Defective Product Lawyer | Ozark Trail Camp Axes

On October 3rd, 2018, Walmart recalled nearly a quarter of a million camp axes due to injury hazard. The 246,000 Ozark Trail camp axes had a defect that allowed the axe head to separate from the handle, creating a distinct risk for injury. To date, there have been two reports of individuals suffering cuts and abrasions. It is recommended that users immediately stop using the axe and return them to Walmart for a full refund.

The axes were sold in Walmart retail stores and online stores for $8 for about a year and a half, from January 2017 to July 2018. They were manufactured in India by Gardex and imported into Arkansas.

To identify the axes, look for the model number 60111140 on the product’s packaging. The name of the company, Ozark Trail, is present as well. The axes themselves are a little over a foot long and weigh over a pound. The steel is offset by the rubber grip allowing for easier usage, and the head of the axe has an indentation, or claw.

    Product Liability Information

You can file a product liability claim against the responsible party if you were harmed by the item because of a defect. You must have been using the item as intended; if you were using it in a way that is not recommended, it may be harder or impossible to win a claim. There are a few ways that you can determine the liable party for a defective item.

    • Design defect: There was a flaw in the design of the product that should have been found out prior to the creation of any items. This may be in part due to faulty designers, pushy management, typos, and more.
    • Manufacturing defect: There must have been some kind of mistake when the product was being created. There might have been something get caught in the machine or assembly line, or something may have not been properly screwed in.
    • Warning Sign: If a product can potentially harm you or if it poses a danger, it should be appropriately marked with a warning sign to give ample heads-up to a customer. The hazard sign can be on either the packaging or the item itself.

Steps to Take in a Defective Product Claim

If you have been hurt by a broken item or a defective product, you should follow this procedure to have the best chance of successfully winning your lawsuit.

Firstly, you should not throw the item away or return it to the store. You should hold on to it at all costs, or at the very least, take pictures if it is particularly urgent. The evidence will be destroyed if it is handed back to Walmart.

You should not try to fix the product with yourself or tamper with it. This could void any possible warranty. If you accidentally cause more damage, the insurance agent could claim that there is no surefire way to tell what the original damage is or that you weren’t wrongfully using the item.

It is wise to get medical attention as quickly as possible after the accident happens. There should not be a gap between the incident and your medical treatment. A gap can mean trouble for your case. Insurance agents can look at the length of time between the injury and the treatment and claim that you were obviously hurt elsewhere.

One of the most important pieces of evidence you will have in conjunction with the item itself is the receipt or proof of purchase of the item. You could have a paper receipt, a credit card statement, a confirmation email, and more.

Lastly, you should reach out to a product liability attorney to handle your claim for you. It is likely that you will not have legal experience required to negotiate the best deal from Walmart and you will not have the time needed to work on winning the claim. You may even be outright denied any chance to stand up for yourself. Fortunately, our lawyers can see to it that you get the fairest treatment possible.

Earnings from a Product Liability Lawsuit

A product liability lawsuit can result in numerous kinds of compensation for your damages. You may be able to receive overage for alt h debts stemming from the incident. For instance, you could receive:

    • Coverage for medical expenses
    • Reimbursement of lost wages
    • Compensation for emotional pain and suffering
    • Repair and replacement costs for any damaged property

In extreme cases, a defective product could lead to a fatal accident, such as in the case of automobiles. You would then be able to receive wrongful death expenses to cover the costs of the funeral.
