C3 Manufacturing Recalls Climbing Systems due to Fall Risk

c3 climbing systems fall hazard accidents product liability lawyer compensation sue lawyer
On March 19, 2020, C3 Manufacturing issued a recall for their Perfect Descent Auto Belays climbing devices. According to the recall, 20-097, the belay climbing device can loosen and cause slack on the rope; this could result in the climber falling and suffering significant injuries and even death.

The recall affects approximately 1,100 units of the climbing systems. The recall specifically involves the Perfect Descent Auto Belay model 220 Indoor, Outdoor, Speed Drive, as well as Direct Drive devices. The serial number and manufacture dates associated with the recalled products include the following:

    • I-0970 through I-3109, February 2017 through November 2018
    • S-0604 through S-1609 March 2017 through December 2018
    • S-1695 through S-1762 February 2019 through March 2019
    • D-1015 through D-1385 June 2018 through December 2018
    • D-1572 through D-1705 February 2019 through March 2019
    • D-1710 through D-1722 March 2019
    • D-1726 through D-1751 March 2019 through April 2019
    • D-1761 through D-1777 April 2019

The recalled products are designed to be used with climbing ropes to protect climbers, arrest falls, or allow lowering on the rope. The climbing devices were available in yellow and black; they have “Perfect Descent” printed on the top. The defective climbing systems were sold by Aerial Adventure Technologies around the country as well as online via www.perfectdescent.com; they were available from February 2017 to April 2019 for pricing ranging between $1,800 and $2,100.

According to C3 Manufacturing, there have been no incidents or injuries associated with the defective products. The company is urging all consumers affected by the recall to stop using the belay devices and contact them for a free repair; all known purchasers are being contacted directly.

Should you contact the company for a free repair? The answer to this question depends on whether you or a member of your family suffered harm associated with the defective product. If you or a member of your family suffered harm associated with the defective climbing devices, you should not contact the company for a free repair – instead, you should contact a lawyer to explore your legal options.

Depending on the details surrounding the incident and the harm suffered, you might have grounds to pursue a product liability claim against C3 Manufacturing. To learn more about your right to sue for the harm that you or a member of your family suffered, do not hesitate to seek legal assistance with the experts at our firm at our earliest convenience.

The Danger of the Recalled Product
As explained above, the recalled belay climbing device can become loose and cause slack on the rope; this could cause the climber using the device to fall and suffer severe injuries. Climbing is typically a dangerous activity; however, there is an abundance of tools and equipment designed to make the activity safer. Because the device is defective, climbers could be at greater risk of suffering harm. Falls from high elevations can result in dangerous injuries, including but not limited to the following: head injuries; traumatic brain injuries; neck injuries; back injuries; spinal cord injuries; pelvic injuries; hip injuries; leg injuries; fractures; sprains and strains; lacerations. Depending on the details surrounding the incident, these injuries could be fatal.
About Product Liability – You Could Sue
Were you or a member of your family harmed because of a defective product? Whether the incident resulted in injuries or death, you might have grounds to take legal action. You should explore the possibility of pursuing a lawsuit based on product liability. What is product liability? Based on product liability, companies owe their consumers a specific duty of care; they have the duty to ensure that their products are completely safe for consumers to use as intended. Unfortunately, companies often fail to ensure the safety of their products. They fail to identify and address the hazards present in their products; therefore, they make defective and potentially dangerous products available to unsuspecting consumers. If a defect in a product’s design, labeling, or manufacturing directly contributes to harm to a consumer, the company could be held liable based on product liability. This means that the consumers affected by defective products could sue these companies.
    What Should You Do?
If you or a member of your family suffered harm associated with a defective product, you should do the following:product-liability-lawyer-risk-recall-c3-manufacturing-climbing-system

    • Take photos of all injuries sustained
    • Take photos of the defective product
    • Seek medical attention immediately
    • Contact the company
    • Report the incident and the harm suffered
    • Report the defect
    • Do not agree to a free repair or replacement
    • Do not agree to a refund or voucher
    • Do not agree to return the defective product (keep it as-is in a safe place)
    • Speak to witnesses and gather their information
    • Collect medical records
    • Gather purchase records
    • Seek legal assistance immediately

By following the recommendations listed above, you and your family are preparing to hold the company accountable. Although it could be difficult to act accordingly after such a devastating incident associated with a defective product, sticking to the recommended steps listed above could ensure that you and your family can gather the tools necessary to hold the company liable for their actions.
    You Could Recover Compensation
Recovering monetary compensation cannot reverse the harm that you and your family suffered because of a defective product; however, compensation can help significantly with moving forward after such a traumatic time in your life. Could you really be eligible to receive compensation? Your right to receive compensation will always be based on the details surrounding your claim. What could you recover? Some of the compensation that you might be eligible to receive could include the following:

    • Medical expenses
    • Lost wages
    • Pain and suffering
    • Funeral and burial costs
    • Loss of consortium
    • Punitive damages

Regardless of the type and amount of compensation that you could be eligible to recover, you can be certain that the product liability lawyers at our firm are ready to aggressively fight for your right to recover the highest amount of compensation available. For more information about the compensation that you could be awarded, do not hesitate to contact our firm today.
How Long Do You Have to Sue?
Most people do not know that their claims are subject to strict deadlines. All claims are subject to a statute of limitations – which determines the specific length of time that claimants have to file their claims. If claims are not filed on time, the right to sue is lost. In California, product liability claims are typically subject to a two-year statute of limitations, meaning that claimants only have two years to file their claims. However, exceptions can apply. To ensure that you have a thorough understanding of the deadline that applies to your defective product claim, do not hesitate to contact our law firm at your earliest convenience.
