Klein Tools Voltage Testers Recall Class Action Lawsuit

Klein Tools Recall Voltage Testers liability lawyers sue compensation lawsuit

On June 9, 2021, Klein Tools issued a recall for their Non-Contact Voltage Testers (specifically, model NCVT-1). According to the recall, number 21-150, the tester could fail to work properly because “the on/off button can remain depressed during the power on or power off cycle.” Therefore, any consumers using the product to test electrical sources could fail to be warned of a live voltage and are put at risk of shock injuries. The recall affects approximately 1,690,000 products in the U.S.

The recall includes products with model number NCVT1 as well as date codes ending in H7, which were sold both individually and in kits. The testers have a yellow body housing with a gray tip as well as a black pocket tip and battery cap on the back. The model numbers are printed above the brand name, and the date codes are under the brand name. The product is CAT IV rated and can measure up to 1,000 Volts.

The following products are included in the recall:

    • NCVT1 – Non-Contact Voltage Tester
    • NCVT1SEN – Non-Contact Voltage Tester with Sensormatic Tag
    • NCVT1EP – Non-Contact Voltage Tester (Econo. Pack – Bubble Bag)
    • NCVT1TA – Non-Contact Voltage Tester (Asian Packaging)
    • NCVT1E – Non-Contact Voltage Tester (European Packaging)
    • 69149 – KIT, 3PC, Multimeter Test Kit (Retail Clam Shell)
    • 80018 – KIT, 4PC, Residential Electrical Tool Kit (Poly-Bag)
    • MPZ00001 – KIT, 2PC, Pliers + NCVT1 Tester (Clam Shell)
    • MPZ00052R – KIT, 3PC, Stripper/Cutter + NCVT1 Tester + RT210 GFCI Tester (Retail Clam Shell)

These products ranged in price from about $16 to $68. They were available at a number of locations, including The Home Depot stores, electrical wholesalers, industrial distributors, and hardware stores nationwide. They were available from January 2020 through March 2021.

The company is urging consumers to stop using the recalled voltage testers and contact them for instructions on getting a free replacement.

According to the company, there have been two reports of the voltage teste not working as it should, one of which included a shock injury.

Injuries Resulting from the Defective Product

As briefly mentioned above, the company received at least one report of a shock injury. The injury likely occurred after the product failed to warn of live voltage. Unfortunately, shock injuries are often underestimated.

Electric shock could lead to all of the following:

    • Burns
    • Cardiac arrest
    • Confusion
    • Muscle damage
    • Nerve damage
    • Respiratory issues
    • Seizures

Of course, electric shock injuries can potentially be fatal. If you or a member of your family suffered harm as a result of the defective tester recalled by Klein Tools, it is important that you explore your legal options immediately. You might have grounds to sue.

What to do if You or Your Family were Harmed

If you or a member of your family suffered harm as a result of the defective Klein Tools voltage testers, you could be eligible to file a lawsuit based on the concept of product liability, since product manufacturers have a duty to ensure that all their products are safe for consumer use. So, what if you are injured? If you are injured by a defective product, you should do the following:

    • Take photos of your injuries
    • Take photos of the defective product
    • Contact the company to report the incident and the harm that you suffered (NOTE: do not agree to a return, a replacement, or a refund)
    • Speak to witnesses and collect their contact information
    • Gather any surveillance footage that might have captured the incident
    • Collect all records of the purchase of the product
    • Collect all medical records and records of lost income due to the harm suffered
    • Seek legal assistance with a product liability lawyer immediately

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.
