Product Recall: Woodstream’s Mosquito Magnet Traps

On March 6, 2018, Woodstream Corporation of Knoxville, Tennessee recalled their Mosquito Magnet traps and Quick Clear Cartridge kits. The trap is designed to attract and capture mosquitoes; the kit included in the recall is designed to clean the trap. According to the recall, the traps could become damaged while cleaning with the cleaning kit. If the trap is being cleaned while powered on, the trap could become damaged and propel pieces of the broken regulator. This can result in injuries. Although no injuries have been reported, the company recognizes the danger of consumers suffering injuries after reports of damage to the mosquito trap while cleaning it.

The recall—number 18-114—affects nearly 28,000 units sold in the United States. The products were sold at hardware and home improvement stores, including the well-known Home Depot. The defective products were also sold online via www.mosquitomagnets.com. The products were sold at the following price ranges: $330 to $1,000.

Recall 18-114 includes the following products (note: product models, model numbers, and serial numbers are included in the listing):

    Model Model #  Serial #
    Independence MM3200 IN01450-IN01625
    Executive MM3300 EX01444-EX01630
    Commander MM3400 CM01503-CM01621
    Patriot MM4100 PT01483-PT01542
    Patriot/Patriot Plus MM4200 PT0142-PT01642

The recall advised consumers who own the affected products to stop using the traps and the cleaning kits as soon as possible. The recall also states that the company should be contacted for a free repair of the defective regulator hose.

Although the recall claims that the defective product did not cause any injuries, there is a possibility that some injuries have not been reported and, therefore, are not recognized. If you were injured by Woodstream’s defective mosquito trap, you must take action as soon as possible. You have rights, and you must fight for these rights.

We urge you contact our law firm and speak with our attorneys as soon as possible. Our attorneys will give you all the case-specific information necessary to ensure a successful claim.

    The Hazard

According to the recall, the defective product could potentially propel broken regulator pieces. What injuries could you expect if a broken piece of any material is suddenly propelled towards you? Broken materials, like the broken regulator, can contain sharp edges. When suddenly propelled towards an individual, broken pieces of any material can cause scrapes and lacerations for example. The type and severity of injuries would likely depend on many factors, one of which could be the point on the body in which the broken material makes contact. If a piece of broken regulator is propelled towards a victim’s face; there is a risk of facial injuries and scarring, in addition to eye injuries and possible effects to one’s vision. If you were injured in any way as a result of Woodstream’s defective mosquito magnet trap, you must take legal action as soon as possible.

    Filing a Lawsuit

All companies have a duty to ensure that their products are safe before they make them available for purchase. However, some companies prematurely release their products before identifying hazards that could endanger the safety of their consumers. Can you file a lawsuit if you were injured as a result of a defective product? Yes, you can sue the company. However, you can only sue the company one of the following is true about the product: (1) there is a defect in the product’s design; (2) there is a defect in the product’s manufacturing process; (3) there is a defect in the product’s labeling. If you can prove that any of the previous statements are true, you must seek legal assistance as soon as possible.

There are a few things you should do immediately after your injury to ensure that you retain your right to sue. Unfortunately, a product liability claim can be easily dismissed if victims do not take the proper steps. To ensure that you can file a lawsuit, you must do all of the following:

    • Seek medical attention—seeking medical attention makes a direct connection between your injuries and the defective product. It also creates a record of the treatment required for your injuries, as well as the medical expenses that resulted of your injuries.
    • Do not try to fix the defective product—by trying to fix the defective product, you are tampering with essential evidence. In product liability claims, the defective product is one of the most important pieces of evidence; therefore, you should do everything to preserve its defective state. This includes rejecting any offers of free repairs from the company.
    • Do not return the item—some product recalls recommend returning the product for a replacement or a refund. As mentioned above, the defective product is one of the most important pieces of evidence therefore, returning the product would destroy evidence.
    • Keep records of receipts and documents—you should keep copies of all receipts, order confirmations, or other documents related to the purchase of the defective product.

You must also immediately contact a law firm with experience in product liability and defective product claims. The attorneys at Normandie Law Firm can help you file a lawsuit against Woodstream if you were injured because of their defective mosquito magnet trap.

    Compensation Available for Your Claim

If you file a lawsuit after you were injured by a defective product, you might be eligible to file a lawsuit. Many victims of defective products recover compensation for their injuries. Common categories of compensation include the following:

    • Medical costs
    • Lost wages
    • Property damage
    • Pain and suffering
    • Punitive damages

As you can see, there are many categories of compensation available for recovery. However, there is no guarantee that victims will recover all the types of compensation mentioned above. Instead, the majority of victims are eligible to collect a combination of some of the categories of compensation listed. For more information on the type and amount of compensation you might receive for your defective product claim, you must contact our attorneys as soon as possible. Our attorneys will evaluate your claim and estimate the value of your claim. Our experienced product liability attorneys will always fight for your right to be compensated, and they will not rest until you receive the maximum amount of compensation available for your claim.

    Statute of Limitations

If you are interested in filing a product liability lawsuit, you must be aware of the statute of limitations that applies to your claim. A statute of limitations is a timeline that establishes the length of time in which you must file a claim—a deadline to sue. If you do not file your claim within the time allowed by the statute of limitations, you might lose your right to sue. The victims of defective products must adhere to a two-year statute of limitations in California (statutes vary from state to state). Some exceptions might apply and increase the total time you have to sue; however, only an experienced attorney should identify any exceptions. For more information on the statute of limitations and exceptions that apply to your claim, you must immediately speak with the expert attorneys at Normandie Law Firm.
