Onewheel Self-Balancing Electric Skateboards Class Action Lawsuit

Onewheel Self-Balancing electric skateboard class action lawsuit lawyer recall incident liability

The U.S. Consumer Product Safety Commission (CPSC) and Future Motion issued a recall for all of their models of their Onewheel Electric Skateboards. According to the recall, number 23-299, the skateboards can stop balancing the rider if the board’s limits are exceeded; this poses a crash risk that could result in severe injuries and even death. The recall affects 300,000 units of the Onewheel Electric Skateboards.

According to the recall, Future Motion received at least four reports of deaths resulting from incidents on their products between 2019 and 2021. The company also received multiple reports of serious injuries. Still, Future Motion initially refused to agree to recall the product after the CPSC’s first warning about the product.

As mentioned above, all models of the skateboard are included in the recall. These models are listed below:

    • Onewheel (original model)
    • Onewheel+
    • Onewheel+ XR
    • Onewheel Pint
    • Onewheel Pint X
    • Onewheel GT

The electric skateboards were available online at Onewheel.com and other online retailers as well as at independent shops around the country from January 2014 to September 2023; the products were sold for prices ranging from $1,050 and $2,200 each.

The remedy provided by the company is a firmware update that would include a Haptic Buzz alert function (a tactile/audible warning system that will engage when nearing the board’s limit, low battery, or error). They are urging consumers to stop using the skateboards until the update is complete. Consumers with the original Onewheel or Onewheel+ models are being offered a refund (store credit) with confirmed disposal of the product, as these two models are not eligible for the update.

If you suffered injuries or a member of your family lost his or her life as a direct result of the defective Onewheel Electric Skateboards, you could have grounds to file. It is important that you do not agree to any remedy offered by the company. Rather, you should seek legal assistance as soon as possible. Here at the Normandie Law Firm, our lawyers are more than ready to provide you with the guidance that you need to fight for your rights and recover the compensation that you are owed. Can I Sue?

Yes – you could be eligible to file a lawsuit. In fact, your right to sue will be based on the concept of product liability, which states that all product manufacturers have a duty to ensure that their products are completely safe for consumers. In other words, manufacturers must test and inspect their products to be able to identify and address any issues to avoid harm to unsuspecting consumers.

It is important to note that, since 300,000 units of the product are affected by the recall and countless consumers have been harmed as a direct result of the defect, a class action lawsuit is likely. You might be wondering how to join a class action lawsuit. In general, joining a class action lawsuit is as simple as opting-in or opting-out (as some will automatically include all consumers). However, your best option is to find a recall lawyer to discuss what to do next and how to proceed with your case.

How Long Do I Have to File a Lawsuit?

All claims, including defective product claims and product liability claims are subject to a statute of limitations or a deadline to sue. This establishes the total length of time that claimants have to file their claims. In the state of California, specifically, injured consumers have two years to file their claims. In other states, this deadline can range from one to six years. For more information about the specific time that you have to file your Onewheel lawsuit against Future Motion, contact us today. Our lawyers are ready to guide you every step of the way to ensure that you file your claim on time.

    Can I Recover Compensation?

Based on the details surrounding your lawsuit, you could be entitled to receive compensation for the harm that you or a loved one suffered. What can you recover? The different types of compensation can include the following:

    • Medical costs
    • Lost income
    • Pain and suffering
    • Loss of consortium
    • Funeral and burial costs
    • Punitive damages
    • Legal fees

Of course, the specific type and amount of compensation that you can be awarded will be based on the details surrounding each case.

What is the average case value of these types of cases? Defective product cases resulting in severe injuries and/or death can be associated with values ranging from $500,000 to $3 million – and sometimes even more. This is for a single case; of course, class actions reach higher settlement amounts. For more information about the possible value of your claim, we recommend that you seek legal assistance with the experts here at our law firm as soon as possible. Our lawyers are ready to aggressively fight for your right to recover the maximum payout available for your claim.
