Miles Industries Issues Recall for Gas Fireplaces due to Burn and Laceration Risks

Miles Industries Issues Recall for Gas Fireplaces due to Burn and Laceration Risks lawyer attorney sue compensation liability

On July 30, 2020, Miles Industries issued a recall for their Valor H5 gas fireplace. According to the recall, number 20-768, delayed ignition associated with pilot degradation can cause gas in the fireplace to accumulate before the burner ignites. When ignition occurs, the glass window can shatter; this poses both burn and laceration risks to consumers. The recall has affected approximately 370 products in the U.S. This is not the first time the fireplaces have been recalled.

The recall specifically involved the Model 1150ILP and Model 1150JLP of the Valor H5 propane gas fireplaces. Model 1150ILP has a serial number range of 20001 to 20365. Model 1150JLP has a serial number range of 20366 to 21502. Model numbers and serial numbers can be found printed on the rating sheet located behind the trim. The affected fireplaces were available in seven trim and front options; they also came with a log set and a mesh screen barrier (which was installed in front of the glass). The fireplaces are fully enclosed in a rectangular sheet-metal box (with a glass front). The fireplaces have an exhaust that is vented to the outside via a ventilation duct.

The defective fireplaces were sold at Southern Fireplaces & More, On Fire, Custome Hearth, Abercrombie & Co., Southern Hearth & Patio stores, as well as other Specialty Hearth stores. The fireplaces were available from July 2014 through March 2020 for prices ranging between $3,700 and $5,500. There was an additional fee for installation.

According to the recall, the company has received at least one report of delayed ignition of the fireplace; however, allegedly, no injuries have been reported.

The company is urging all affected consumers to immediately stop using the recalled fireplaces and contact the retailer or contractor to schedule a free repair. The company is contacting known consumers directly.

Without a doubt, it is important that the company offers repairs for the defective products that they negligently made available to consumers. However, some consumers might be owed much more than just a free repair. Did you or your family suffer harm associated with the defective product recalled by Miles Industries? If the defective fireplace directly harmed you or a member of your family, it is important that you know that you might have grounds to sue the company.

Based on the details surrounding the incident and the harm that you or your family suffered, you might have grounds to file a product liability claim for the harm/damages caused by the defective product. This means that you might have grounds to hold the company accountable for the harm suffered due to the defective fireplace. The Defect Associated with the Defective Product

As explained above, an issue with delayed ignition can cause gas to accumulate in the fireplace prior to ignition. Therefore, when the burner ignites, the glass window of the fireplace can shatter; this poses a burn and laceration risk to consumers. Unsuspecting consumers could suffer lacerations due to the shattering glass; the shattered glass could be launched outwards, resulting in a number of injuries including facial injuries, eye injuries, lacerations, and even nerve or ligament damage. These injuries could cause permanent scarring and other permanent damage. The defective product also represents a burn risk to consumers. Consumers could suffer burns varying in degrees, which could result to damage to the skin, the muscles, the nerves/ligaments, and even the bones. Burn injuries are likely to lead to permanent scarring, loss of mobility, loss of function, and loss of feeling. In severe cases, burn injuries can also lead to amputations. Regardless of the specific harm that you or a member of your family suffered as a direct result of the defective product, you should explore the possibility of holding the company that released the defective product accountable for all the harm suffered.

Liability for Incidents and Harm Resulting from Defective Products

Who is liable for the incidents and harm caused by a defective product? Depending on the details surrounding the incident, the company that made the defective product available for consumers could be liable for the harm suffered; this is based on the concept of product liability. Product liability means that all companies owe their consumers a duty of care – a duty to ensure that their products are completely safe for consumers to use. Companies must test and inspect their products to be able to identify and address any of the hazards present in the product (before making it available to the public). When companies fail to do this, they are breaching their duty of care towards their consumers; they are also putting their consumers at risk of suffering significant harm. When a consumer suffers harm as a direct result of a breached duty of care (represented by a defective product), the company that made the defective product available could be liable for all harm resulting from the incident. In other words, an affected consumer could hold the company accountable and file a product liability lawsuit for the damages caused by a defective product. If you would like to learn more about product liability and your right to sue, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.

File Within the Statute of Limitations

Did you know that you could lose your right to sue if you fail to file your claim within the appropriate length of time? This is because all claims are subject to a deadline – or a statute of limitations. A statute of limitations determines the specific time that claimants have to pursue their claims. If they fail to file their claims within the appropriate length of time, claimants could lose their right to sue. What deadline applies to your claim? In general, product liability claims in the state of California are subject to a two-year statute of limitations; this means that claimants only have two years to file their claims. However, it is also important for claimants to be aware that exceptions to the statute of limitations, which could toll or pause the time to sue, could apply based on the details surrounding the claim. To ensure that you have an in-depth understanding of the time that you have to pursue your claim against Miles Industries, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.
