Decathlon USA Recalls Swiss Balls due to Injury Risk

Decathlon USA Recalls Swiss Balls due to Injury Risk lawyer attorney sue liability

ON September 3, 2020, Decathlon USA issued a recall for their Domyos Swiss Ball. According to the recall, number 20-777, the recalled exercise balls can burst unexpectedly, causing consumers to fall and potentially suffer injuries. The recall has affected approximately 510 products.

The recall specifically involves the Decathlon USA Domyos swiss balls – which are often referred to as pilates balls and/or gymnastics gymballs. The model numbers included in the recall include the following:

    • 8529175
    • 8529176
    • 8529177

The swiss balls are designed to be used for exercising. They were available in a number of colors, including blue, gray, and bordeaux. The balls measure 21.65 inches to 29.53 inches in diameter; the balls weigh between 10.6 and 10.9 ounces each. Near the base of the ball, Domyos, the diameter, and the weight are all printed.

The recalled swiss balls were sold nationwide at Decathlon stores; they were also available online via Decathlon.com. The balls were available from February 2019 through March 2020 for approximately $20 each.

According to the recall, the company has received at least 26 reports of the swiss balls bursting unexpectedly. Allegedly, these incidents have resulted in at least six injuries, which consisted of fractures, scratches, and bruises. So far, all reports of incidents and injuries are outside of the U.S.

The company is urging all affected consumers to immediately stop using the exercise balls and contact them for a refund (in the form of a store credit equal to the product’s purchase price). The company is contacting known purchasers directly.

Should you contact the company to get a refund? If the recall has not affected you in any way, it makes sense to get a refund. Did you or a member of your family suffer harm, however? If so, you should never consider agreeing to a refund. Instead, you should consider pursuing a product liability claim.

If the defective swiss ball contributed to an incident that led to harm, you might have grounds to sue. If you are interested in learning more about your right to sue and possibly recover compensation for the harm that you or a member of your family suffered, do not hesitate to seek legal assistance immediately.

    • Head injuries
    • Traumatic brain injuries
    • Neck injuries
    • Back injuries
    • Spinal cord injuries

    • Bruises

Regardless of the specific type of injuries that you or a member of your family suffered, you might have grounds to pursue a claim. You should seek legal assistance immediately to explore the legal options available to you – based on the details surrounding your claim, you might have grounds to pursue a product liability claim.

Your Right to Sue Based on Product Liability

Can you sue for the harm that you or a member of your family suffered associated with a defective product? Can you pursue a claim if you or a member of your family suffered harm associated with the defective swiss balls? Based on the details surrounding the incident, you could sue. Specifically, you could sue based on the concept of product liability.

Based on product liability, companies owe their consumers a duty of care. Companies have a duty to ensure that their products are free of any hazards that could harm consumers. They must subject their products to tests and inspections to be able to both identify and address any risks present in the products. Unfortunately, companies can breach this duty of care and release defective products to the public. Defective products can directly contribute to incidents which can harm consumers.

When a defective product directly harms a consumer, the company could be liable based on the concept of product liability. This means that affected consumers could pursue claims against the negligent companies that made the defective products available for purchase. If you would like to learn more about your right to file a product liability claim for the harm that you or a member of your family suffered associated with the defective product, contact our firm today.

    What Should You Do?

After being harmed by a defective product, consumers should do a number of things to essentially prepare to file claim against the company that negligently made the defective product available for purchase. What should you do? Some of the recommendations that you and your family should follow after being harmed by a defective product include the following:

    • Take photos of all injuries suffered
    • Seek medical attention as soon as possible
    • Take photos of the defective product
    • Keep the defective product in a safe place, where it can remain as-is
    • Contact the company to report the incident and the harm suffered
      • Do not agree to a refund
      • Do not agree to return the defective product
      • Do not agree to a free replacement
      • Do not agree to a free repair
    • Speak to witnesses present at the time of the incident (gather their contact information for future reference)
    • Gather all relevant records (this includes medical records, records of lost income, etc.)
    • Seek legal assistance with a product liability lawyer immediately
