BMC Bicycles and Framesets Recall Class Action Lawsuit

BMC Issues Recall for Bicycles and Framesets due to Fall Risk injury lawyer attorney sue compensation lawsuit
On December 19, 2019, BMC issued a recall for their Teammachine SLR01 DISC bicycles and framesets. According to the recall (recall number 20-042), the fork steerer tube on the bicycles and framesets can crack or break during normal use, resulting in a fall hazard.

Approximately 840 units are affected by the recall in the U.S. The recall includes all 2019 and 2019 models of the Teammachine SLR01 DISC bicycles and framesets. The bicycles are performance road bikes available in red, green, graphite, grey, blue, and aqua green. BMC can be found printed on the bicycles’ downtube.

The recalled models include the following:

    • Teammachine SLR01 DISC Team (2018)
    • Teammachine SLR01 DISC One (2018)
    • Teammachine SLR01 DISC Two (2018)
    • Teammachine SLR01 DISC Module Team Red (2018)
    • Teammachine SLR01 DISC Module Carbon Green (2018)
    • Teammachine SLR01 DISC Module Carbon Gray (2018)
    • Teammachine SLR01 DISC Edition AXS (2019)
    • Teammachine SLR01 DISC One (2019)
    • Teammachine SLR01 DISC Two (2019)
    • Teammachine SLR01 DISC Three (2019)
    • Teammachine SLR01 DISC Four (2019)
    • Teammachine SLR01 DISC Frameset Module Race Grey (2019)
    • Teammachine SLR01 DISC Frameset Module Team Red (2019)
    • Teammachine SLR01 DISC Frameset Module Aqua Green (2019)
    • Teammachine SLR01 DISC Frameset Module Stealth with Sticker Set (2019)

All recalled models of the bicycles have serial numbers that begin with 8R17 and 8R18 – followed by one letter and a four-digit code. The serial numbers are printed on the underside of the bicycles’ bottom bracket. According to the recall, only the bicycles/framesets with FK6 forks require a replacement fork.

The defective bicycles were sold at bicycle stores and authorized BMC bicycle dealers nationwide from July 2017 to October 2019 for about $4,500 and $12,500 each. Based on the recall, BMC has received at least four reports of the defective fork steerer tube breaking during use; at least one consumer suffered a shoulder injury requiring hospitalization/surgery and another suffered minor scratches and bruises.

The company is urging consumers to stop using the bicycles included in the recall and contact the local BMC authorized dealer for both a free inspection and a free replacement fork.

What does this recall represent? Is it simply an inconvenience? Does the recall reflect the harm that you or a member of your family already suffered? For many people who own the bicycles included in the recall – specifically those who have not been harmed in any way – reaching out to an authorized dealer for an inspection and replacement is simply the thing to do. For those who were harmed in any way because of the defective product, however, getting a free inspection and free replacement can actually be problematic; doing so could result in losing the right to take any legal action against BMC or any other company that negligently contributed to the harm suffered.

Do you have the right to sue? If you suffered any harm because of a defective product, you will likely have grounds to pursue a claim. Specifically, you could pursue a claim because you wouldn’t have suffered any harm if the company had ensured that their products were safe for use. Depending on the details surrounding the harm that you suffered, you might have grounds to file a product liability claim. You might be eligible to sue BMC and even receive monetary compensation for the harm that you suffered.

If you or a member of your family suffered any type of harm because of a defective product, such as the defective bicycles that were recently recalled by BMC, you should explore the possibility of filing a product liability claim.

The Defective Bicycle Could Harm Consumers

All defective products should be taken seriously; however, defective bicycles are amongst the most dangerous. According to the recall, the fork steerer tube on the bicycles and framesets can crack or break during normal use, resulting in a fall hazard. What does this mean? At any time while using the bicycle – whether traveling at 10 mph or 30 mph – the fork steerer tube can break and cause an unsuspecting bicyclist to fall. Depending on the speed being traveled, the surrounding area, and other factors, bicyclists can suffer significant injuries if they fall due to a broken steerer tube.

