Advantus Fluorescent Computer Task Lamps Recall – Class Action Lawsuit

    ledu-black-flourescent-computer-task-lamp-recall-product-liability-lawyer-compensation-sue-attorney

On September 2, 2020, Advantus issues a recall for their LEDU Black Fluorescent Computer Task Lamps (Model L283MB). According to the recall, number 20-175, the tape that is used to contain wire components within the task lamps case housing can overheat and melt; this represents a burn hazard to consumers. The recall has affected approximately 384 units.

The recall specifically includes the LEDU Black Matte Fluorescent Computer Task Lamps (Model L283MB). The lamp case housing measures about 3.5 in. in height, 1.5 in. in width, and 1.875 in. in depth. The model number can be found printed on the product packaging. On the black coating of the electrical cord, UL E157718 CSA LL101497 Type SPT-2 can be found printed. The recalled product is associated with UPC code 072743000487, which can be found on the product packaging.

The recalled task lamps were available via catalogs, independent office product dealers, and internet resellers from Stapes and Essendant. The products were also available online via Walmart.com and Lowes.com. The recalled computer task lamps were sold for approximately $136 each from February 2020 through July 2020.

According to the company, there has been at least one report of smoke coming from the lamps case housing; however, allegedly no injuries have been reported. The company is urging all affected consumers to immediately unplug the lamps and stop using them; additionally, consumers are urged to contact the company for a full refund.

Should you follow these recommendations? If you or a member of your family suffered harm associated with the defective Advantus task lamps, you should not simply agree to a refund; rather, you should explore the legal options available to you. Based on the details surrounding the situation and the harm that you or a member of your family suffered, you might be eligible to sue and recover compensation – the compensation that you could recover could potentially be more than the refund that the company might be offering you.

The Defective Product Represents a Burn Hazard
As explained above, the tape used to contain the wire components withing the lamps case housing can overheat and melt, which can represent a burn risk to consumers. If consumers touch the product, they could suffer burns ranging in severity. First-degree and second-degree burns are likely. In more severe cases, third-degree burns are also possible. These burns can cause significant pain and can lead to permanent scarring. In some cases, burn injuries could lead to nerve injuries, which can be devastating. Regardless of the harm that you or a member of your family suffered as a direct result of the defective product, you might have grounds to sue. For more information about your right to sue, contact our experts today.

    Understanding Product Liability
Your right to sue Advantus or any other negligent company for the harm that you or a member of your family suffered associated with a defective product is based on the concept of product liability. Based on product liability, companies (that is, the companies that make products available to consumers) owe their consumers a duty of care – specifically, a duty to ensure that their products are completely safe for their consumers to use. To be able to exercise this duty of care owed to consumers, companies have to test and inspect their products routinely to be able to identify and address any hazards present in the products. Even though companies owe consumers a duty of care, they often breach their duty of care – they fail to test and inspect their products and release products without identifying or addressing any of the hazards present.

When companies breach their duty of care towards their consumers, they are putting them at risk of suffering harm. A breached duty of care can directly lead to an incident, which can result in harm. If a consumer suffers harm as a direct result of a breached duty of care (or a defective product), the company could be liable based on product liability. Therefore, affected consumers could sue. If you are interested in learning more about your right to hold Advantus accountable for the harm that you or a member of your family suffered based on the concept of product liability, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.

    What Should Affected Consumers Do?
After suffering harm associated with a defective product, such as the recalled computer task lamps made available by Advantus, there are a number of things that you could do to prepare to hold the company accountable.

Consider some of the recommendations listed below:

    • Seek medical care (you should seek care even if you believe that your injuries are minor)
    • Take photos of your injuries (before and after treatment, if possible)
    • Take photos of the defective product
    • Take photos of any property damage resulting from the incident
    • Stop using the defective product (put it in a safe place where it will remain as-is)
    • Contact the company to report the incident and the resulting harm
      • Do not agree to a refund
      • Do not agree to a free repair (or a repair kit)
      • Do not agree to a free replacement
      • Do not agree to return the defective product under any circumstance
    • Speak to witnesses
    • Gather any home surveillance video that might have captured the incident
    • Gather all relevant medical records
    • Gather records associated with the purchase of the defective product
    • Seek the legal opinion of a product liability attorney as soon as possible

Is there a Class Action Lawsuit?

Can I file a class action lawsuit? How can I join or be a part of a class action lawsuit on this case? If the defective product harmed many parties, then it is likely that there is a class action claim in which you could participate. A class action lawyer can help you figure out how to join the specific class action lawsuit. In some cases, there might be mass torts rather than a class action lawsuit – mass torts are single claims against the same company. For more information about how to proceed with your claim, do not hesitate to contact our recall lawyers as soon as possible.

    You Could Be Awarded Compensation
If your product liability claim against Advantus is successful, you could recover compensation for the harm that you or a member of your family suffered. You could be eligible to recover compensation for some of the following:

    • Medical expenses
    • Lost income
    • Pain and suffering
    • Property damage
    • Funeral and burial expenses
    • Loss of consortium
    • Punitive damages

Could you be eligible to recover all the categories listed above? The specific type and amount of compensation that you could receive is strictly based on the details surrounding your claim; therefore, you should seek legal assistance with an expert on the matter to learn more about the compensation that you could recover.

When you allow the product liability lawyers at our firm to handle your claim, you can trust that our lawyers will aggressively fight for your right to recover the highest amount of compensation available for your claim.

What Statute of Limitations Applies to Your Claim?product-liability-lawyer-compensation-attorney-sue
Although you have the right to sue based on the concept of product liability, you could lose your right to sue if you fail to file your claim within the appropriate length of time. This is because all claims are subject to a statute of limitations (a deadline that ensures that claims are filed promptly). If you do not file your claim within the time allowed by the statute of limitations, you could lose your right to sue altogether.

How long do you have to sue? What statute of limitations applies to your claim? In California, product liability claims are subject to a two-year statute; this means that claimants must file their claims within two years to preserve their right to sue. However, certain exceptions could apply – which can pause the applicable statute of limitations. To ensure that you have a thorough understanding of the statute of limitations that applies to your claim, contact our experts as soon as possible.
