    Grace Digital Recalls EcoBoulder Speakers

Grace Digital Recalls EcoBoulder Speakers lawyer attorney incident liability

On November 20, 2019, Grace Digital issued a recall for their ECOXGEAR EcoBoulder Speakers. According to the recall, number 20-027, the battery on the speakers can become overcharged and burst. This poses a significant injury hazard.

According to the recall, approximately 88,000 units have been affected.

The recall specifically involves the ECOXGEAR EcoBoulder Bluetooth Speakers. The following models are affected by the recall:

    • GDI-EXBM900 (in Orange) with UPC code 819127010331
    • GDI-EXBM901 (in Black) with UPC code 819127010348
    • GDI-EXBM904 (in Yellow) with UPC code 819127011796
    • GDI-EXBM907 (in Red) with UPC code 819127011802
    • GDI-EXBM913 (in Blue) with UPC code 819127011819

The affected speakers are black with a rubber mat slip at the top of the speaker. The different versions of the speakers have color accents (around the front of the speakers) that match the rubber mat slip located at the top of the speaker.

The speakers involved in the recall were sold at Costco stores throughout the U.S. from October 2016 to January 2017. From January 2018 to December 2018, the speakers were available at Academy Sports, Cabela’s, Home Depot, Best Buy, and online via Amazon. The speakers were sold for approximately $180 each.

According to the recall, there have been at least 5 reports of the speaker batteries suddenly bursting and fragmenting. There have also been at least 2 reports or property damage to surrounding property. So far, there have not been any reports of injuries.

The recall urges all affected consumers to immediately stop using the recalled speakers and contact the company as soon as possible for a free battery replacement kit.

Should you do as the recall suggests? Should you contact the company for a free battery replacement kit? Only the consumers who were not affected in any way by the defective product should follow the suggestions set out by the recall. If you or a member of your family suffered any damages because of the defective product, you might have grounds to sue and even fight for the right to recover at least some sort of compensation.

Did you or a member of your family suffer injuries because of the defective speakers that were recently recalled? Regardless of the specific harm suffered, it is essential that you explore the possibility of pursuing a claim – you might have grounds to file a claim for all the damages resulting from the defective product.

    The Risk of Injury

According to the recall, the batteries in the speakers could overcharge, causing them to burst. The burst could result in fragments possibly impacting bystanders. This could result in bruises, scrapes, and lacerations, for example. Fragments could even become lodged in the skin. It is also possible for the fragments of the bursting battery to impact bystanders in the face, possibly resulting in ocular injuries (eye injuries), for example. Innocent consumers are needlessly put at risk of injury. If you were harmed, regardless of the specific injury suffered, you might have grounds to hold the company accountable for your injuries.

Could you hold the company accountable if the defective product, in addition to injuries, resulted in property damage? If any of your personal property was damaged because of the defective product, you could take legal action. Just like you wouldn’t have suffered injuries had the product not been defective, your property wouldn’t have been damaged had the product not been defective.

    What is Product Liability?

Could you sue Grace Digital for the harm caused by their defective product? Could you sue ECOXGEAR for the harm that you suffered? The answer is simple – yes, you could sue. All companies have a duty of care towards their consumers. They have a duty to ensure that their products are completely safe for consumer to use. They have the duty to ensure that every element of their products, including batteries, is safe for consumers.

When companies fail to ensure that their products are safe for consumers, they are essentially breaching their duty of care towards their consumers. They are recklessly and negligently failing to take the action necessary to keep their products and their consumers safe. When a breached duty of care contributes to an incident that causes any sort of damages, the company could be liable for all damages and harm suffered.

    File Your Claim on Time

Although you have the right to sue if you were harmed by a defective product, you could lose your right to sue if you fail to take legal action within the appropriate length of time. All claims are subject to deadlines which are established by a statute of limitations. In California, product liability claims are typically subject to a two-year deadline. This means that claimants could only have two years to file their claims. However, certain exceptions could apply. When exceptions apply, the applicable statute of limitations can be tolled for some time, ultimately granting more time to sue.

When claims are not filed within the appropriate length of time, claimants can lose their right to sue. Therefore, it is essential that claimants have a thorough understanding of the deadline that applies to their claim. For more information, do not hesitate to contact our law firm today.
