Pier 1 Issues Recall for Three-Wick Halloween Candles due to Fire and Burn Risks

Pier 1 Issues Recall for Three-Wick Halloween Candles recall lawyer liability attorney sue compensation

On August 19, 2020, Pier 1’s Three-Wick Halloween Candles were recalled. According to the recall, number 20-169, the candles’ high flames can ignite the surface of the wax, resulting in fire and burn risks to consumers. The recall has affected approximately 30,810 products.

The recall specifically involves the Pier 1 Imports’ three-wick Halloween candles in two scents, including Scary Black Cherry (with SKU 4122285) and Death by Chocolate (with SKU 4122298). The SKU number can be found printed on labels on the bottom of each candle.

The three-wick candles were available at Pier 1 Imports stores around the nation; they were also available online via Pier1.com. The candles were available from June 2019 through October 2019 for prices ranging from $10 to $17.

The store has received at least seven reports of high flames associated with the three-wick candles; this includes at least one report involving a minor burn injury and another report of property damage (albeit minor).

Affected consumers are being urged to immediately stop using the recalled candles and cut the wicks as short as possible to prevent other consumers from using the candles; consumers should discard the candles after doing so.

Are any of the recalled Halloween candles in your home? Did you unknowingly purchase a dangerous product? If the recalled three-wick candles are in your home, should you discard them? The answer to this question depends strictly on whether the defective product harmed you or a member of your family.

Did the defective Halloween candles lead to burn injuries or property damage? If so, you should not simply discard the product as recommended by the recall. Instead, you should explore the legal options available to you. Based on the details surrounding the incident, you might have grounds to file a claim – that is, a product liability claim.

If you are interested in learning more about your right to sue for the harm that you or a member of your family suffered as a direct result of the defective candles, do not hesitate to seek legal assistance with the experts at our firm immediately.

The Risk Associated with the Recalled Candles

As explained above, the recalled three-wick candles represent fire and burn hazards to consumers. The high flame can cause a fire, which can quickly spread throughout the home – potentially resulting in injuries as well as property damage. Burn injuries, without a doubt, are the most common result of fire hazards. The burn injuries that victims could suffer can vary in degrees – first-degree, second-degree, third-degree, etc. These injuries could cause significant damage, including damage to different layers of the skin as well as to nerves, ligaments, muscles, and even bone. These injuries can lead to loss of feeling, loss of function, and even complete loss of the limb (amputations). In addition to burn injuries, victims could also suffer smoke inhalation injuries, which can result in internal burns (specifically affecting the respiratory system) and oxygen deprivation (resulting in loss of consciousness and possibly brain damage). In addition to these physical injuries, mental and emotional injuries are also likely. Fires also are likely to lead to significant property damage. Property damage could be extensive and cost tens of thousands of dollars in necessary repairs. Damage to personal property with sentimental value is also possible.

Were you and your family affected by the defective three-wick candles? Regardless of whether the defective candles resulted in burn injuries or property damage, you might have grounds to pursue a claim for the harm and/or losses associated with the defective product. Specifically, you might have grounds to file a product liability claim.

    Understanding Product Liability

Do you have the right to file a product liability claim for the damages resulting from the defective three-wick candles? Based on the concept of product liability, you might have grounds to sue. In other words, companies could be responsible for the harm that consumers suffer due to their defective products. This is because companies owe their consumers a duty of care – a duty to ensure that their products are completely safe for their consumers to use. They must test and inspect their products to be able to identify and address any hazards present in their products. However, companies can breach their duty of care and fail to identify and address the hazards in their product – putting their consumers at risk of suffering harm. When a breached duty of care directly contributes to the harm that a consumer suffers, the company could be liable.

If you would like to learn more about your right to pursue a claim based on the concept of product liability, do not hesitate to seek legal assistance with the experts at our firm as soon as possible. Our lawyers will help you better understand the concept of premise liability and your right to sue.

File Your Claim Within the Deadline

Did you know that you only have a short length of time to pursue your product liability claim against the company that contributed to the harm that you or a member of your family suffered associated with a defective product? All claims are subject to a statute of limitations, which determines the total length of time that claimants have to sue. If claimants do not file their claims within the time allowed by the applicable statute of limitations, they could lose their right to sue. What deadline applies to your claim? In California, product liability claims are typically subject to a two-year statute of limitations; this means that claimants only have two years to file their claims. However, exceptions to the deadline could apply, which could toll the statute of limitations. If you would like to learn more about the total time that you have to pursue your claim, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.
