Umbrosa Pool and Patio Umbrellas Recall Class Action Lawsuit

Pool and Patio Umbrellas Recalled due to Injury Risk – Umbrosa Recall Injury Lawyers attorney sue compensation incident accident

On May 27, 2021, Umbrosa issued a recall for their pool and patio umbrellas – specifically the umbrellas equipped with their Umbrosa Evolution Arm/Holder. According to the recall (number 21-751), the umbrella arm can potentially break at the elbow while it is in use and pose an injury hazard. The recall has affected approximately 250 units of the product. It is important to note that about 200 of the affected products had already been involved in a recall in 2018 due to a similar issue.

The recall specifically includes the Umbrosa Evolution Umbrellas that are equipped with the Evolution Arm/Holder which is supposed to be flexible. The umbrellas have “Umbrosa” printed on the arm/holder and were available in multiple colors. As aforementioned, the recall also includes umbrellas that were recalled in the past as well as the replacement parts provided for that recall.

The defective umbrellas were available for sale at ShadeScapes showroom in Colorado as through ShadeScapes dealers and other design professionals as well as resellers around the country from July 2018 through February 2020. The umbrellas were sold for prices ranging from $1,800 and $7,600.

According to the recall, there have been at least five reports of the defective umbrellas breaking at the elbow; however, the company claims that no injuries have been reported.

Although the company claims that no injuries have been reported, it is possible that there have been countless unreported incidents and unreported injuries. If the umbrella breaks at the elbow, it can fall and potentially strike anyone who is standing, walking, or sitting nearby.

Although every situation is different, some of the potential injuries that affected parties could experience include the following:

    • Head injuries
    • Traumatic brain injuries
    • Neck injuries
    • Back injuries
    • Fractures
    • Lacerations
    • Eye injuries
    • Bruising
    • Impaling injuries

Were you or a member of your family injured as a direct result of a defective Umbrosa umbrella? If so, you might have grounds to file a lawsuit. It is important that you find a product liability lawyer to provide you with the guidance that you need as soon as possible.
Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

What to do If You or Your Family were Injured

If you or a member of your family were injured due to the defective Umbrosa umbrellas, you could sue based on the concept of product liability because all companies owe their consumers a duty of care – a duty to ensure that their products are completely safe for their consumers. If you suffer injuries because of a defect present in the product, you could sue.

To prepare to file a lawsuit after being harmed by a defective product, you should consider the following:

    • Seek medical attention as soon as possible
    • Take photos of all injuries resulting from the incident
    • Take photos of the defective product
    • Leave the defective product as-is (do not try to repair it or tamper with it in any way)
    • Contact the company to report the defective product (do not agree to a refund, to return the product, to a replacement, or to a free repair)
    • Speak to all witnesses and collect their contact information
    • Gather any surveillance footage that captured the incident
    • Gather all medical records
    • Gather all records relevant to the purchase of the defective product
    • Seek legal assistance as soon as possible

After being harmed by a defective product, you should follow the steps listed above to prepare to file a lawsuit. A defective product attorney can help you recover a significant monetary compensation for the harm that you or a member of your family suffered due to a defective product.
