On December 17, 2019, J. Crew issued a recall for their boys’ denim pants – specifically the crewcuts boys’ stone washed denim pants. According to the recall (20-040), small stones could be present in both the pockets or the waistband of the pants from the stone-washing process during manufacturing; the small stones pose an aspiration or choking risk to young children.
According to the recall, approximately 900 units have been affected. The affected units of denim pants were sold in both sizes 2 and 3. Only pants that were made in Pakistan are affected by the recall. The pants can be identified by style number J8406 and season FA 19, both of which are listed on the care label on the pants’ side seam. The UPC codes on the affected products include 099105125419 and 099105125420 (which are listed on the price tag attached to the recalled pants).
The denim pants were sold between July 2019 and October 2019 for approximately $50 each at J. Crew and Crewcut sores nationwide as well as online via J. Crew’s website. According to the recall, J. Crew has only received one report of stones found in the waistband extension of the denim pants; no injuries have been reported.
The company is urging consumers to take the pants involved in the recalled away from children and remove any stones form the pockets or internal waistband opening to completely eliminate the hazard.
Although the company claims that there has only been one report of stones found in the pants and no reported injuries, it is possible that there have been at least a few unreported incidents. If your child got ahold of the stones in the pockets or waistband of the pants and suffered any sort of injury, including choking or aspiration, he or she could be significantly harmed.
If your child was harmed because of the recalled denim pants, it is essential that you explore the possibility of taking legal action against J. Crew for negligently making the defective product available to purchase. You might have grounds to pursue a product liability claim against J. Crew; you also might have grounds to recover monetary compensation.

Product Liability and Your Right to Sue
Undeniably, consumers who are harmed because of defective products have the right to sue and receive compensation for the harm suffered. What is the right to sue based on? The right to sue companies for the harm resulting from defective products is based on product liability. Based on product liability, all companies have a duty of care towards their consumers. This means that companies must ensure that their products are safe for consumer use prior to making them available for purchase. When companies fail to ensure that their products are safe for use (or fail to identify or address any hazards present in their products), they are essentially breaching their duty of care towards their consumers. The breach of duty could directly cause an incident which could result in harm to consumers.
Whenever the harm consumers suffered is related to a breach of duty (such as a hazard present in a product’s design, labeling, or manufacturing, for example), the company could be found negligent and liable of the harm suffered. Therefore, affected consumers could take legal action and file product liability claims.

- Lost wages
- Pain and suffering
- Loss of consortium
- Funeral and burial costs

How Long Do You Have to Sue?
Did you know that you could lose your right to sue if you fail to file your claim within the appropriate length of time? All claims are subject to a statute of limitations, which determines the length of time that claimants have to sue. If claims are not filed on time, claimants will lose their right to sue and receive any compensation.
How long do you have to sue? In general, product liability claims are subject to a two-year statute of limitations, meaning that claimants will only have two years to file their claims before losing their right to sue. Even though statutes of limitations establish strict deadlines, exceptions could apply. Depending on the details of your claim, applicable exceptions could toll or pause the deadline that applies to your claim.
To avoid losing the right to sue, you must have a full understanding of the deadline that applies to your claim. Our defective product attorneys are ready to provide you with all the information that you need to file your claim on time and start working towards a successful claim outcome.
