Restoring Hardware Product Recall: La Salle Metal-Wrapped Coffee Tables

Restoring Hardware (RH) has recalled over 1,500 units of its metal-wrapped coffee tables. The metal top on the tables was coated with lead-based paint, which can be toxic to both children and adults. The La Salle Metal-Wrapped Coffee Tables were recalled on November 15, 2018. All of the tables are rectangular in shape, and they range in size from 48 inches to 72 inches.

The tables were manufactured by Heritage Creations, an Indian company, and sold at RH galleries, outlet stores, and the website between August 2013 and December 2017. The tables were imported into California. The items could be purchased for anywhere between $1,900 and $2,600.

RH has offered a refund to any consumers who purchased the tables, or a replacement table altogether. To date, there have been two reported incidents of children suffering from elevated lead levels in their blood stream. Children who are exposed to lead could suffer lead poisoning, which may lead to developmental troubles and cognitive difficulty.

The two tables in question were found in Pittsburgh, Pennsylvania, and Temple, Texas. They were distributed nation-wide.

    Suing for Product Liability

You can file a product liability lawsuit against RH if you can show that they were negligent in their duty to you as a customer. In order to file a claim, you must be able to show that one of these issues is true:

    • The table had a design flaw
    • The table had a manufacturing defect
    • There were no warnings on the label or hazard notices on the packaging or the table itself.

In all likelihood, the table was manufactured poorly if the choice of paint was lead-based. The design of the table is not faulty and there is seldom a reason to list any potential dangers of a tble that is assumed to be working properly and functions as a table should. However, the exposure to lead would not be accounted for, if it is even known at all.

As a customer, you are owed a duty of care by the company. They must no expose you to any potential harms and must not sell you faulty products. The duty of care must be upheld all of the time. If a company breaches that duty of care and some kind of incident happens, such as prolonged exposure to lead-based pain in the table, and physical harm is the result, you could sue for negligence.

Steps to Take on Product Liability Claims

The most important aspect of a product liability claim is retaining the product. You should not return it; it will be much more difficult to prove that there was an issue if you do not have the item with you. You should also make sure to take photos of it for additional evidence, just in case it gets lost, damaged, or repossessed.

You should not try to remove the coating yourself or do anything that would otherwise change or alter the product. If you try to fix it or make it better, you likely will not be able to collect compensation. The reason is simple: it will no longer be apparent that the damages you suffered were caused by RH.

You should get medical treatment within an acceptable amount of time. If you wait too long, it can appear that your injuries were caused by someone else or in another incident. The sooner you get to the doctor, the better it will be for your claim. This is especially true if you have children who were exposed to lead.

You should have a receipt or proof of purchase to show that you actually owned the table. You can also use a credit card statement to show that you bought the table. You may have received an email confirmation if you bought the table online, too. All of this can be put together and presented with your claim.

Finally, it is important that you reach out to an attorney with experience in product liability lawsuits. Some lawyers are not adept in the area and will try to quickly settle case with no intention of truly helping you. Reach out to our firm, where our attorneys are adequately skilled and experienced and can ensure that you receive everything you deserve.

Statute of Limitations for a Product Liability Claim

You only have two years from the incident to file a claim against the responsible business. If you take too long, you will be prevented from securing any compensation at all. Statutes of limitations can be extended, such as in case of a minor being hurt by the product. He would not have to adhere to the statute until the day he turned 18 years old. Further, if the defendant left the state or if you were so injured you could not reasonably work, you should have a momentary deadline extension.

    Potential Earnings

You can collect various kinds of coverage for any injuries you suffered or that your child suffered from an RH metal-coated table. Chief among them is compensation for any medical expenses. You may also be able to receive coverage for lost income, damaged belongings, and emotional pain and suffering. Our attorneys will strive around the cclock to bring you the maximum compensation available for your case.
