Both the model numbers and the serial numbers are located on the data plate which is on the unit rating plate (found on either the outer jacket or the underside of the removable front jacket plate). The brand name can be found printed on the front of each unit.

The defective boilers were available for purchase via independent contractors, plumbers, and plumbing supply vendors and distributors. The recalled products were available from August 2016 to June 2020. The defective boilers were available for between $8,000 and $25,000 (including installation fees).

According to the company, there have been at least seven reports of the boilers’ flue grommets deteriorating; one of the reports consisted on carbon monoxide poisoning while two of the reports consisted of emission of carbon monoxide albeit without injury.

The company is urging affected consumers to immediately contact either the installer or a qualified technician to schedule a free repair. The company is also urging consumers who continue using the boilers while awaiting repairs to have functional carbon monoxide alarms outside all sleeping areas and on every level of the home.

Although a free repair seems convenient, you should not follow the suggestions of the company if you or a member of your family suffered harm associated with the defective boilers. Instead, you should seek legal assistance immediately to explore the legal options available to you. Based on the details surrounding the incident, you might have grounds to pursue a product liability claim for the harm suffered. If you would like to learn more about the possibility of pursuing a claim against Lochinvar, do not hesitate to contact the experts at our firm today.

The Dangers of Carbon Monoxide Poisoning

Carbon monoxide is a tasteless, colorless, and odorless gas that is produced by burning fuel (such as gasoline, propane, wood, or charcoal, among others). Appliances that are not properly ventilated or that are defective could release carbon monoxide; if the release of the gas occurs in enclosed spaces, carbon monoxide levels can reach dangerous levels. Carbon monoxide poisoning can cause a number of symptoms, which include headaches, weakness, dizziness, nausea/vomiting, shortness of breath, blurred vision, confusion, and loss of consciousness. Although individuals who experience such symptoms can usually address the situation, individuals who are sleeping or intoxicated are at a significant risk of developing permanent damage and even losing their lives.

Product Liability and Your Right to Sue

Did you or a member of your family suffer harm associated with a defective product? Whether you suffered injuries or a member of your family lost his or her life because of a defective product, you might have grounds to take legal action – your right to sue is likely based on the concept of product liability. What is product liability? Based on the concept of product liability, all companies owe their consumers a duty of care – a duty to ensure that all products are safe for consumers to use. Typically, companies must test and inspect the products present in their products; this allows companies to identify the defects present in their products – and quickly address them.

Unfortunately, companies do not always exercise their duty of care; they can breach their duty of care and fail to identify and address any hazards present in their products. Therefore, they negligently release their defective products and put their consumers at risk of injury. When consumers are harmed because of their defective products, the company that negligently made the product available to consumers could be liable. What does this mean? If consumers are harmed by defective products, they could pursue product liability claims against the companies.

If you would like to learn more about your right to file a product liability claim for the harm that you or a member of your family suffered, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience. Our lawyers are ready to guide you ever step of the way.

    What Should You Do?

If you or a member of your family suffered harm associated with a defective product, such as the defective Lochinvar boilers, there are a number of things that you should do to prepare to pursue your claim. What should you do to prepare to file a claim and hold the negligent company accountable for the harm suffered? Affected companies should always do the following:

    • Take photos of any visible injuries
    • Take photos of the defective product
    • Seek medical attention immediately
    • Stop using the defective product (keep it a safe place as-is)
    • Contact the company to report the defective product and the harm suffered
    • Do not agree to a free repair, a free replacement, or a refund
    • Do not agree to return the defective product
    • Speak to witnesses present at the time of the incident
    • Gather any surveillance footage of the time of the incident
    • Gather records associated with the purchase of the defective product
    • Gather medical records associated with the harm suffered
    • Seek legal assistance immediately

For more information about the recommended steps that affected consumers should take after being harmed by a defective product, do not hesitate to seek legal assistance with the experts at our firm immediately. Our lawyers are ready to guide you every step of the way – until you reach a successful claim outcome.

    Could You Recover Monetary Compensation?
If your claim reaches a successful outcome, you might be eligible to recover compensation for all the harm suffered. What could you be eligible to receive? The type and amount of compensation that you could be eligible to recover will always be based on the details surrounding your product liability claim, and it could include some of the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Property damage
    • Funeral and burial costs
    • Loss of consortium
    • Punitive damages

For more information about the type and amount of compensation that you could be eligible to receive, do not hestiate to contact the experts at our firm at your earliest convenience. Our lawyers are ready to aggressively fight for your right to recover the highest amount of compensation available for your claim. You can be certain that our attorneys will not rest until after you recover the compensation that you deserve.

    The Statute of Limitations

How long do you have to pursue your product liability claim? All claims are time sensitive. More specifically, all claims are subject to a statute of limitations, which determines the specific length of time that claimants have to pursue their claims. If claimants do not file their claims on time, they will – unfortunately – lose their right to sue. What deadline applies to your claim? In California, product liability claims are normally subject to a two-year statute of limitations, which means that claimants only have two years to file their claims. However, exceptions could apply, exceptions that could toll or pause the applicable deadline. To ensure that you file your claim on time and that you have a thorough understanding of the statute of limitations (and possible exceptions) that apply to your claim, do not hesitate to contact our firm as soon as possible.
