digital wireless equipment electric guitar recall yamaha product liability fire risk compensation sueOn March 12, 2020, Yamaha issued a recall for their Line 6 Relay G10 Digital Wireless Guitar Systems and USB Charging Cables. According to the recall, number 20-089, the lithium-ion battery can overheat, and the battery cover can separate with force; this poses a fire and injury risk to consumers. According to the recall, approximately 82,000 products have been affected in the U.S.

The recall specifically involves the Line 6 Relay G10, G10S (G10SR), AND G10T Digital Wireless Guitar System (which are part of the G10 family of products) that allow electric guitars to connect wirelessly to amplifiers. The system consists of a transmitter, a receiver, as well as a charger. Receivers have ¼” and XLR outputs to connect to amplifiers and/or other audio equipment. The affected products are black in color.

The following serial numbers are included in the recall:

    • G10 – 6601000001
    • G10S (G10SR) – 6736000001
    • G10T – 6640000001

The recalled digital wireless guitar systems were available at Guitar Center, Sweetwater Sound, Musicians Friend, Sam Ash, and other small retailers nationwide. The systems were also available online via Amazon.com. They wireless guitar systems were available from March 2016 through December 2019. The G10 was approximately $180, the G10S was approximately $250, and the G10T was approximately $100. The USB charging cable was sold for approximately $15.

According to Yamaha, there have been at least four reported incidents worldwide in which the battery cover separated forcefully from the transmitter; one of these reports consisted of minor property damage. According to Yamaha, no injuries have been reported. However, it is possible that there have been many unreported incidents.

The company is urging consumers to immediately stop using the product and contact them for a free repair of the product as well as a full refund for the charging cable. Sounds simple enough, right? Should you really follow these recommendations?

If you or a member of your family was directly harmed by a defective product, you should not even consider the possibility of following the recommendations of the company. Instead, you should consider taking legal action.

Could you take legal action against Yamaha? Depending on the details surrounding the specific incident and the harm suffered, you might have grounds to pursue a product liability claim. The Danger of the Fire and Injury Risk

As explained above, the battery on the digital wireless guitar systems can overheat and the battery cover can separate with force; this poses a fire and injury hazard. Without a doubt, fire risks should never be taken lightly. Fires can quickly destroy personal property; if not immediately addressed, a fire can spread and lead to structural damage. Fires can also result in smoke and ash damage. Besides property damage, physical injuries are also possible. Specifically, affected parties could suffer burn injuries (varying degrees of burn injuries); smoke inhalation injuries are also possible. Because the battery cover can separate with force, it is also possible for consumers to be struck by the cover. Without a doubt, the fire and injury risk is significant.

    About Product Liability

Can Yamaha be liable for the harm that you and your family suffered? Based on the concept of product liability, Yamaha could be liable for the harm that you and your family suffered. Specifically, because Yamaha – like all other companies – owes consumers a duty of care. That is, companies have a duty to ensure that their products are safe for their consumers to use. When companies fail to ensure the safety of their products, they are breaching their duty of care towards their consumers and are putting them at risk of suffering harm. Because of this, as soon as a consumer suffers harm associated with a defective product, they company could be held accountable. This means that affected consumers could sue the liable companies.

What Should You Do If You Are Harmed?

If you or a member of your family suffered harm associated with a defective product, there are a number of things that you should do to ensure that you could hold the liable company accountable for the harm suffered. You should do the following: (1) seek medical attention immediately; (2) take photos of all the physical injuries suffered as well as of the defective product and the entire scene of the incident; (3) contact the company to report the defect, the incident, and all the harm suffered; (4) do not agree to a free replacement, a free repair, a refund, or to return the defective product; (5) gather all records, including medical records and purchase records; (6) gather surveillance footage if any is available; (7) speak to witnesses if any were present; (8) seek legal assistance with a product liability lawyer. By following these recommendations, you and your family are essentially preparing to take legal action against the liable company. This means that claimants only have two years to file their claims; if they fail to file their claims within this time, they will lose their right to sue.
