VIQUA Recalls Solenoid Valve Kits due to Electrical Shock Risks

On October 3, 2019, VIQUA issued a recall for their Solenoid Valve Kits. The Solenoid Valve Kits are designed for UV water treatment systems. According to the recall, recall number 20-004, a defect in the product could result in electrical current leaking from the solenoid valve, resulting in a risk of electrical shock to users.

The recall has affected approximately 70 units of the solenoid valve kits in the U.S. (170 units of the product are affected in Canada). The recall includes the solenoid valves that come with the company’s solenoid valve accessory kits for both residential and commercial UV water treatment systems. The defective products are identifiable by green coil compartments attached to the valve with part number 400127-xxx as well as date codes 1A3 through 5A2 or 0B1 through 0B8.

VIQUA Recalls Solenoid Valve Kits due to Electrical Shock RisksThe defective solenoid valve kits were sold at VIQUA distributors and through plumbing contractors nationwide from May 2018 to October 2019. The kits were sold for between $460 and $500 each.

According to the recall, no incidents or injuries have been reported. The company is urging consumers to stop using the valve kits immediately and disconnect the power source to the water treatment system. The company is also urging consumers to visit their website for assistance with the inspection of the green coil component on the valve (to identify production date codes). The company is also offering the free installation of replacement coils for affected consumers that contact VIQUA directly.

Although the company claims that there have been no incidents or injuries reported, it is possible that there have been unreported incidents and injuries. If you or a member of your family suffered harm associated with the defective valve kits that were negligently made available by VIQUA, you might have grounds to pursue a claim – specifically a product liability claim.

The Danger associated with Electrical Shock

Many of us have experienced minor electric shock at one point or another. Without a doubt, electric shock can often be nothing to worry about. However, severe electric shock could result in significant harm – and even death.

Electrocution could result in the following:

    • Abdominal pain
    • Broken bones
    • Burns
    • Chest pain
    • Confusions
    • Difficulty breathing or shortness of breath
    • Numbness and tingling
    • Paralysis
    • Problems with vision, speech, or hearing
    • Seizures
    • Spinal injuries (after forceful muscular contraction)
    • Unconsciousness

If you or a member of your family suffered electric shock because of the defective solenoid valve kits recently recalled by VIQUA, do not hesitate to seek legal assistance as soon as possible – you might have grounds to pursue a claim.

Is VIQUA Liable for the Harm Caused by their Defective Products?

Is VIQUA liable for the harm that you or a member of your family suffered? VIQUA could be liable for the harm that you suffered simply on the basis of premise liability. Based on premise liability, all companies have a duty of care towards their consumers. Companies that produce products have the duty to ensure that all their products are safe for consumer use. To exercise this duty of care towards consumers, companies must subject their products to inspections and tests to ensure that they are safe. When companies fail to do this and fail to identify/address any hazards present in their products, they are putting their consumers at risk of injury – they are also breaching their duty of care towards their consumers. As soon as a breach of duty directly results in harm, the company could be liable. If you would like to learn more about VIQUA’s liability for the harm that you or a member of your family suffered, do not hesitate to contact our firm today.

Do You Have the Right to Sue?

As explained above, VIQUA had the duty to ensure that their products were safe for consumers. By failing to ensure that their products were safe before making them available for consumers, VIQUA put all their consumers at risk of suffering harm. This means that if you suffered harm because of their negligent actions (failing to identify and address hazards in their products) you could sue and fight for the right to recover monetary compensation. If you would like to learn more about your right to sue, do not hesitate to contact our law firm immediately.

    Could You Recover Compensation?

There is no doubt that monetary compensation cannot and will not reverse the harm that you and your family suffered because of the defective product. Monetary compensation, however, can help you and your family move forward with your life after such a traumatic experience. Could you really recover any compensation? Your right to recover any sort of compensation will always depend on the details of the claim.

In general, some of the types of compensation available for recovery include the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Property damage
    • Loss of consortium
    • Funeral and burial costs
    • Punitive damages

Could you really recover all of the compensation listed above? The compensation that you could recover will always depend on the details of your claim; although there is no guarantee that you could recover the compensation mention above, you could be eligible to receive at least some of the categories of compensation listed.

To ensure that you have a thorough understanding of the type and amount of compensation that you could be eligible to receive, do not hesitate to contact our law firm as soon as possible. Our lawyers are ready to fight for your right to recover the compensation that you deserve – contact us today to learn more about the compensation that you could recover.

    What Should I Do?

You were harmed by a defective product; now, what? Without a doubt, the details of the harm that you suffered might make you eligible to pursue a claim; however, it is essential that you take the appropriate actions. Many people unknowingly lessen the possibility of reaching a successful claim outcome because of the things that they do and don’t do. Consider the following recommended actions:

    • Stop using the defective product – remove its power supply
    • Seek medical assistance as soon as possible
    • Take photos of the defective product
    • Take photos of the harm that you suffered
    • Contact VIQUA to report the defective product and the harm that it caused you or your family
    • Do not agree to a free repair
    • Do not agree to a free replacement
    • Do not agree to a refund
    • Do not agree to return the defective product to the company
    • Do not provide the company with any information that could be used against you
    • Gather all relevant records (purchase records and medical records)
    • Gather witness information (if applicable)
    • Seek legal assistance immediately

By following the recommended steps above, you are essentially preparing everything that you need to file your claim. If you would like to learn more about the specific actions that you should take to prepare to file your claim after being harmed by the defective solenoid valve kits, do not hesitate to seek legal assistance as soon as possible with the experts at our firm. Our lawyers are ready to provide you with the guidance that you need to pursue your claim and reach a successful claim outcome.

How Long Do I Have to Sue for a Defective Product?

Without a doubt, when you follow the recommendations listed above, you will better the chances of reaching a successful claim outcome. However, even if you do everything listed above, you could still lose your right to sue based on just one thing – failing to file your claim on time. All personal injury claims are subject to a statute of limitations. A statute of limitations determines the specific length of time that claimants have to pursue their claims. If claimants fail to file their claims on time, they will lose their right to sue – and their right to receive monetary compensation.

What is the statute of limitations that applies to your claim? There are different types of deadlines that apply to different claims. In California, product liability claims are subject to a two-year statute of limitations. This means that the parties interested in pursuing a claim will only have two years to file. If they fail to file on time, they will likely lose their right to sue. There is no doubt that this is a strict deadline; however, exceptions could apply. Specifically, certain details of your claim could result in exceptions to the statute of limitations – some exceptions could toll the applicable deadline, for example. If you would like to learn more about the statute of limitations that applies to your claim, do not hesitate to contact our firm immediately.
