Kids II Recalls Baby Sleepers – Infant Deaths

In late April 2019, Kids II issued a recall for all their models of rocking sleepers. According to the recall (number 19-112), the baby sleepers are hazardous to infants – specially when infants roll from their backs onto their stomachs (or sides) while unrestrained in the sleeper. This recall affected approximately 694,000 Kids II products and with good reason. Since 2012, there have been at least 5 reported infant deaths associated with the sleepers. In all recorded deaths, the infants rolled onto their stomachs while on the sleepers and suffocated. In late April 2019, Kids II issued a recall for all their models of rocking sleepers. Understanding the Danger Associated with Baby Sleepers

Up to 4,000 infants die annually in the U.S. in incidents associated with sleepers. There is a lot of information available that claims that infants can die after rolling onto their stomachs or sides due to suffocation. Although death due to suffocation is very likely, some infants survive; however, survivors of suffocation are usually left suffering permanent brain injuries. As parents, we trust that baby sleepers – and all other baby products – are safe for our infants. Unfortunately, we can never be too trusting of these products; even if we use them correctly, they can prove to be death traps. If your baby lost his or her life – or suffered permanent brain damage – due to suffocation in the defective baby sleepers, do not hesitate to explore the possibility of taking legal action against the appropriate party.

Understanding Liability for the Harm Caused by Defective Products

If your baby died or suffered permanent brain damage, is anyone liable? Who can be held accountable for the harm that your infant suffered after being harmed by a defective baby sleeper? Understanding liability for the harm suffered due to a defective product is one of the most important aspects of pursuing a claim. To understand liability, you must be aware of the specific duty of care that all companies have towards their consumers.

All companies have the duty to ensure that their products are safe for consumer use prior to making them available for purchase. They must do the appropriate research, subject their products to the appropriate inspections/tests, and address any hazards present in their products to ensure that their products are completely safe for consumers. When companies fail to ensure that their products are safe, they are creating the risk of harm for their consumers – they are also breaching their duty of care to their consumers. When this breach of duty directly causes harm, either in the form of injuries or death, the company will be held liable.

What does this mean? Because Kids II failed to identify and address the hazard in their defective products prior to making them available to the public, Kids II can be held accountable for all the harm caused by their defective products. If you would like to learn more about establishing liability for the harm caused by defective products, do not hesitate to seek legal assistance with the experts at our law firm. Our product liability experts are ready to provide you with all the information that you need to take legal action against the company liable for the harm that your infant and your entire family suffered.

Do You Have the Right to Pursue a Claim?

How was your infant affected by the defective product? Did your child suffer permanent brain damage? Did your child lose his or her life? Regardless of the harm that your infant suffered, you will likely have grounds to pursue a claim; however, the specific legal action that you decide to take can vary.

You will likely have some of the following options available:

• You could pursue a product liability claim if the defective product resulted in your infant’s permanent brain injuries. These claims are based on the fact that companies failed to ensure their products were safe for use prior to making them available to the public.
• You could pursue a wrongful death claim if the defective product directly resulted in your infant’s death. These claims are based on the fact that the deceased victims would still be alive had the company acted rightfully.
• You could pursue a class-action lawsuit if there are multiple cases similar to yours. These cases are based on the fact that the actions of one company affected many parties.

If you would like to learn more about the options available to you after your infant was harmed by a defective baby sleeper, do not hesitate to seek legal assistance with the experts at Normandie Law Firm as soon as possible. Our lawyers are ready to provide you with the guidance that you need to take the appropriate legal action.

Could You Recover Compensation?

If you infant was harmed as a result of a defective product, could you recover any sort of compensation? Your right to recover compensation depends on the specific details of your claim. Without a doubt, monetary compensation cannot reverse what has already happened; however, it can definitely help you and your family move forward and start working towards overcoming such a traumatic time in your life.

In general, claimants could recover compensation for at least some of the following:

• Medical expenses
• Lost earnings
• Pain and suffering
• Loss of consortium
• Funeral and burial costs
• Punitive damages

Regardless of the specific type of compensation that you might be eligible to recover, you can be certain that the experts at Normandie Law Firm will always aggressively fight for your right to recover the maximum amount of compensation available for your claim. You can trust our lawyers to always do everything within their reach to ensure that you can recover the compensation that you deserve.

What Should You Do?

What are the things that you should do after your infant was harmed due to a defective baby sleeper? After either suddenly losing your child or seeing your child suffering a permanent brain injury, filing a claim might not even be a priority. Without a doubt, you and your family will need time to heal after even considering the possibility of filing a claim. Even if you are not immediately thinking of pursuing a claim against Kids II, it is essential that you take certain actions immediately after your infant is harmed.

These recommended actions include the following:

• Seeking a professional evaluation to determine the cause of death or cause of the permanent brain injuries
• Contacting the company to report the defective product and the harm suffered
• Never accepting any offers (such as refunds or vouchers)
• Never sending the defective baby sleeper to the company
• Never signing any documents without the expert opinion of an attorney
• Seeking legal assistance immediately to determine the best option for you and your family

You might not have the desire to take any action after your infant was harmed by a defective product. However, you must find the strength to at least find a trustworthy lawyer to handle your claim.
