DeWALT Recall Electric Drill | Defective Product Lawyer

On February 5th, 2019, the DeWALT Industrial Tool Company recalled 122,000 electric drill products after learning that the internal parts of the drill could be affected by the wiring, leading to electric shocks. 8,000 of the units were sold in Canada.

The products were sold at various hardware and home repair stores, such as Home Depot and Lowe’s, as well as online at Amazon and other retailers from September 2017 through November 2018. They cost roughly $60 and were manufactured in the USA.

The products are DWD110 and DWD112 drills, which are 3/8 inch reversible drills of varying speeds. They are colored yellow and have black accented marks on them. The items have a date code on them, and only drills with codes 2017-37-FY through 2018-22-FY are at risk.

There have been no reported injuries from electric shocks, but it is still recommended that customers immediately refrain from using the drills get in touch with DeWALT for a free inspection and repair.

    Injuries from Electric Shocks

Electric shocks can cause various damages to your body. For one, electric currents can cause burns that take weeks to heal, especially if they seared layers of skin. They could leave heavy scarring and damage your nerves beyond repair. Numbness from nerve damage can lead to other issues as well; for example, a general lack of sensation could prevent you from realizing there are cuts or puncture wounds in an accident.

Other results from electric shocks can include seizures, heart trouble, difficulty breathing, unconsciousness, paralysis, difficulty with speech or vision, and more.

Steps To Take For A Product Liability Lawsuit

If you wish to file a product liability lawsuit, you should follow these steps to guarantee the highest chance of success.

    • Do not return the item to the manufacturer, as it is a key piece of evidence and you will not be able to sufficiently sue if you do not have it
    • Do not tamper with the item or try to repair it yourself; the company can claim that the issues were caused by your tampering, and it would be difficult for you to prove otherwise
    • Get medical attention as quickly as you can after suffering any injuries so you can be treated and prevent further or lasting harm. The longer you wait, the more you risk greater damage to your health; additionally, you may endanger your claim. Insurance agents often look at gaps between accidents and treatments and raise concerns; it is a common cause for claims to be thrown out.
    • Hold on to any receipts, bank statements, proof of purchase emails, or other papers that show that you were the legal owner and purchaser of the drill.

You can file a lawsuit if you can show that there was one of three issues with the item. The issue may have been a design defect, which was present when the drill was drawn up and created and should have been caught by the team but wasn’t; a manufacturing defect, which occurred during the creation process at a plant or factory and could have been the result of a malfunctioning machine and only affected a small number of items; or a lack of a warning label or hazard statement on the product’s packaging or the product itself.

    Compensation

If you were injured thanks to a DeWALT electric drill, we can help you receive the compensation you deserve. You should not be expected to cover certain expenses if the company did not sell you a working product or if the item were dangerous. Our lawyers can help you receive the following:

    • Medical expenses from the past and future
    • Property damage
    • Lost wages from the past and future
    • Pain and suffering

Do not stand idly by and pay for your expenses if you were a victim. Let our expert product liability attorneys at the Normandie Law Firm help you.

Statute of Limitations on Product Liability Claims

In the State of California, you only have 2 years from the date of the injury to file a product liability claim against the responsible party. If you wait too long, your claim will be tossed out and you won’t be allowed to receive any compensation for your injuries. The longer you wait, the more likely it is that your evidence will get lost or become corrupted and you will not have too much proof of your injuries.

Further, your injuries may fade or become less impactful as time goes on, and it would be hard to convince an insurance agent that you deserve rightful compensation for something that happened too far in the past.

Our product liability lawyers can ensure that you file a claim within the acceptable time frame.