Some of the injuries that bicyclists could suffer include the following:

    • Head injuries
    • Traumatic brain injuries
    • Neck injuries
    • Back injuries
    • Spinal cord injuries
    • Shoulder injuries
    • Knee injuries
    • Fractures
    • Nerve injuries
    • Sprains and strains
    • Lacerations
    • Scrapes and bruises

These are just a few of the injuries that victimized consumers could suffer because of the defective bicycles. If you or a member of your family suffered any type of harm associated with the defective bicycles, you should explore the possibility of taking legal action immediately.

    Product Liability

Do you have the right to sue if you or a member of your family suffered harm because of a defective product? Depending on the circumstances surrounding the incident and the harm that you suffered, you might have grounds to sue based on product liability. Based on product liability, all companies have a duty of care towards their consumers; they have the duty to ensure that their products are completely safe for consumer use. When companies fail to ensure that their products are safe to be used by consumers, they are breaching their duty of care and putting their consumers at risk of harm. The breach of duty can cause an accident which can directly lead to harm (injuries and even death, for example).

When a breached duty of care leads to harm, the victim (and his or her family) could hold the company that negligently breached their duty of care accountable for the harm suffered. The company could be sued on the basis of product liability.

If you would like to learn more about your right to take legal action against BMC based on product liability, do not hesitate to seek legal assistance with our experts at your earliest convenience.

    What Should You Do?

Unfortunately, many parties harmed by defective products fail to successfully file claims against liable companies simply due to a lack of guidance and a lack of information. After suffering harm, it is important to act appropriately. Consider the following recommendations:

    • Take photos of all injuries suffered
    • Take photos of the defective product
    • Seek medical attention
    • Keep the defective product in a safe place
    • Do not attempt to repair the defective product yourself
    • Contact the company to report the incident and harm suffered
    • Do not accept a refund
    • Do not accept a free repair or replacement
    • Do not return the defective product
    • Speak to witnesses and gather their information
    • Gather all purchase records
    • Gather medical records
    • Seek legal assistance

When you follow the recommended steps above, you are essentially gathering the tools necessary to file your claim. If you would like to learn more about what you should do immediately after being harmed by a defective product, do not hesitate to contact our law firm at your earliest convenience.

    Could You Recover Compensation?

If you were harmed by a defective product, could you be eligible to receive monetary compensation? Depending on the details surrounding your claim – because the details of your claim directly affect the potential value of your claim – you could be eligible to recover compensation for at least some of the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Loss of consortium
    • Funeral and burial costs
    • Property damage
    • Punitive damages

Without a doubt, the recovery of monetary compensation cannot reverse the harm suffered; however, everyone can agree that compensation can help victims and their families move forward from such a traumatic time in their lives. If you would like to learn more about your right to recover monetary compensation for the harm resulting from a defective product, do not hesitate to seek legal assistance with the experts at our firm immediately.

When you allow our attorneys to handle your claim, you can be certain that there will always be someone aggressively fighting for your right to recover the highest amount of compensation available for your claim. Our attorneys will not rest until you recover the compensation that you deserve.

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.
    The Statute of Limitations

Without a doubt, the parties affected by defective products could sue and fight for their right to recover monetary compensation. However, the failure to file a claim on time could result in losing the right to sue. All claims are subject to a statute of limitations (a deadline to sue) based on the specific cause of action being pursued. Product liability claims, for example, are typically subject to a two-year statute of limitations, meaning that the claimant will only have two years to pursue his or her claim.

Although the statute of limitations establishes a strict deadline, certain exceptions could apply (exceptions always depend on the specific details surrounding your claim). These exceptions could toll or pause the applicable statute of limitations, making your claim subject to a different deadline.

To avoid losing the right to sue due to a simple lack of information, it is essential that you discuss the deadline that applies to your claim with an experienced attorney at your earliest convenience.
