    What Is Product Liability?

Do you have the right to sue for the harm that you or a member of your family suffered due to the defective ladders? Your right to sue will be strictly based on the details surrounding your incident. However, if you have the right to sue, it will be because of the concept of product liability. Based on product liability, all companies owe consumes a duty of care – to ensure that their products are completely safe for their consumers to use. What does this mean? Because of this duty of care owed to consumers, companies must test and inspect their products thoroughly to ensure that their products are safe for use. Testing and inspecting products allows companies to identify and address the hazards presents in their products. However, companies can breach their duty of care and fail to ensure the safety of their products; they negligently make defective products available to consumers, putting them at risk of suffering harm.

When a breach of duty (or a defective product) directly leads to an incident that harms a consumer, the company could be liable; this is because the company could have essentially prevented the incident by simply exercising the duty of care owed to consumers. What does this mean? Companies could be liable based on product liability; therefore, affected consumers could sue.

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

    Understanding the Statute of Limitations

Without a doubt, you might have grounds to sue for the harm that you or a member of your family suffered harm associated with a defective product. However, to ensure that you preserve your right to sue, you must file your claim quickly, within the time allowed by the statute of limitations that applies to your claim. What is a statute of limitations? A statute of limitations determines the specific length of time that claimants have to file their claims (ensures that claims are filed promptly and within a fair timeframe). When claimants file their claims on time, they could lose their right to sue.

Because claimants could lose their right to sue if they do not file their claims on time, it is essential that they have a thorough understanding of the statute of limitations that applies to their claims. How long do you have to sue based on the statute of limitations that applies to your claim? In California, product liability claims are normally subject to a two-year statute of limitations; therefore, claimants only have two years to pursue their claims. Although this is a strict deadline to sue, claimants must be aware that exceptions to the statute of limitations could apply – exceptions could essentially pause the applicable deadline.

To ensure that you have a thorough understanding of the total length of time that you have to file your product liability claim against CMP Group or any other negligent company, do not hesitate to seek legal assistance immediately.
