The model number can be found printed on the labels in each of the individual product boxes/cartons. The boxes/cartons also have a manufacturing date code printed; the date codes include the following: 43U, 44U, 45U, 47U, 48U, 49U, 50U, 51U, 52U, 53U, 01V, and 02V. Some of the receptacles might also have manufacturing date codes MU, NU, PU, and AV hot-stamped on the back. “Legrand” can be found printed on the back of the receptacles.

The defective receptables were sold at electrical equipment supplies and other stores around the nation from October 2019 to February 2020; the receptables were sold for prices ranging from $3 to $10. According to the company no incidents or injuries have been reported associated with the recalled product.

The company is urging affected consumers to stop using the recalled electrical receptacles and contact them for a free replacement or a refund (in the form of a credit). Should you follow this recommendation? Only those who were not harmed by the defective product should follow the company’s recommendations. If you were harmed by the defective product (that is, if you suffered burns), you should not simply settle for a free replacement or a refund; instead, you should seek legal assistance immediately.

Based on the details surrounding your incident and the harm that you suffered, you might have grounds to sue – you might even have grounds to recover monetary compensation for the harm that you suffered. Specifically, you might have grounds to file a product liability claim against Pass & Seymour or any other company that negligently released a defective product to the public. Understanding Product Liability

As explained above, a manufacturing error could potentially lead to consumers forcing plugs into the receptacles, which can overheat and cause burns. Could the company be liable for the burns that unsuspecting consumers suffer due to the defective product? The answer is simple; yes, the company could be liable. The company could be liable for all harm caused by their defective product based on the concept of product liability. Based on product liability, all companies owe their consumers a duty of care – the duty to ensure that all products are safe for consumers to use. Typically, companies must test and inspect their products to be able to identify (and address) any hazards present in manufacturing, design, or even labeling. When companies fail to identify and address the hazards present in their products, they are breaching their duty of care towards their consumers. In addition, they are also putting innocent consumers at risk of suffering harm.

When companies breach their duty of care and recklessly release defective products to the public, incidents can occur. When these incidents lead to harm, companies could be liable for all the harm suffered – given that the incident was directly associated with the defective product. If you would like to learn about product liability and how companies could be liable for the harm resulting from a defective product, do not hesitate to seek legal assistance with the experts at our firm today.

    Your Right to Sue

Do you have the right to sue for the harm that you suffered due to a defective product? As explained above, companies could be at-fault for the harm caused by the defective products that they negligently make available to the public. What does this mean? Based on product liability, affected consumers have the option to sue companies for the harm that they suffered. If you would like to learn more about your right to sue based on the concept of product liability, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience.

    Could You Recover Compensation?

Since you have the right to sue for suffering harm associated with a defective product, you might also have the right to recover monetary compensation. Could you really be compensated? If so, how much compensation could you be eligible to receive? What type of compensation could you recover? The type and amount of compensation available for your product liability claim will always be based on the details surrounding your claim.

Some product liability claims can lead to the recovery of the following types of compensation:

    • Medical expenses
    • Lost income
    • Pain and suffering
    • Property damage
    • Punitive damages

If the harm suffered leads to the death of the victim, surviving family members might also be eligible to recover compensation for funeral and burial fees as well as loss of consortium.

To learn more about the type and amount of compensation that you could be eligible to receive if your claim reaches a successful outcome, do not hesitate to contact the experts at our firm immediately. Our product liability lawyers are ready to aggressively fight for your right to recover the highest amount of compensation available for your claim. What Should You Do?

Although many consumers have never been affected by defective products, all consumers should be aware of the specific actions that they should take in the case that they are ever affected by defective products. What should consumers do after being harmed by a defective product? If you or a member of your family suffered harm associated with a defective product, you should follow the recommendations listed below:

    • Take photos of any visible injuries caused by the defective product
    • Seek medical attention immediately
    • Take photos of the defective product
    • Take photos of any property damage caused by the defective product
    • Stop using the defective product
    • Do not tamper with the defective product in any way
    • Contact the company to report the defect and the harm suffered
    • Do not agree to a free repair, a free replacement, or a refund
    • Do not agree to return the defective product
    • Speak to witnesses present at the time of the incident and gather their contact information
    • Gather all medical records associated with the harm suffered
    • Gather all documents relevant to the purchase of the defective product
    • Gather any documents associated with property damage caused by the defective product
    • Seek legal assistance immediately

    Understanding the Statute of Limitations

Without a doubt, you might have grounds to pursue a claim based on the details surrounding the incident and the harm that you suffered. However, it is important that you are aware that your claim is time sensitive. Even if you follow the recommendations listed above, you could lose your right to sue if you fail to file your claim within the appropriate length of time.

This is because all claims – including defective product claims – are subject to a statute of limitations, which determines the time that claimants have to pursue their claims. If claimants fail to file their claims within the time allowed by the applicable deadlines, they will lose their right to sue.

How long do you have to pursue your claim? In California, product liability claims are typically subject to a two-year statute of limitations. In other words, claimants have two years to pursue their claims. Besides the time allowed by the statute of limitations, it is important that claimants are familiar with any potential exceptions that could apply to their claims. That is, based on the details surrounding your claim, exceptions that toll (or pause) the applicable statute of limitations could apply.

To ensure that you have a thorough understanding of the total length of time that you have to pursue your product liability claim against Pass & Seymour, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience.
