Modus Furniture Recalls Dressers Due to Tip-Over and Entrapment Risk

Modus Furniture Recalls Dressers tip over lawyer attorney sue compensation

On June 18, 2020, Modus Furniture issued a recall for their Brighton, Travis, and Bevelle dressers. According to the recall, number 20-752, the dressers are unstable if the mirrors are not installed; the dressers pose a tip-over and entrapment risk that could lead to injuries or death to children. The dressers also fail to comply with performance requirements of the U.S. voluntary industry standard. In addition, the tip-over restraint kits also fail to comply with performance requirements.

The recall has affected approximately 1,300 products. All the following dressers are included in the recall:

    • Brighton nine-drawer dressers
    • Bow-front dressers
    • Travis nine-drawer dressers
    • Travis nine-drawer double dressers
    • Bevelle dressers
    • Wooden nine-drawer dressers

The dressers were manufactured from November 2017 through February 2019. The dressers are approximately 63 inches wide by 20 inches deep and 41 inches high. The dressers weigh approximately 245 pounds each. The recalled dressers have a label on the back which has the manufacturing date as well as “MADE IN INDONESIA.”

The recalled dressers were sold at Costco as well as other furniture stores nationwide; they were also available online. The dressers were available from November 2017 through December 2019. They were sold for prices ranging from $700 to $1100.

According to the company, no incidents or injuries have been reported. The company is urging all affected consumers to keep the dressers away from children until they have been repaired. The company is offering a free tip-over restraint kit (compliant with safety standards) as well as a one-time, free, in-home installation of the restraint kit. All known purchasers of the recalled dressers are being contacted directly.

The company is offering solutions for consumers affected by the recall. Should you agree to any of these suggestions? If your child suffered harm as a direct result of the defective product, you should not even consider agreeing to a free tip-over restraint kit or a free installation. Instead, you should consider the possibility of taking legal action against the company – for negligently making the defective product available for purchase.

Based on the details surround the incident, you might have grounds to file a product liability claim. You could sue for the harm that your child suffered associated with the defective product. If you would like to learn more about your right to sue for the harm that your child suffered – whether he or she suffered injuries or death – do not hestiate to seek legal assistance with the experts at Normandie Law Firm at your earliest convenience.

    The Tip-Over and Entrapment Hazard

Dressers are often recalled due to tip-over and entrapment risks to children. The tip-over and entrapment hazard is easily one of the most severe risks that children are exposed to due to defective products. The hazard can cause devastating injuries and death. Young children often climb furniture to gain access to elevated areas; it is something that most children do at some point. There are many types of furniture that is relatively safe for children to climb; however, many types of furniture (such as drawers) can become unstable with the added weight of the child; therefore, they can tip over and fall on the child.

If a dresser tips over and falls on a child, a child could suffer a number of injuries, including head injuries, traumatic brain injuries, crushing injuries, broken bones, sprains, strains, lacerations, and bruises, for example. When a dresser tips over, it is likely that the child will become entrapped under the dresser. The weight of the dresser could result in additional harm, including suffocation, oxygen deprivation, brain damage, and death. Even if the child survives the tip-over incident, the entrapment could complicate the incident and cause additional harm.

Was your child harmed in a tip-over and entrapment incident associated with a defective product? If so, do not hesitate to seek legal assistance with the experts at our law firm as soon as possible. Depending on the details surrounding the incident and the harm that your child suffered, you might have grounds to take legal action.

You Can Sue Based on Product Liability

If the harm that your child suffered could be directly associated with a defective product, you might have grounds to sue based on product liability. Why do you have the right to sue? Consumers affected by defective product have the right to sue because, based on product liability, companies owe their consumers a duty of care – a duty to ensure that products are completely safe for consumers to use. They must test/inspect all products thoroughly to be able to identify/address any hazards present. When companies fail to do this, they are breaching their duty of care towards their consumers. They are also putting their consumers at risk of suffering incidents and harm.

Because of this, whenever a breached duty of care – or a defective product – leads to an incident and the harm that a consumer suffered, the companies that made the defective product available for consumers could be held accountable for all harm suffered. This means that consumers could sue the at-fault companies. Would you like to learn more about product liability and your right to sue? If so, do not hesitate to seek legal assistance with the experts at our firm immediately.

You May Be Eligible to Recover Compensation

Depending on the details surrounding the product liability claim, you and your family might be eligible to recover compensation for some of the following:

    • Medical expenses
    • Pain and suffering
    • Lost wages
    • Property damage
    • Funeral and burial costs
