On December 20, 2019, Hallmark issued a recall for their frosted balsam jar candles. According to the recall, number 20-047), when the candle is lit, the glass candle jar can break; this poses a fire risk as well as a laceration risk. Approximately 4,500 units of the defective product have been affected by the recall.
The recall specifically involves Hallmark’s balsam soy blend jar candles. The scented balsam soy blend jar candles are green; they also have three wicks. The glass jar containing the candle measures approximately 5 inches high and 4.5 inches in diameter. The glass jar has a metal top. On the front of the jar, Hallmark, frosted balsam, and a photo of a snowy pinecone all appear. On the white label on the bottom of the candle jar, the date code (9211D), the SKU code (XKT1747), and the UPC code (763795556991) can be found.
The recalled candles were sold at Norman’s Hallmark stores in New Jersey and Pennsylvania from September 2019 to December 2019 – each candle was sold for approximately $28. According to the recall, there have been at least 6 reports of the glass jars suddenly breaking and causing fire damage to items that were nearby; no injuries have been reported so far.
The company is urging consumers to immediately stop using the candles included in the recall and return them to the store in which they purchased them for both a full refund of the purchase and a $10 gift card.

Understanding the Danger Present in the Recalled Product
According to the recall, the glass jar can break when the candle is lit, posing a laceration risk as well as a risk of property damage. But, why are the candle jars breaking? The jars could be breaking for a number of reasons. For example, the glass jars could have simply been not suited to handle heat. Likewise, the candle wick might have not been centered properly, allowing heat to concentrate on one side of the jar and causing it to break. Additionally, it is possible that the flame gets too close to the bottom of the jar which also results in concentrated heat and the risk of breaking.
Without a doubt, candle jars that break can pose a laceration risk. Without the containment of the jar, the candle’s flame could lead to the damage of surrounding property. Curtains, table covers, and other flammable pieces of personal property that are commonly found in homes can catch fire and cause flames to spread throughout the home – possibly leading to extensive burn damage. If the fire is not controlled quickly, smoke inhalation and burn injuries could be even more likely to occur.
Regardless of how you and your family were harmed because of a defective product, such as the defective candles recalled by Hallmark, it is important that you understand that you might have grounds to pursue a claim. If the harm that you and your family suffered could be associated with a defective product, you might have grounds to sue.
Understanding Defective Products and Product Liability
What happens when consumers are harmed by defective products? Depending on the details surrounding the incident and the harm suffered, affected consumers might have grounds to pursue a product liability claim. What is product liability? Based on product liability, companies owe their consumers a specific duty of care – a duty to ensure that all their products are completely safe for consumers to use. To ensure that products are safe for consumers to use, companies must inspect their products are subject their products to appropriate safety tests; this allows companies to identify and address any potential hazards before consumers are put at risk and harmed.
When companies fail to ensure that their products are safe for consumers, they are breaching their duty of care (and releasing defective products to consumers). The breach of duty can cause an incident (such as the glass candle jar breaking) and can put consumers at risk of harm (lacerations, burns, property damage, etc.). When a breached duty of care directly leads to harm, the company could be held liable. Why could companies be held liable? The answer is simple – if they had effectively exercised their duty of care towards consumers, their consumers wouldn’t have suffered any sort of harm.
What does this mean? If companies negligently make defective products available to their consumers, they could be liable for all harm suffered – meaning that they could be sued. Victimized consumers and their families could sue companies, such as Hallmark, for the harm that they caused their consumers.
If you would like to learn more about product liability and your right to pursue a claim after you or a member of your family were harmed by a defective product, do not hesitate to contact our law firm at your earliest convenience.
