Camso Issues Recall for Yeti SnowMX Conversion Kits due to Crash Risk – Product Liability Lawyer

camso yeti snowmx conversion kits recall product liability lawyer hazard faul;ty brakes risk compensation sue attorney

On April 9, 2020, Camso issued a recall for the Yeti SnowMX conversion kits. Based on the recall, number 20-108, the brakes on the snow bike can fail after the installation of the conversion kit; this causes a crash risk to the user. The recall has affected approximately 380 units of the product.

The recall specifically involves the Yeti Snow MX kits used to convert dirt bike motorcycles into snow bike motorcycles (for use in the snow). The conversion kit allows the front wheel of the motorbike to be replaced with a ski; it also allows the rear suspension and wheels to be replaced with a track system. It also adds the appropriate breaks as well as other components.

The Yeti Snow MX kits have serial numbers starting with YE3XXXX or 964XXXX (which can be found under the unit). The kits have the Yeti logo printed on the side. The recall includes 2018, 2019, and 2020 model year conversion kits.

The following models are including in the recall:

    • Model Year 2018
      • Yeti SnowMx 120 Sport SS
      • Yeti SnowMx 129 Freeride SS
      • Yeti SnowMx 120 Sport
      • Yeti SnowMx 129 Freeride
      • Yeti SnowMx 137 Mountain life
    • Model Year 2019
      • Yeti SnowMx 120SS
      • Yeti SnowMx 129SS
      • Yeti SnowMx 129FR
      • Yeti SnowMx 137 MT
    • Model Year 2020
      • Yeti SnowMx 120SS

The recalled conversion kits were available at authorized Yeti SnowMX dealers from October 2017 to February 2020; the conversion kits were sold for approximately $8,600 each.

According to the recall, there have been at least 12 reports of incidents surrounding break failure; however, allegedly no injuries have been reported. The company is urging all consumers affected by the recall to immediately stop using their snow bikes with the recalled conversion kits and contact an authorized dealer for a free repair.

Although only 12 incidents have been reported to the company, it is possible that there have been many more unreported incidents – some of which might have resulted in injuries. Should you follow the recommendations made on the recall if you were harmed because of the defective product? Only those who were inconvenience by the recall should follow its suggestions. If you or a member of your family suffered harm as a direct result of the defective product, you should seek legal assistance rather than following the suggestions of the company. Based on the details surrounding the incident and the harm that you suffered, you might have grounds to file a product liability claim.

If you would like to learn more about your right to pursue a product liability claim for the harm that you suffered as a direct result of the defective Yeti SnowMX conversion kits, do not hesitate to seek legal assistance with the experts at Normandie Law Firm at your earliest convenience. Understanding the Severity of the Risk Present in the Product
As explained above, the conversion kit has been recalled due to faulty brakes, which can fail during use and present a significant crash risk. Whenever a crash risk exists, the risk of injuries is also present. If someone using their snow bike motorcycle suddenly cannot control the brakes (due to their failure), users could crash, and the incidents could result in injuries. Some of the injuries that consumers could suffer include the following:camso-yeti-snowmx-conversion-kit-recall-product-liability-lawyer-hazard-faulty-brakes-risk-compensation-sue-attorney

    • Head injuries
    • Traumatic brain injuries
    • Neck injuries
    • Back injuries
    • Spinal cord injuries
    • Broken bones
    • Nerve damage
    • Ligament damage
    • Muscle damage
    • Sprains and strains
    • Amputations
    • Lacerations
    • Scrapes and bruises

These injuries might seem minor; however, most incidents can result in a combination of injuries, which can be life-threatening. Whether you suffered injuries or a member of your family lost his or her life in a snow bike motorcycle accident due to defective brakes, you might have grounds to take legal action.

