American Honda Recreational Off-Highway Vehicles Recall – Class Action Lawsuit

    honda-off-highway-vehicle-recall-crash-injury-lawyer-product-liability-attorney

On June 18, 2020, American Honda issued a recall for their recreational off-highway vehicles (ROVs). According to the recall, number 20-751, the ROVs can move or roll when they are left in the park position; this poses both crash and injury risks. The recall has affected approximately 25,000 units.

The recall specifically involves models of the 2019 and 2020 Honda Pioneer 1000 and Talon 1000 (side-by-side vehicles). The vehicles listed below are included in the recall:

    • 2019 Pioneer 1000 – 3 Passenger (SXS10M3*) with VIN range 1HFVE04**K4300061 – 1HFVE04**K4301919
    • 2019 Pioneer 1000 – 5 Passenger (SXS10M5*) with VIN range 1HFVE04**K4300061 – 1HFVE04**K4302460
    • 2019 Talon 1000 – 2 Passenger (SXS10S2*) with VIN range1HFVE05**K4000003 -1HFVE05**K4003902
    • 2020 Pioneer 1000 – 3 Passenger (SXS10M3*) with VIN range 1HFVE04**L4400001 -1HFVE04**L4402426
    • 2020 Pioneer 1000 – 5 Passenger (SXS10M5*) with VIN range 1HFVE04**L4400001 -1HFVE04**L4402984
    • 2020 Talon 1000 – 2 Passenger (SXS10S2*) with VIN range 1HFVE05**L4100001 -1HFVE05**L4102280
    • 2020 Talon 1000 – 4 Passenger (SXS10S4*) with VIN range 1HFVE06**L4000002 -1HFVE06**L4002100

The ROVs were available in multiple colors, including yellow, gray, green, blue, and red. “HONDA” is located on the front, rear, and sides of the vehicle. The Pioneer 1000 models have the VIN number stamped below the tilt-up seat in the left rear of the frame. The Talon 1000 models have the VIN number stamped under the left front fender, on the left side of the frame.

The recalled ROVs were available from November 2018 through March 2020 at authorized Honda Powersports dealers throughout the U.S. The vehicles were sold for prices ranging from $15,000 and $24,000.

According to the company, there have been at least three reports of the vehicles moving while in the park position; however, the company claims that no injuries have been reported in associated with the defective product. The company is urging consumers affected by the recall to stop using the vehicles and contact an authorized dealer to schedule an appointment for a free inspection as well as a repair. Honda is directly contacting all known purchasers of the recalled product.

Although Honda claims that there have been only three reported instances of the vehicle moving in the park position, it is possible that there have been many other instances of the defect becoming apparent. In addition, it is possible that there have been unreported incidents and injuries associated with the defective product. Were you or a member of your family harmed because of a defective ROV? If so, you should not follow the recommendations made by the company; instead, you should explore the legal options available to you. The Dangers Associated with the Defective ROVs

As explained above, the ROVs can move even when they are left in the park position, resulting in a crash and injury risk. Affected consumers could suffer significant injuries, including but not limited to head injuries, traumatic brain injuries, neck injuries, spinal cord injuries, fractured bones, joint injuries, lacerations, scrapes, bruises, sprains, and strains, for example. Because the vehicles can move even when they are in the park position, it is possible for consumers to become pinned between the vehicle and a wall or a fence, for instance. This could lead to internal injuries, crushing injuries, and other harm.

Did you or a member of your family suffer harm associated with the defective Honda ROVs? If so, you might have grounds to sue. Your right to sue will likely be based on the concept of product liability.

Understanding Product Liability: You Could Sue for the Harm Suffered

You might have grounds to sue based on the concept of product liability. What is product liability? How does product liability determine your right to sue? Based on product liability, the companies owe their consumers a duty of care – a duty to ensure that their products are completely safe for consumers to use. Companies have to test and inspect their products to ensure that they are free of any hazards or defect that could potentially harm consumers. When companies breach their duty of care and release defective product to consumers, they could be responsible for the harm that their consumers suffered.

Because of this, affected consumers could pursue claims against these negligent companies. In other words, the consumers who have been harmed by defective products could pursue product liability claims. If you would like to learn more about your right to file a product liability claim against Honda, do not hesitate to seek legal assistance with the experts at our firm as soon as possible. Our lawyers are ready to provide you with all the information that you need file a claim and hold the negligent company accountable for the harm that you suffered.

    What Should I Do?

If you were harmed because of the defective Honda ROVs or any other defective product, you could have grounds to sue – you must prepare to pursue a claim to ensure that you can effectively hold the liable company accountable for the harm suffered. To prepare to pursue a claim, you should do the following:

    • Take photos of all harm suffered
    • Take photos of the defective product
    • Take photos of the scene of the accident
    • Seek medical attention as soon as possible
    • Contact the company to report the incident and harm suffered
    • Do not agree to a free repair
    • Do not agree to a free replacement
    • Do not agree to a refund
    • Do not agree to return the defective product
    • Speak to witnesses present at the time of the incident
    • Gather any video footage that captured the incident
    • Collect all medical records

    Can I Recover Compensation?

If your product liability claim reaches a successful outcome, you could be eligible to recover compensation for the harm resulting from the defective ROV. Could you really be eligible to recover compensation? The type and amount of compensation that you could recover will always be based on the details surrounding the incident, including the type of harm suffered, for example. Although every claim is different, you could be eligible to recover compensation for some of the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Property damage
    • Funeral and burial costs
    • Loss of consortium
    • Punitive damages

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

    Understanding the Statute of Limitations

If you or a member of your family suffered harm associated with a defective ROV, like those recalled by American Honda, you could pursue a claim; however, you must file your claim promptly to preserve your right to sue. All claims, including product liability claims, are subject to a statute of limitations, which determine the total length of time that claimants have to sue. If claimants do not file their claims within the time allowed by the statute of limitations, they will lose their right to sue.

What deadline applies to your claim? How long do you have to file your product liability claim against Honda? In California, product liability claims are subject to a two-year statute of limitations, meaning that they only have two years to pursue their claims. However, exceptions can apply. If any exceptions apply to your claim, the applicable deadline could be tolled or paused. To ensure that you have a thorough understanding of the time that you have to sue, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.
