Man with Stab Wounds Arrested after Sexual Assault of a Minor at a Long Beach Denny’s – Sexual Assault Lawyers

The Long Beach Police Department responded to the Denny’s restaurant located on the 600 block of Long Beach Boulevard at around 1:39 a.m. after receiving a call of sexual assault involving a minor in the restaurant. According to reports a Good Samaritan noticed what was happening and got help. Civilians detained the man – who has been identified as Jimmie Kirkwood (33 years old) – until officers arrived at the scene.

When officers arrived, they found that he had stab wounds; he was transported to a local hospital for medical treatment. It is unclear whether the stab wounds occurred during the attempted sexual assault of the minor or during a previous incident.

The suspect is accused of lewd and lascivious acts with a child under 14 years old, assault with the intention to commit rape, and false imprisonment, according to the police department.

    The incident remains under investigation.

Sexual assault, without a doubt, remains a significant and ever-present issues in busy establishments like Denny’s. Although most people can go into a Denny’s and enjoy their meal without having any issues whatsoever, some people can find themselves involved in incidents, like sexual assault. Unfortunately, Denny’s typically do not have on-site security. In many cases, anyone can walk in, even if they are not customers, with the excuse of using the restaurant’s restrooms. Of course, if anyone that is unstable or has bad intentions encounters someone in the restroom – especially a minor – horrible things could happen.

If you or a loved one suffered sexual assault at a Denny’s restaurant, you might be wondering whether you could take any action. Depending on the details surrounding the incident, you could sue. You could, of course, sue the attacker, but you could also have grounds to sue the restaurant owner. Sexual Assault and Its Lasting Effects

Sexual assault can be defined as any unwanted sexual contact, which can include the following:

    • Rape and attempted rape
    • Forcing the victim to perform any sexual acts
    • Groping, fondling, kissing, or any other unwanted touching

Sexual assault can lead to significant physical harm as well as extensive mental and emotional harm. Some of the physical harm that victims could experience include sexually transmitted infections, unwanted pregnancies, organ damage (specifically to reproductive organs), injuries to genitals, etc. In addition, the use of excessive force during an attack can also result in head injuries, fractures, lacerations, bruises, etc.

Examples of the mental and emotional harm resulting from sexual assault include fear, depression, anxiety, post-traumatic stress, etc. This type of harm can often be long-lasting and require many years of therapy. In fact, many victims of sexual assault continue to suffer from mental and emotional distress long after their physical injuries have healed.

Liability for Sexual Assault Incidents at Restaurants like Denny’s

Who is liable for the sexual assault that you suffered? Of course, the person who attacked you and committed the sexual assault can be liable. However, when the sexual assault occurred on the premises of a restaurant, like Denny’s, the property owner could also have at least some liability. This is because property owners owe their guests a duty of care. Specifically, they must ensure that their premises are free of any dangers – including dangers presented by others on their property. Some examples of hazards that could actually increase the risk of sexual assault include poorly lit areas, isolated areas, lack of surveillance cameras, lack of security guards, poorly trained employees, negligent hiring or employees/security, etc.

Although property owners cannot control the actions of those who enter their premises, they can take a number of steps to reduce their risk of sexual assault on their premises. If you or a loved one suffered sexual assault at a Denny’s or other diner, then you might have grounds to file a sexual assault lawsuit against the restaurant owner. For more information about the legal options available to you and your family after being sexually assaulted at a Denny’s or another restaurant, do not hesitate to seek legal assistance with the experts at our law firm immediately.
