DICK’S Sporting Goods Recalls Safety Ropes due to Fall and Injury Risks

dicks sporting goods field and stream safety ropes defect product liability lawyer recall compensation sue
On June 10, 2020, DICK’s Sporting Goods issued a recall for their Field & Stream safety ropes. According to the recall, number 20-133, the safety ropes can fail when being used in freezing conditions; this results in a fall and injury risk to consumers. The recall has affected approximately 63,000 units of the product.

The recall specifically involves the Field & Steam Life Line, Linesman, and Safety Ropes – which are used to reduce the risk of falls during climbing. The recalled ropers are black with orange lines; they were sold in singles as well as in three-packs. The ropes have a carabineer that hooks onto harnesses. There is a red label on the ropes with style number HEH01299, HEH01882Z, HEH01882Z, or HEH01530 printed (on the bottom corner).

The recalled ropes were sold at DICK’S Sporting Goods as well as at Field & Stream stores nationwide and online from June 2017 to March 2020; the recalled ropes were also available at Sportsman’s Warehouse stores nationwide from October 2019 to April 2020. The ropes were sold for between $20 an $80.

According to the recall, there has been at least one report of the safety rope failing when it was being used during freezing weather; the incident resulted in a concussion and a knee injury.

The company is urging consumers affected by the recall to stop using the recalled ropes and return them to any DICK’s Sporting Goods, Field & Stream, or Sportsman’s Warehouse (wherever it was purchased). Consumers that have a receipt will be given a full refund, while consumers without a receipt will receive store credit.

    Understanding Product Liability

Do you have the right to sue for the harm that you or a member of your family suffered because of the defective safety ropes recently recalled by DICK’S Sporting Goods? Depending on the details surrounding the incident and the harm suffered, you might have grounds to pursue a claim – specifically, you might have grounds to pursue a claim based on the concept of product liability.

What is product liability and how does it determine your right to sue? Based on the concept of product liability, all companies owe their consumers a duty of care. That is, companies owe consumers the duty to ensure that their products are completely safe for their consumers to use. This means that companies have to test and inspect their products in order to be able to identify and address any defects present in their products. When companies fail to identify and address the hazards present in their products (and release the defective products to consumers), they are breaching their duty of care – they are also negligently putting their consumers at risk of injury.

When a defective product results in an incident (such as a fall) that leads to injuries, companies could be liable based on the concept of product liability. This means that companies could be sued by affected consumers. Depending on the details surrounding the incident, you might be eligible to recover compensation for some of the following:

    • Medical expenses
    • Lost wages

    • Loss of consortium

Without a doubt, you might have grounds to sue and receive compensation; however, you could lose the right to sue if you fail to take legal action within a specific length of time. This is because all claims are subject to a statute of limitations. A statute of limitations determines the specific length of time that claimants have to pursue their claims. If claimants fail to file their product liability claims within the appropriate period, they will lose the right to sue.

What deadline applies to your product liability claim against DICK’S Sporting Goods? In the state of California, product liability claims are normally subject to a two-year statute of limitations, meaning that claimants only have two years to pursue their claims.

However, it is also important to be aware that exceptions to the statute of limitations could apply. If any exceptions apply to your claim, the statute of limitations could be tolled or paused for some time. Exceptions are always based on the details surrounding the claim.

To ensure that you have a thorough understanding of the statute of limitations and any exceptions that might apply to your claim, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience.
