Sterno Home Recalls Path Light Kits with LED Power Supplies – Consumers at Risk of Electric Shock

sterno home path light kits led recall defective product liability lawyer electric shock burn nerve damage compensation sue
On May 14, 2020, Sterno Home issued a recall for their path light kits with LED power supplies. According to the recall (number 20-123), the path lights have a defective Sterno Home LED power supply that can stay in the AC outlet when the power supply is pulled from the outlet; this poses a risk of electric shock to the user. The recall has affected approximately 77,000 units of the product.

The recall specifically involves the Hampton Bay, Patriot Lighting, and Paradise light kits (which are all sold with Sterno Home LED power supplies. The LED power supplies alter the voltage going through the light circuit. Either “Hampton Bay,” “Patriot Lighting,” or “Paradise” are printed on the light rating label.

The defective product was sold at Home Depot as well as at other hardware stores nationwide and online; the product was available from March 2017 through May 2020 for prices ranging from $50 to $100.

According to Sterno Home, there has been at least one report of the power supply plug blade detaching in an outlet; however, allegedly no injuries have been reported. The company is urging all consumers affected by the recall to stop using the recalled product and contact them for a free replacement (of the LED power supply) as well as installation instructions.

Should you follow the recommendations made by the company? Should you contact Sterno Home for a free replacement of the power supply? If you or a member of your family suffered harm associated with the defective product, you should not simply agree to a free replacement; rather, you should explore the legal options available to you. Based on the details surrounding the incident and the harm that you or a member of your family suffered, you might have grounds to sue – that is, you might have grounds to file a product liability claim.

The Shock Hazard Present in the Defective Product

As discussed above, the defective power supply can result in a risk of electric shock to users. Because many people have experienced minor shock at some point during their lives, many people disregard shock injuries as minor. However, shock should always be taken seriously. Electric injuries could result in significant harm, which could include the following:

    • Thermal burns
    • Muscle damage
    • Nerve damage
    • Tissue damage
    • Cardiac arrest (or other cardiac complications)
    • Falls (and subsequent injuries associated with falls)

Although the harm caused by shock might not be immediately apparent, it could result in a number of symptoms, including but not limited to heart attack symptoms, headaches, irregular heartbeat, muscle spasms, numbness/tingling, seizures, and loss of consciousness, for example. Regardless of the harm that you or a member of your family suffered associated with the defective product, do not hesitate to seek legal assistance to learn more about your right to pursue a claim for all the harm suffered.

Understanding Product Liability and Your Right to Pursue a Claim

Do you have the right to take any legal action for the harm that you or a member of your family suffered because of a defective product? Whether the harm was caused by the defective power supply or any other defective product, you might have grounds to sue – specifically, you might have grounds to sue based on the concept of product liability. What is product liability? How does product liability determine your right to sue?

Based on the concept of product liability, all companies owe their consumers a duty of care. Companies have a duty to ensure that their products are completely safe for their consumers; they must test and inspect their products to ensure that their products are safe for products to be made available to consumers. When companies fail to ensure that their products are safe for consumers, they are breaching their duty of care; this means that they are putting their consumers at risk of suffering harm. Because of the duty of care owed to consumers, any breach of duty that results in incidents and subsequently harm to innocent consumers could result in the company being held accountable (based on the concept of product liability). In other words, injured consumers might have grounds to sue based on the concept of product liability.

If you would like to learn more about product liability and your right to sue, do not hesitate to contact the experts at our firm at your earliest convenience. Our lawyers are ready to provide you with the guidance that you need to hold Sterno Home or any other company accountable for the harm that you or a member of your family suffered.

    What Should You Do?

In many cases, consumers who have been affected by defective products do not act appropriately after being harmed by a defective product; therefore, they negatively affect their right to pursue a successful claim against the negligent companies that contributed to the harm that they suffered. If you or a member of your family suffered harm because of a defective product, you should consider following the steps listed below:

    • Take photos of any visible injuries suffered
    • Take photos of any property damage resulting from the defective product
    • Take photos of the defective product
    • Stop using the defective product
    • Keep the defective product in a safe place (do not tamper with it in any way)
    • Contact the company to report the defective product and the harm suffered
    • Do not agree to a refund, a repair, or a replacement
    • Never agree to return the defective product (the defective product will always be the most important piece of evidence for your claim)
    • Seek medical attention immediately
    • Gather all medical records relevant to the harm caused by the defective product
    • Gather all relevant purchase records
    • Speak to any witnesses present at the time of the incident
    • Seek legal assistance with the experts at our firm

If you would like to learn more about the steps that you should follow after you or a member of your family suffered harm associated with a defective product, do not hesitate to contact the experts at our firm as soon as possible. Our lawyers will guide you every step of the way.

    • Medical costs
    • Lost income

    • Property damage
    • Loss of consortium

    File Your Claim Soon

Even if you have the right to sue based on the concept of product liability, you could lose your right to pursue your claim if fail to file your claim within the appropriate length of time. This is because all claims are subject to a statute of limitations – meaning that all claims must be filed within a specific timeframe. Statute of limitations ensure that claims are filed promptly; if claimants do not file their claims within the time allowed by the applicable statute of limitations, they could lose their right to sue. Because of this, all claimants must have a thorough understanding of the total length of time that they have to sue.

How long do you have to pursue your product liability claim against Sterno Home? In general, product liability claims (filed in California) are subject to a two-year statute of limitations. This means that claimants have two years to file their claims. However, it is possible for exceptions to apply – potentially tolling or pausing the statute of limitations. If you would like to learn more about the time that you have to pursue your product liability claim against Sterno Home or any other negligent company, do not hesitate to contact the experts at our firm immediately.
