Uttermost Company Recalls Wall Decor | Product Malfunction Attorney

On June 12, 2018, The Uttermost Company, of Rocky Mount, Virginia, issued a product recall that affected approximately 17,000 units of mirrors, art, and other wall décor. According to the recall, the hanging hardware on the affected mirrors, art, and wall décor can suddenly break and fall, which creates the risk of injury to unsuspecting bystanders.

According to recall number 18-176, there has been at least one injury in which the defective hanging hardware caused a mirror to fall and cause a consumer to suffer from a laceration in his or her leg. The Uttermost Company has received a total of thirteen reports of mirrors, art, and other wall décor falling from walls after the hanging hardware suddenly broke.

The recall advises consumers who believe that their wall décor is affected to inspect the hanging hardware for the recalled numbers. The company advises consumers to avoid re-hanging the décor if the hanging hardware is involved in the recall. The recall claims that consumers who contact the company will receive free hanging hardware replacements.

The recalled hanging hardware can be identified by the following numbers that are printed near the bottom of the hardware: 1703, 1704, 1705, and 1706. All the affected hanging hardware has the following measurements—3.5 inches long and 0.75 inches wide. If you purchased a mirror, art, or other wall décor from Gallery Furniture, Mathis Brothers, Matter Brothers Furniture, RC Willey, Star Furniture, 5thAvenueDesigns.com, Bellacor.com, Build.com, or Wayfair.com for prices ranging from $50 to $200 during the timeframe between June 2017 and March 2018, you are likely to be affected by the recall.

Were you affected by Uttermost’s product recall? If you inspected your wall décor to find that the hanging hardware was included in the recall, you might be interested in simply contacting the company for a free replacement of the hanging hardware. Although the action recommended by the company could benefit parties that were unharmed by the defective product, you must not follow these recommendations if you or a member of your family sustained injuries after your wall décor fell from the wall.

If you, your child, or any member of your family sustained injuries as a result of Uttermost’s defective hanging hardware, you might have grounds to file a lawsuit against the company. You must seek legal assistance as soon as possible. If you are in need of legal assistance, you must contact the experienced product recall attorneys at Normandie Law Firm as soon as possible. Do not hesitate to contact us—our experienced lawyers are ready to fight for your right to sue and receive compensation for the injuries you or your family members sustained.

    The Risk of Injury

As described above, the hanging hardware used for mirrors, art, and other wall décor can break and cause the product to fall off the wall. The recall identifies at least one injury in which a mirror fell off the wall, broke, and caused a leg injury. Falling mirrors, art, and other wall décor can cause a variety of injuries—especially if the décor is sizeable. Falling décor can cause many injuries, some of which are listed below:

    • Back injuries
    • Dislocations
    • Fractures
    • Head injuries (concussions and brain injuries)
    • Lacerations, scrapes, and bruises
    • Neck injuries
    • Spinal cord injuries

As you can see, there are many injuries that you can suffer as a result of falling wall décor. These injuries can be suffered by adults and children, alike. However, children are more likely to be seriously injured due to falling wall décor. If you or a member of your family suffered any type of injury, you might have grounds to file a lawsuit and receive compensation. You must contact our law firm to learn about the possibility of filing a lawsuit against Uttermost for their defective product.

    Could You Sue?

You could only file a product liability lawsuit if any of the following statements are true:

    • There is a defect in the product’s design.
    • There is a defect in the product’s manufacturing.
    • There is a defect in the product’s labeling.

Based on the description of the defective hanging hardware, it is not clear if the defect is caused by the product’s design or manufacturing; however, at least one of the statements above is true regarding the recalled handing hardware. Because of the truth in the statement, parties that have suffered injuries as a result of the defective product breaking and causing the wall décor to fall and cause injuries could have grounds to file a lawsuit against Uttermost.

Why do you have grounds to file a lawsuit? Your product liability lawsuit is based on the company’s negligence in making a defective product available for purchase. All companies, including Uttermost, have the responsibility of ensuring that every product is safe for consumers. Uttermost had a duty to their consumers of ensuring that their products were safe and could not be hazardous. Since uttermost made defective products available for purchase, they breached their duty of care to consumers. Any time that a duty of care results in an injury to a consumer, the company could be found liable and negligent.

If you would like more information about how Uttermost is liable for the injuries you sustained after your wall décor fell from your wall, you must contact the experienced attorneys at Normandie Law Firm as soon as possible.

What Should You Do after Suffering Injuries?

After sustaining injuries as a result of falling wall décor, you might be confused about the actions that you must take to preserve your right to file a lawsuit. If you fail to take the correct actions, you could jeopardize your right to file a product liability claim and be compensated. After your accident, you must do all of the following:

    • Seek medical attention
    • Do not return the product to the company
    • Do not attempt to fix the hazard
    • Keep records of all documents relating to your purchase, medical care, and communication with the company

If you fail to perform anything listed above, you could encounter many difficulties when you attempt to pursue a claim against Uttermost. You must also seek legal assistance immediately.

The attorneys at Normandie Law Firm are prepared to handle your claim against Uttermost after you or a member of your family became the unfortunate victims of the defective hanging hardware.

    The Compensation Available for Recovery

If you are eligible to file a claim against Uttermost, you might also be eligible to receive compensation for your injuries. Although each product liability claim is different, many claimants are eligible to receive compensation for some of the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Property damage
    • Loss of consortium
    • Punitive damages

If the injuries sustained due to the defective product resulted in the death of a member of your family, you might also be eligible to receive compensation for funeral and burial costs. No matter the specific details or estimated value of your claim, you can be certain that our lawyers will always fight for your right to receive the compensation that you deserve. Our defective product lawyers are ready to aggressively negotiate with Uttermost until you are rightfully compensated.

    The Statute of Limitations

All personal injury claims, including defective product claims, are subject to a statute of limitations—or a timeline to sue. For product liability claims, claimants usually have up to two years from the date of their injury to file a claim. However, the two-year timeline could be affected by many factors which could toll or extend the time that claimants have to file a lawsuit. If you do not file your lawsuit within the time allowed by the statute of limitations, you could lose your right to sue and receive compensation. Because of that, it is essential that you seek legal assistance to learn more about the statute of limitations that applies to your claim.
