Varidesk Recalls Stand2Learn Stools Recall – Class Action Lawsuit

Varidesk stand2learn stool recall injury hazard fall risk personal injury lawyer maximum compensation attorney sue injured

On January 23, 2020, Varidesk issued a recall for their Stand2Learn Stools. According to the recall, recall number 20-054, the foot support on the stools were improperly welded; therefore, the foot support can break and pose a fall risk to consumers. According to the recall, approximately 4,700 units of the product have been affected. The recall includes the adjustable-height stools designed for students. The stools’ height ranges from 19 inches to 33 inches. The stools are gray steel and have a black padded seat. The stools also have four stabilizing cross-bars supporting the legs as well as the adjustable footpads for leveling. The stools’ model number (42058) can be found underneath the seat; the UPC code (8-13866-02360-7) can be found on the product packaging. The defective stools were sold online via Varidesk.com, Schoolspecialities.com, Wayfair.com, and Amazon.com. The stools were also available through corporate sales and third-party sellers. The stools were sold for about $95 each and were sold between June 2018 and November 2019.

According to the recall, the company has received at least seven reports of the foot support bars on the stools suddenly breaking off. Allegedly, no injuries have been reported. The company is urging consumers to stop using the recalled stools and contact the company for a full refund.  Without a doubt, it could be tempting to simply contact the company to request a refund after learning that one of the products which you purchased is defective and has been recalled. However, if you or a member of your family suffered any type of harm because of the defective product, you should never even consider the possibility of accepting a refund.

If you or a member of your family suffered harm, you should consider the possibility of pursuing a product liability claim. You might have grounds to sue Varidesk for the harm suffered. Specifically, you might have grounds to file a product liability claim against Varidesk. If you would like to learn more about taking legal action against Varidesk for the harm resulting from one of their stools, do not hesitate to seek legal assistance with the experts at our law firm at your earliest convenience.

The Dangers of the Defective Stools

    About Product Liability

Is the company liable for the harm suffered? Is Varidesk liable for the harm associated with their defective stools? Based on product liability, Varidesk could be liable. What is product liability? Based on product liability, all companies have a duty of care towards their consumers. Companies have the duty to ensure that their products are completely safe for their consumers to use. To ensure the safety of their products, companies must subject their products to tests and inspections; this allows companies to identify any hazards and quickly address them. If companies fail to identify and address hazards present in their products, they are breaching their duty of care towards consumers and are putting them at risk of injury.

Hazards can exist in a product’s design, labeling, or manufacturing. These hazards (such as the improperly welded foot support bar) could contribute to an incident (such as a consumer falling) which can result in injuries. If a defective product directly contributes to the injuries that a consumer suffered, the company could be found at-fault based on product liability.

If you would like to learn more about product liability, do not hesitate to seek legal assistance with our law firm at your earliest convenience. Our lawyers are ready to provide you with all the information that you need to learn more about product liability and how it applies to your specific situation.

Some of the compensation that you could be eligible to receive could include the following:

    • Pain and suffering
    • Loss of consortium

    What Should You Do?

Unfortunately, many people simply do not know what they should do after being harmed by a defective product. Because of that, many people simply do nothing. If you were harmed by a defective product, it is important that you are aware that you could pursue a claim against the company that negligently made the defective product available for purchase.

    You should follow these steps:

    • Seek medical attention immediately
    • Take photos of all injuries suffered
    • Take photos of the defective product
    • Keep the defective product in a safe place
    • Do not tamper with the defective product in any way
    • Stop using the defective product
    • Contact the company to report the incident and the harm suffered
    • Do not agree to a free repair, free replacement, or a full refund
    • Gather all records associated with the purchase of the defective product
    • Seek legal assistance immediately

Our product liability lawyers are ready to provide you with all the information that you need to prepare to file your claim. Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

Is Your Claim Subject to Deadlines?

Without a doubt, you could pursue a claim if you or a member of your family suffered harm because of a defective product, such as the defective Varidesk stools. However, did you know that you could lose your right to sue the company liable for the harm suffered? Unfortunately, many people lose their right to sue everyday – because they fail to understand the timeline that applies to their claims.

All claims are subject to a statute of limitations, which determine the specific length of time that claimants have to pursue their claims. If claims are not filed within the time allowed by the statute of limitations, claimants will lose their right to sue. These deadlines ensure that claims are filed promptly and that claimants do not sit on their claims too long.

What deadline applies to your claim? In California, product liability claims are typically subject to a two-year statute of limitations. This means that claimants only have two years to file their claims. As previously mentioned, failing to file on time could result in losing the right to sue; therefore, it is essential for claimants to have a thorough understanding of the time that they have to sue.

However, it is possible for exceptions to apply. If there are any exceptions to the statute of limitations, the applicable deadline could be tolled or paused. Exceptions apply based on the details surrounding the claim. For example, if the victim was underage at the time of the incident, the deadline can be tolled until the victim becomes a legal adult (that is, if parents do not file first). Likewise, if the victim is mentally incompetent (left in a coma, for example) after the incident, the deadline will be tolled until the victim regains mental competency.

For more information about the time that you have to pursue your claim, do not hesitate to contact our law firm at your earliest convenience.
