 2020 RZR PRO XP 4
    • 2021 RZR PRO XP
    • 2021 RZR PRO XP 4
    • 2021 RZR TURBO S
    • 2021 RZR TURBO S4
    • 2021 RZR XP TURBO
    • 2021 RZR XP 4

The recalled Polaris ROVs were available in both two-seat and four-seat options. They came in a variety of colors, including the following: white, red, titanium (silver), orange, sand (light brown), gray, blue, black, and lime (green). The ROVs have “POLARIS” stamped on the front grille as well as “RZR” stamped on the sides of the vehicle.

The ROVs included in the recall were available nationwide at Polaris dealers from March 2019 through October 2020; they were sold for prices ranging from $18,600 to $32,300.

According to Polaris, there have been at least 136 reports of the clutch on the affected ROVs failing; this includes at least 8 reports of debris and/or clutch-component ejection which resulted in damage to the ROV. Polaris claims that no injuries have been reported. However, it is possible that there have been unreported incidents and injuries associated with the defective ROVs.

The company is urging all consumers affected by the recall to stop using the ROVs immediately and contact a Polaris dealer to schedule a free inspection as well as a free repair. Dealers and registered owners are being contacted directly by the company.

There is no doubt that any consumers who own the defective ROVs should stop using the product as soon as possible. However, should you agree to a free inspection or a free repair? If the defective product did not lead to any harm to you or a member of your family, you should follow the recommendations made by the company.

What if the defective Polaris ROV contributed to the harm that you or a member of your family suffered? If you or a member of your family suffered harm due to the recalled ROVs, you should not agree to a free repair or any other offers made by the company. Instead, you should seek legal assistance to learn more about the legal options that might be available to you.

If you or a member of your family suffered harm associated with a defective product, you might have the right to pursue a product liability claim. More specifically, you might have the right to sue for the harm that you or a member of your family suffered due to a defective product. The Damages Resulting from the Defective ROVs

As explained above, some of the incidents include reports of debris ejection or clutch-component ejection, resulting in property damage to the ROV. Considering the price range of the affected vehicles, property damage resulting from debris or clutch-component ejection could be very expensive to address. The ejected debris or clutch components could potentially strike consumers. In addition, clutch failure could lead to gear slippage as well as failure to engage or change gears; this can potentially lead to an accident. Without a doubt, it is possible for consumers to suffer a number of injuries associated the defective product.

    Can I Sue?

Do I have the right to sue if I experienced harm due to a defective product? Could I sue if a member of my family suffered harm due to a defective ROV? Based on the details surrounding the incident, you might have the right to sue. More specifically, you might have the right to sue based on the concept of product liability.

What is product liability, and how does it determine your right to sue? Based on product liability, companies owe their consumers a duty of care – a duty to ensure that all their products are safe of any hazards or dangerous conditions that could ultimately harm consumers. Because of this duty of care owed to consumers, companies must test and inspect their products thoroughly; doing so allows them to identify as well as address the hazards or defects present in their products.

Unfortunately, however, companies are likely to breach their duty of care towards their consumer. That is, they recklessly make defective products available for consumers to purchase. When a consumer is harmed directly due to a defective product, the company could be held accountable. What does this mean? If you or a member of your family suffered harm associated with a defective product, you could have the right to sue – you could file a product liability claim.

If you are interested in learning more about your right to pursue a product liability claim for the harm that you or a member of your family experienced due to the recalled Polaris ROVs, do not hesitate to seek legal assistance with the experts at our firm today.

    What Should You Do?

      • Do not agree to a refund
      • Do not agree to return the defective product under any circumstances
    • Collect any video footage that captured the incident – such as dash cam footage, body cam footage, or surveillance footage

    • Gather all medical records
    • Gather any records of property damage associated with the incident
    • Gather any records of lost earnings associated with the accident

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

    The Statute of Limitations

There is no doubt that affected consumers could be eligible to pursue product liability claims after being harmed by defective products. However, because all claims are subject to strict timelines, consumers must act quickly to ensure that they preserve their right to sue. All claims, including product liability claims, are subject to a statute of limitations which determines the total length of time that claimants have to sue; if claimants fail to file their claims on time, they can lose their right to sue entirely.

How long do you have to sue Polaris for the harm that you or a member of your family suffered? In California, product liability claims are subject to a two-year statute of limitations. What does this mean? If a two-year statute of limitations applies, claimants will only have two years to file their claims. Although this is a strict deadline, it is possible for exceptions to apply; exceptions could toll or pause the relevant statute of limitations. To ensure that you have a thorough understanding of the total length of time that you have to file your claim, contact us at your earliest convenience. Our lawyers will help you file your claim on time.
