John Deere Recalls Gator Utility Vehicles due to Crash Risk

On September 4, 2019, John Deere issued a recall for the XUV835 model utility vehicles. According to the recall (number 19-776), the plastic sheathing on the utility vehicle’s throttle cable can melt as a result of improper routing, resulting in the throttle sticking; this hazard could result in the operator being unable to stop the vehicle, which could represent a crash risk.

As mentioned above, the plastic sheathing on the utility vehicle’s throttle cable can melt (due to a routing issue) and can cause the throttle to stick, creating the risk of the vehicle not stopping when the operator attempts to stops. This issue can result in crashes. Any sort of vehicular crash has the potential to result in significant injuries.

    Product Liability

By failing to identify and address the hazards present in their products, companies are breaching their duty of care and negligently making defective products available for consumers. Because of this, companies, such as John Deere, will usually be liable for the harm caused by their defective products.
