Skylight Recalls Power Adapters Due to Electrical Shock Risk

On November 7, 2019, Skylight issued a recall for the Series I power adapters for Skylight digital photo frames – these are the power adapters that come with their digital frames. According to the recall (number 20-707), the casing of the power adapter can break when plugged into an electrical outlet, resulting in its metal prongs being exposed. This poses the risk of electrical shock.

Skylight Recalls Power Adapters Due to Electrical Shock RiskAccording to the recall issued by the company, approximately 65,000 units have been affected. The power adapters are black with a circular indentation on one side. The defective products are associated with UPC code 679113611535.

The defective power adapters were sold with digital photo frames available online via skylightframe.com and amazon.com and in-store at Von Maur stores around the country. The frames and the defective power adapters were sold from April 20108 through March 2019 for approximately $160.

So far, there have been at least eight reports of the power adapters breaking resulting in exposed metal prongs. There has also been at least one report of a consumer suffering electric shock.

The company is urging all consumers to stop using the power adapters included in the recall and contact them for more information surrounding proper disposal and replacement of the power adapter. The company is directly contacting all known consumers.

However, it is possible that many other people have suffered harm associated with the defective power adapter. If you suffered any sort of harm due to the defective power adapter sold with the Skylight digital frames, it is important that you seek legal assistance before even considering the possibility of following the suggestions set out in the recall. Depending on the harm that you suffered, you might have grounds to pursue a claim.

    The Risk of Electrical Shock

As explained in the recall, the defective power adapter can increase the risk of electrical shock. Electric shock is most often associated with electrical burns; however, electrical shock could result in many other issues. For example, electrical shock could result in broken bones, abdominal pain, chest pain, and difficulty breathing/shortness of breath. Electric shock could also result in confusion, numbness/tingling, issues with senses (vision, hearing, and speech), and unconsciousness. In the most severe cases, electrical shock could result in seizures, spinal cord injuries, and paralysis.

Regardless of the specific harm that you or a member of your family suffered, you should explore the possibility of taking action against the company that negligently made the defective power adapters available – Skylight should be held accountable.

Product Liability and the Right to Sue

All companies have a duty of care towards their consumers. When they breach their duty of care towards their consumers, they create a risk of harm – which can then directly cause an incident and contribute to the harm suffered by innocent consumers. When a breach of duty directly results in harm, the companies that breached their duty of care towards consumes could be found liable for all harm suffered. This is called product liability.

Based on product liability, companies can be liable for the harm that their consumers suffer because of the defective products negligently made available to them. Companies have a duty to ensure that their products are safe to be used by their consumers. By failing to identify and address hazards present in their products, companies are breaching their duty of care and putting consumers at risk of injury. When harm occurs, companies can be liable.

What does this mean? Does this mean that I could pursue a claim? If a company is at-fault for an incident based on product liability, affected consumers have the right to sue. For more information about your right to sue based on product liability, do not hesitate to contact our law firm today.

    What Should You Do?

    • Seek medical attention as soon as possible

      • Never agree to a free replacement
      • Never agree to a free repair

    Could You Recover Compensation?

If you or a member of your family suffered any type of harm because of a defective product, you might have grounds to recover monetary compensation if your claim reaches a successful outcome. What kind of compensation could you be eligible to receive if you reach a successful outcome? The type and amount of compensation that you are eligible to recover will always depend on the details specific to your claim.

For example, the compensation that you could recover could include some of the following:

    • Medical expenses
    • Lost income
    • Pain and suffering
    • Property damage
    • Funeral and burial damages
    • Loss of consortium
    • Punitive damages

What Deadline Applies to Your Claim?

If you are interested in pursuing a claim after suffering any sort of harm related to a defective product, it is essential that you have a thorough understanding of the statute of limitations that applies to your claim. All claims are subject to statutes of limitations. A statute of limitations determines the specific length of time that claimants have to file their claims; if claimants fail to file within the appropriate length of time (as established by the statute of limitations), they will lose their right to sue – and their right to receive any form of compensation.

What deadline applies to your claim? In California, product liability claims arising from the harm caused by defective products are subject to two-year deadlines. This means that claimants will only have two years to file their claims. However, certain exceptions could apply resulting in deadlines being paused or extended, for example. Because failing to have a thorough understanding of applicable deadlines could result in losing the right to sue, it is always necessary to discuss potential deadlines with an experienced attorney.
