KLIM Backcountry Probes Recall Class Action Lawsuit sue compensation lawyer attorney

KLIM is recalling the Backcountry Probes A300, which are used by rescuers to find victims that are buried under an avalanche. The probes may fail to operate during a rescue, which will significantly increase the risk of injury or death to the buried victim. The recall affects around 3,930 probes, which were sold at KLIM or Polaris retailers from October 2022 through November 2022. To identify the probes, consumers can look for the numbers “PO2761” on the tip of the probe.

Make sure to stop using the probe right away and contact the manufacturer via email at orders@KLIM.com, with “A300 Probe Recall” in the subject line to request a full refund. KLIM will send out a free shipping label and packing materials for the item to be returned to them. This is a sufficient remedy for someone that hasn’t been injured by this product. But what can you do if you or your loved one sustained bodily harm, including death, as a result of this product’s defect?

When problems with a product are caused during the manufacturing process, accident victims and their loved ones may have the right to recover compensation, such as medical expenses, funeral costs, lost income, and loss of consortium. Injuries from an Avalanche

Frankly, there’s no way to overestimate the dangers of an avalanche, which occurs when a layer of snow on a mountain collapses and rolls downhill. Generally, injuries from an avalanche fall into one of three categories:

    • Blunt force trauma
    • Hypothermia
    • Asphyxiation (deprived of oxygen)

The number one cause of deaths from an avalanche is asphyxia, which accounts for around 72% of all avalanche-related fatalities. However, even if the victim is able to breathe, they can die from the effect of their injuries if it takes too long for someone to find them. Even if the victim survives, any of the injuries we’ve mentioned above can lead to life-altering health issues, like brain injury, amputation, and damage to the internal organs. That’s why it’s imperative that avalanche probes have no major flaws or defects that can cause them to miss a buried victim.

Steps to Take if You’ve been Injured due to a Defective Avalanche Probe

Every second counts when you are buried under snow from an avalanche. Sadly, it’s not unusual for people to die from their injuries, especially if an avalanche probe fails to work properly and locate the victim before it’s too late. In most accidents, people are able to take photos of their injuries, get contact info from witnesses, and take other actions to help their case. After an avalanche, however, medical treatment is your first priority.

Whether you are the accident victim or the loved one of someone that died in an avalanche, it’s essential to contact an accident injury lawyer right away. If you believe that the rescue efforts were delayed by a defective avalanche probe, you may be entitled to monetary damages from a personal injury lawsuit or wrongful death compensation claim. To secure the highest possible settlement for your losses, please give us a call.