About Product Liability and Consumers’ Right to Sue
Do you have the right to sue if you suffered any harm after an incident caused by a defective product? You might have the right to sue based on the concept of product liability. What is product liability? Based on the concept of product liability, all companies owe their consumers a duty of care. Companies have the duty to keep their products safe for consumers to use. When companies fail to ensure the safety of their products and make defective products available to the public, they are breaching their duty of care. The breached duty of care (which can be represented by a defective product) can contribute to an incident that could lead to harm to innocent consumers. Whenever a consumer is harmed as a direct result of a defective product, the company that released the defective product to the public could be held accountable. In other words, companies could be held liable based on the concept of product liability.

Were you or a member harmed by a product that was defective in design, labeling, or manufacturing? If so, you might have grounds to file a product liability claim based on the concept of product liability. For more information about product liability and your right to sue, do not hesitate to contact the experts at our firm at your earliest convenience.

You Could Sue and Recover Monetary Compensation
As mentioned above, you might have grounds to sue based on the concept of product liability. If your product liability claim reaches a successful outcome, you could also be eligible to recover monetary compensation for the harm suffered. Although every product liability claim is different, some of the categories of compensation that victims might be eligible to recover could include the following:

    • Medical expenses (for all costs associated with the medical care resulting from the incident and harm suffered)
    • Lost income (for the wages resulting from the inability to work due to the harm suffered in the incident)
    • Pain and suffering (for the mental/emotional distress resulting from the incident)
    • Property damage (for any damage to personal property resulting from the incident)
    • Loss of consortium (for losing the ability to have a normal, family relationship with the victim)
    • Funeral and burial expenses (for any expenses necessary to cover death services in the case of the victim’s death)
    • Punitive damages (awarded as a form of punishment towards the defendant)
    • Legal fees (to cover the costs associated with all legal services)

If you would like to learn more about the type and amount of compensation that you could be eligible to receive if your claim reaches a successful outcome, do not hesitate to contact our firm at your earliest convenience. Following the Appropriate Steps to Follow
If you or a member of your family suffered harm associated with a defective product, there are a number of things that you should do to prepare to hold the liable company accountable. Consider the following recommended steps that you should take:

    • Photograph all visible injuries suffered
    • Photograph the scene of the incident
    • Photograph the defective product
    • Seek medical attention immediately (even if the injuries do not seem severe)
    • Speak to any witnesses present at the time of the incident
    • Contact the company immediately
    • Report the defect and the harm resulting from the incident
    • Do not agree to return the defective product
    • Do not agree to a free repair or a free replacement
    • Do not agree to a refund
    • Do not tamper with the defective product in any way (do not attempt to repair it yourself)
    • Gather all medical records associated with the harm that you suffered
    • Gather all records associated with the purchase of the defective product
    • Identify surveillance cameras that might have captured your incident
    • Seek legal assistance immediately

Although following these recommendations does not guarantee that your claim will be successful, it can facilitate the process of preparing to file the claim. For more information regarding the importance of following the steps listed above after being harmed by a defective product, do not hesitate to contact the experts at our firm at your earliest convenience.

The Statute of Limitations for Your Claim
Depending on the details surrounding the incident and the harm that you suffered, you might have grounds to sue; however, it is essential that you pursue your claim promptly as your claim will be subject to a statute of limitations. What is a statute of limitations? A statute of limitations establishes the length of time that claimants have to pursue their claims. If claimants do not file their claims within the time allowed by the statute of limitations, they will lose their right to sue.

How long do you have to pursue your product liability claim against Camso or any other company that negligently contributed to the harm that you suffered? In California, product liability claims are typically subject to a two-year statute of limitations; this means that claimants will only have two years to pursue their claims. Without a doubt, this is a strict deadline; however, exceptions could apply under some circumstances. If exceptions apply to your claim, the applicable statute of limitations could be tolled (or paused) for some time.

To ensure that you have a thorough understanding of the specific time that you have to pursue your product liability claim, do not hesitate to contact the experts at our firm as soon as possible. Our lawyers are ready to provide you with all the information that you need to file your claim within the appropriate length of time. Contact our firm today.
