Thule Group Recalls Strollers due to Injury Risk
On August 12, 2020, Thule Group issued a recall for their Thule Sleek strollers. According to the recall, number 20-164, the handlebar on the strollers can detach; this results in an injury risk to children. The recall has affected approximately 4,000 products in the U.S.
The recall specifically involves the Thule Sleek strollers sold in black, light gray, dark gray, navy blue, and red; the strollers either had a silver or a black frame. Only the strollers without a QC2020 sticker (next to the product label) manufactured between May 2018 and September 2019 are affected by the recall. The manufacture date code (in YY/MM format) and the product number can be found on a label located on the lower inside frame of the affected stroller.
The affected product numbers include the following:
- 11000001-5

The recalled strollers were available at Buy Buy Baby, REI, and other stores around the country. The strollers were also available online at Thule.com and Amazon.com. The defective strollers were available from July 2018 through June 2020 and were sold for prices ranging between $830 and $850.
According to the recall, the company has received at least one report of the stroller handlebar detaching; however, no injuries have been reported.
The company is urging all affected consumers to immediately stop using the recalled strollers and contact them to arrange the return of the defective product and receive a free replacement frame. Should you follow these recommendations?
If the defective product never resulted in an incident, there is no issue with following the recommendations made by the company. However, if the defective product directly contributed to the harm that your child suffered, you should not agree to return the defective product for a free replacement. Instead, you should explore the legal options available to you and your family.
Based on the details surrounding the incident and the harm that your child suffered, you might have grounds to pursue a product liability claim. The Risk to Children
Defective strollers pose a significant danger to young children. According to the recall, the handlebar in the defective stroller can detach, which represents an injury risk to children. If the handlebar detaches, the parent could lose control of the stroller, which could quickly lead to an incident which can cause injuries. Children could suffer head injuries, brain injuries, neck injuries, back injuries, fractures, spinal cord injuries, lacerations, and many other injuries. Some injuries can cause permanent harm; other injuries can be fatal. Regardless of the specific harm that your child suffered associated with the defective product, you must know that you could hold the negligent company accountable for the harm that your child suffered.
Understanding Product Liability
Based on the details surrounding the incident and the harm that your child suffered, you might have grounds to sue the company that made the defective product available for purchase. Your right to sue is based on the concept of product liability. In other words, the company owes you and your family a duty of care – specifically, a duty to ensure that all their products, such as strollers, are completely safe for consumers to use. Companies must test and inspect their products to identify and address any defects present in their products. However, companies can breach their duty of care and make defective products available for consumers. When a breached duty of care directly leads to an incident and the harm that a consumer suffers, the company could be liable based on product liability. This means that affected consumers could hold the negligent company accountable for the harm resulting from the product.

You Can Sue and Recover Compensation
Monetary compensation cannot reverse the harm caused by a defective product; however, it can help you and your family start working towards moving past such a traumatic experience. Based on the details surrounding your claim and if your claim is successful, you could be eligible to recover monetary compensation for the harm that your child suffered. You could be compensated for some of the following:
- Medical expenses
- Lost income
- Pain and suffering
- Loss of consortium
- Funeral/burial costs
- Punitive damages
The type and amount of compensation that you could be eligible to receive will always be based on the details surrounding your claim. Therefore, you should seek legal assistance immediately to gain a better understanding of the value of your claim and the compensation that you could recover. To learn more about the possible recovery available for your claim, do not hesitate to contact our product liability lawyers immediately. - Seek medical care for all harm suffered
- Take photos of all injuries caused by the incident
- Take photos of the defective product
- Take photos of the scene of the accident

- Contact the company to report the defect and the harm suffered
- Do not agree to a refund (either full or partial)
- Do not agree to return the defective product
- Do not agree to a free repair or free replacement
- Speak to any witnesses present at the time of the incident
- Collect any video that captured the incident

- Gather all relevant purchase records (receipts, order confirmations, etc.)
- Gather death records (if the incident resulted in the death of your child)
- Seek legal assistance immediately

File the Claim Quickly
Claims, including product liability claims, are subject to a statute of limitations which determines the specific length of time that claimants have to pursue their claims. If claimants do not file their claims on time, they could lose their right to sue entirely. Therefore, claimants should have a thorough understanding of the statute of limitations that applies to their claims. In California, product liability claims are subject to a two-year statute of limitations; therefore, claimants will only have two years to pursue their claims. It is also important to be aware of any exceptions that could apply – exceptions to the statute of limitations. In cases involving children, for example, an exception could apply and toll the statute of limitations until the victim reaches an adult age; at an adult age, the victim could pursue a claim independently (only if a claim has not already been pursued). If you would like to learn more about the specific length of time that you have to file your product liability claim against Thule Group, do not hesitate to contact our firm today.
