InSinkErator Single Outlet SinkTop Recall — Product Liability Injury Lawsuit

On March 6, 2016, InSinkErator recalled its SinkTop switches. The switches mount to sinks or countertops, providing consumers with a unique switch for their garbage disposal needs. According to recall 18-116, water can enter the switch’s power module—creating a fire hazard. According to the recall, the company received up to 40 reports of water entering the switch’s power module, causing the module to overheat and become damaged.

The recall claims that approximately 1.4 million units were sold in the United States. The SinkTop switches were sold for $50 to $90 from 2005 to October 2017. The recall affected a total of four models: 76703, STS-SOSN, 78251, and 74300. Recall 18-116 advises consumers to stop using the switches and contact the company for a free replacement.

    SinkTop Fire Hazard

According to the recall, the defective product poses a fire hazard. Fires can result in a series of burn and respiratory injuries that can leave victims permanently affected. Victims injured by the fires created by the defective SinkTop might suffer from first-degree burns, second-degree burns, third-degree burns, and fourth-degree burns—first-degree being the mildest and fourth-degree being the most severe. Victims might also suffer respiratory injuries after smoke inhalation or inhalation of hot gases. The injuries sustained in a fire caused by a defective SinkTop are serious, and the company should be held liable for their negligent release of the defective product.

    Filing Your Claim

Can you file a lawsuit against InSinkErator? Can you sue the company for selling you a defective product? To be eligible to file a product liability claim, there must be a defect in the product’s labeling, a defect in the product’s manufacturing process, or a defect in the product’s design. If you can prove that your injuries were caused by a defect in labeling, manufacturing, or design, you will have grounds to file a lawsuit. To retain your eligibility to file a lawsuit, you must be cautious. Product liability claims can easily be lost if victims do not take the proper steps.

All victims should do the following:

    • Seek immediate medical attention
    • Avoid altering the defective product
    • Do not return the product
    • Keep all documents related to the defective product

Why do you need to do everything listed above? Seeking medical attention creates a connection between your injuries and the defective product. Doing so ensures that you have the proof necessary to claim that your injuries were caused by the defective product. Many people’s first instinct might be to try to fix the defective product; however, altering the defective product in any way can destroy essential evidence. For that same reason, you should never return the defective product either. The defective product is the primary piece of evidence, returning the product will affect the outcome of your claim. You must also keep all documents, including receipts and order confirmations, for example. You should keep records of all medical bills and expenses associated with your injuries.

Doing everything mentioned above will ensure that you have the necessary evidence to pursue legal action against InSinkErator. For more information about preparing to file a claim, you should contact our law firm as soon as possible and request to speak with our attorneys.

    Compensation Available

What compensation are you eligible to recover if you file a claim? If you were injured by a defective product, you might be eligible to receive various forms of compensation. The type and amount of compensation that you are eligible to recover varies depending on the specific details of your claim. Some of the categories of compensation that might be available for recovery are listed below:

    • Medical costs
    • Lost income
    • Pain and suffering
    • Property damage
    • Punitive damage
    • Loss of consortium
    • Funeral and burial costs

As you can see, there are many categories of compensation available for recovery. However, there is no guarantee that victims will receive all the compensation listed above. Since the type and amount of compensation available for your claim depend on specific details, you must contact our law firm as soon as possible. Our experienced attorneys will evaluate your claim and provide you an estimated case value. Our lawyers understand the extent of your injuries and your need for compensation. Statute of Limitations

If you are interested in filing a lawsuit after you were injured by a defective product, you must ensure that you file your lawsuit within the statute of limitations. What is a statute of limitations? A statute of limitations is a time limit that is placed on all claims. It is a deadline to sue designed to ensure that all claims are filed promptly. What is the statute of limitations for your claim? Victims of defective products have two years to file their claims. Victims have two years from the date that they were injured by the defective product to bring forth a lawsuit. If victims do not file their claim within the allowed time limit, they will likely lose their right to sue. Some exceptions—which lengthen the statute of limitations—might apply to your claim based on your claim’s details. For more information about the statute of limitations and any exceptions that might apply to your claim, you should contact our law firm as soon as possible.
