According to the recall, recall number 20-064, the chairs’ legs can break; this poses a significant fall and injury risk. About 6,000 desk chairs are affected by the recall.

The recall specifically involves five different collections of the Pier 1 desk chairs. The upholstered, swivel desk chairs are adjustable and have a base with five wheels; they were sold in multiple colors. On a label located on the bottom (or underside) of the seats, the specific model number, the manufacturing date code (in MMYYY format), Pier 1, and China are printed.

The recall specifically involves the following desk chairs:

The recalled desk chairs were sold from May 2019 to November 2019 at prices ranging from $260 to $450. The desk chairs were available Pier 1 stores around the U.S. as well as online via their website. According to the recall, Pier 1 has received at least 29 reports of the chair legs breaking; there has been at least one report of a minor back injury associated with the defective desk chairs. The company is urging all consumers affected by the recall to stop using the desk chairs and contact them immediately for a free repair kit.

Should you follow the recommendations established in the recall? The answer to that question depends on whether you or a member of your family suffered any harm as a direct result of the defective desk chairs. If you were not affected by the defective products, there is no reason why you shouldn’t follow Pier 1’s suggestions. However, if either you or your family were harmed because of the defective desk chairs, you should never even think about simply agreeing to a free repair kit; instead, you should consider the possibly of taking legal action against Pier 1.

If you were harmed because of a defective product, you could hold the liable company liable for the harm suffered. The defective product should have never been available for you to purchase. If you would like to learn more about your right to pursue a claim against Pier 1 or any other company after being harmed because of a defective product, do not hesitate to contact our law firm at your earliest convenience. The Defective Desk Chairs Could Lead to Harm

Many of us assume that chairs, including desk chairs, are completely safe to sit in. Before taking a seat, most of us never consider the possibility that a desk chair could break. Unfortunately, the legs in the defective desk chairs that were recently recalled can break suddenly; anyone sitting on the desk chairs when the legs suddenly break can fall and suffer injuries.

Victims could suffer a number of injuries. Some of the common injuries associated with broken and collapsing chairs include back injuries, spinal cord injuries, hip injuries, pelvic injuries, and even knee injuries, for example. Other possible injuries include neck injuries, head injuries, shoulder injuries, broken bones, and lacerations, among others.

Although many of these injuries could be disregarded as minor, some injuries could be severe and life-altering. Regardless of the specific harm that you or a member of your family suffered because of the defective desk chairs recently recalled by Pier 1, you might have grounds to take legal action – do not hesitate to seek legal assistance immediately.

About Product Liability and Your Right to Sue

Do you have the right to file a claim if you or a member of your family was harmed by a defective desk chair? Depending on the details surrounding your claim, you might have grounds to pursue a claim – specifically, a product liability claim. Why do you have the right to sue? Your right to sue is based on the concept of product liability. That is, all companies that make products available to the public owe their consumers a specific duty of care. They owe their consumers the duty to ensure that their products are completely safe for use. When companies breach their duty of care towards their consumers (by failing to identify and address the hazards present in their products), companies are negligently putting their consumers at risk of harm. When the defective product causes an incident and the consumer is harmed, the company could be held accountable.

If a defect in a product’s design, labeling, or manufacturing resulted in the harm that you or a member of your family suffered, you might have grounds to pursue a claim. If you would like to learn more about product liability and your right to sue for the harm that you suffered because of a defective product, do not hesitate to contact our law firm at your earliest convenience.

    You Could Recover Compensation

If you sue Pier 1 for the harm that you or a member of your family suffered because of their defective desk chairs, a successful outcome could result in the recover of monetary compensation. How much compensation could you be eligible to recover? What type of compensation could you receive? The answer to these questions always depends on the specific details surrounding your claim. For example, when comparing two cases, the case in which the victim suffered more extensive and more permanent harm will likely be worth more. Because determining claim values could be so complex, we always recommend speaking with an attorney immediately.

Depending on the details surrounding your claim, you could be eligible to recover monetary compensation for all or some of the following:

    • Medical expenses
    • Lost earnings
    • Pain and suffering
    • Property damage
    • Loss of consortium
    • Funeral and burial costs
    • Punitive damages

If you would like to learn more about the type and amount of compensation that you could be eligible to receive, do not hesitate to seek legal assistance with the experts at our law firm as soon as possible. Our lawyers are ready to help you understand your claim’s value. Our product liability lawyers are also ready to aggressively fight for your right to be compensated. Our lawyers will not rest until you recover the maximum amount of compensation available for your claim.

    Preparing for Your Claim

Without a doubt, you might have grounds to file a claim and even recover compensation. However, it is possible for your actions – or lack of actions – to negatively affect the possibility of pursuing a claim. If you were harmed by a defective product, there are a number of things that you should do to prepare to file your claim and essentially better the chances of reaching a successful claim outcome.

What should you do? You should follow the suggestions below:

    • Take photos of all harm suffered
    • Seek medical attention immediately
    • Take photos of the defective product
    • Gather the pieces of the defective product and store them in a safe place
    • Contact the company to report the incident and harm suffered
    • Do not agree to a free repair, a free replacement, a refund, a voucher, or to return the defective product to the company
    • Gather all records associated with the purchase of the defective product
    • Gather all medical records associated with the harm caused by the defective product
    • If applicable, gather any home surveillance footage that might have captured the incident
    • Seek legal assistance as soon as possible

By following these recommendations, you are essentially preparing to file your claim. You are gathering the tools necessary to take action against the company liable for the harm that you or a member of your family suffered. To learn more about the steps that you should follow to prepare to take legal action after being harmed by a defective product, do not hesitate to contact us immediately.

Your Claim is Subject to Deadlines

Did you know that you could lose your right to file a claim if you fail to file within the appropriate length of time? All claims are subject to strict deadlines, or statutes of limitations. The statute of limitations that applies to your claim determines the total length of time that you have to file. What happens if you do not file your claim on time? If you do not file your claim on time, you will likely lose your right to sue – and lose your right to receive any sort of compensation for the harm suffered. What deadline applies to your claim? In California, product liability claims are subject to a two-year statute of limitations, meaning that claimants typically only have two years to file their claims; however, certain exceptions could apply. What does this mean? Based on the details surrounding your claim, exceptions to the statute of limitations could apply and toll the applicable deadline. Exceptions could apply under a number of circumstances. For example, if the injured victim is left mentally incompetent (or in a coma) because of the injuries suffered, an exception could apply and the statute of limitations would be paused until the victim regains mental competency.

To ensure that you have a thorough understanding of the statute of limitations (and possible exceptions) that might apply to your claim, do not hesitate to contact our law firm at your earliest convenience.
