The Dangers of the Defective Gun Holsters

According to the recall mentioned above, a defective retention strap can suddenly become disconnected and cause the gun in the holster to fall, potentially discharging. If the gun fires upon falling from the holster, injuries could occur.

Some of the harm associated with discharging guns include the following: flesh wounds; nerve, ligament, and muscle damage; traumatic brain injuries; shattered bones; soft tissue injuries; hemorrhaging; spinal cord injuries; paralysis (quadriplegia and paraplegia alike); organ damage; coma; death.

If you own one of the defective gun holsters and suffered any sort of harm, it is essential that you seek the appropriate medical care. After you have received the necessary treatment to address your injuries, it is essential that you explore the possibility of pursuing a claim and fighting for your right to recover compensation for the harm that you suffered.

    Understanding Product Liability

Is Mystery Ranch liable for the harm that you suffered because of their defective gun holsters? Based on product liability, companies could be liable for the harm that their consumer suffered, given that the harm consumers suffered was directly associated with a defect in the product’s design, labeling, or manufacturing. All companies have a duty of care towards their consumers – they must ensure that their products are safe for consumer use. This means that companies must thoroughly inspect their products and subject them to tests to ensure that they are safe to be used by consumers.

When companies fail to inspect and test their products, it is also likely that they fail to identify and address any hazards present in their products. This represents a breached duty of care. As soon as a breach of duty results in an incident that ends in any sort of harm to the consumer, the company could be found liable.

If you would like to learn more about establishing liability for any incidents involving the Mystery Ranch gun holsters that were recently recalled, do not hesitate to seek legal assistance at your earliest convenience.

    Suing and Recovering Compensation

Based on product liability, you might be able to file a product liability lawsuit if you were harmed due to a defective product. This means that you could also be eligible or receive monetary compensation upon reaching a positive claim outcome. If you are thinking of the possibility of pursuing a claim, you might also be thinking of the specific compensation that you could be eligible to recover. Could you really be compensated? What type of compensation could you receive? How much compensation could you be eligible to receive?

The type and amount of compensation that you might be eligible to recover if your claim reaches a successful outcome will always depend on the specific details surrounding your claim. Although every claim is different, the compensation that you could recover could include the following:

    • Medical expenses
    • Lost wages

How Long Do You Have to Sue?

Although following the steps above could help you prepare to pursue your claim, following the steps can quickly prove pointless if you fail to file within the appropriate length of time. In fact, many people with legitimate claims lose their right to sue simply because they fail to file within the appropriate length of time. All claims are subject to a statute of limitations. A statute of limitations determines the specific length of time that claimants have to file their claims. If claimants do not file on time, they could lose their right to sue, and their right to receive any form of compensation.

What deadline applies to your claim? In California, product liability claims are typically subjected to a two-year statute of limitations, meaning that claimants only have two years to file their claims. However, exceptions could apply. Therefore, it is essential for those interested in filing a claim to discuss any applicable deadlines with an attorney. If you would like to learn more about the statute of limitations that applies to your claim, do not hesitate to seek legal assistance with our experts immediately.
