    The Risk of Injury

Infants are very frail and can suffer significant injuries very easily. As mentioned above, the recalled infant carriers are defective because the buckles can suddenly break. If the buckles break, the infant being carried in the carrier could fall. If infants fall, they could suffer a variety of injuries, including but not limited to the following: head injuries; traumatic brain injuries; neck injuries; back injuries; spinal cord injuries; rib fractures; broken arms; broken legs; shoulder injuries; sprains and strains; lacerations; bruises. Because infants are so frail, they are likely to succumb to their injuries. Even if infants survive such a fall, their injuries could lead to permanent damage. For example, it is obvious that a head injury could cause permanent brain damage that could affect development; however, even something as simple as a broken leg could affect development and result in a delay in walking or even a permanent limp, for instance. Regardless of the harm that your infant suffered because of the defective carrier, you should explore the possibility of taking legal action against the company that negligently made the defective product available for consumers.

    About Product Liability

Could you pursue any legal action if your infant suffered harm because of a defective product? If a defect in a product’s design, labeling, or manufacturing contributed to the harm that your infant suffered, you might have grounds to file a claim. Specifically, you might have grounds to file a product liability claim. Could you really sue a company, such as Infantino?

Your right to pursue a claim against Infantino or any other company is based on product liability. Product liability establishes that all companies owe their consumers a duty of care; specifically, companies have the duty to ensure that their products are safe for consumers to use. To ensure that all their products are safe for their consumers, companies must inspect and test their products (often repeatedly) to be able to identify and address any hazards that could be present in their products.

As mentioned above, companies have the duty to ensure that their products are safe for consumers to use. If they fail to do so, they are breaching their duty of care and putting their consumers at risk of injury. Defective products are representations of a breached duty of care; whenever a breach of duty directly contributes to the harm an innocent consumer suffers, the company could be held accountable based on product liability.

If you would like to learn more about product liability and about how you could hold Infantino accountable for the harm that you suffered, do not hesitate to contact our law firm today.

    What Should You Do?

As parents, it can be difficult for us to think straight after our infants suffered some sort of harm. It is important to stay calm and act accordingly. If your infant was harmed, you might have grounds to take legal action; however, the actions that you take after your infant was harmed can determine whether you could pursue a successful claim or not.

What should you do? Consider the following recommended actions:

    • Seek medical attention immediately. You might need to contact emergency services.
    • Take photos. You should take photos of any visible injuries that your child suffered (including bruises, scrapes, lacerations, and swelling, in general). You should also take photos of the defective product.
    • Stop using the defective product. Immediately stop using the defective product. Do not place your infant in the defective product or allow other infants to be placed in the defective product.
    • Store the defective product in a safe place. Keep the defective product in a place in which it will remain as-is. Do not tamper with the defective product in any way after the incident.
    • Contact the company. Contact Infantino to report the defect present in their product and the harm that your infant suffered. Do not reveal any information that could be used against you.
      • Never agree to a free repair
      • Never agree to a free replacement
      • Never agree to return the defective product
      • Never agree to a refund or voucher
      • By agreeing to a repair, replacement, return, or refund, you are giving up your right to take any legal action.
    • Speak to witnesses. If anyone witnesses the carrier’s buckles suddenly breaking and your infant falling, their testimony will be essential. Gather their contact information.
    • Check for surveillance cameras. Depending on the location in which the incident occurred, the incident might have been captured by surveillance cameras.
    • Gather all medical records. Gather all medical records surrounding the harm that your infant suffered. If your infant lost his or her life, gather records surrounding his or her death (in which the cause of death is clear).
    • Gather all purchase records. Gather all records associated with the purchase of the defective product, including but not limited to receipts, order confirmations, and bank statements, for example.
    • Seek legal assistance. Contact a product liability attorney to discuss your claim and begin the legal process against the company that negligently contributed to the harm that your infant suffered.

    You Could Recover Compensation

Depending on the details surrounding your claim, you might be eligible to recover monetary compensation for the harm that you suffered. How much compensation could you receive? What type of compensation could you be eligible to recover? The type and amount of compensation that you could be eligible to receive will always depend strictly on the details of your claim.

Although every product liability claim is different, some of the categories of compensation that are often available for product liability claims include the following:

    • Medical expenses
    • Lost earnings
    • Pain and suffering
    • Loss of consortium
    • Funeral and burial expenses
    • Property damage
    • Punitive damages

For more information about the type and amount of compensation that you might be eligible to receive if your product liability claim reaches a successful outcome, do not hesitate to seek legal assistance with our experts at your earliest convenience. The Statute of Limitations

Although you might have grounds to take action against Infantino or any other company that negligently made a defective product available for purchase, you could actually forfeit your right to sue if you fail to take action within the appropriate length of time. All claims are subject to strict deadlines which are set by a statute of limitations.

A statute of limitations is determined based on the specific cause of action being pursued. It determines the exact length of time that claimants have to file their claims. If claimants fail to file their claims within the time allowed by the statute of limitations, they will lose their right to sue.

What deadline applies to your claim? In California, product liability claims are typically subject to a two-year statute of limitations. This means that those interested in filing defective product claims would only have two years to file their claims. However, certain exceptions can apply (based on the details of your claim). In cases that involve minors, for example, a surviving victim could file a claim him or herself after becoming a legal adult. In Specific, the applicable statute of limitations could be tolled until the victim is a legal adult; then, it would start running. Therefore, the victim would have two years from the time he or she becomes an adult to sue.

If you would like to learn more about the statute of limitations and any exceptions that might apply to your claim, do not hesitate to contact our law firm at your earliest convenience. Our lawyers are ready to provide you with all the information that you need to file your claim on time.
