Three years ago, my wife saw a plastic surgeon with fellowship in hands. She had experienced a minor dislocation that left a tiny piece of cartilage on the outside of volar plate. Doc said that it was a simple operation and that he would be performing a volar plate arthroplasty. Instead, he cut a flap on her ring finger knuckle and performed a "shotgun break" (his words in depo). He, than placed a "popsicle stick" (his words) under the finger to give it stability since the perfectly seated joint, was now broken. He placed take behind and in front of the joint and encased the entire hand in a bandage, which he said must have been too tight. That was at 6:30pm on a Fri. night. The next morning, my RN wife, was in excruciating pain despite huge amounts of oxy and Norco. We went to local ER and she poked the end of her fingers, since that was all that was showing and determined that because there was good capillary refill, she was in no danger of vascular compromise or compartment syndrome. did not remove bandage but called him and he refused to come in. We were back at ER next day with different doctor who did the same thing, except she didn't do anything but increase pain meds to 10 mg. oxy. and told my wife to see her Doctor in a week. The next morning my wife drove to san Diego and the bandage was removed for the first time in 76 hrs. The hand was discolored and their was a large black nodule of fluids on top of her knuckle. She was admitted to Sharp hospital because of acute pain, vomiting etc. and spent four days there. Another ten sessions of two hours each in a bariatric chamber did nothing. Nor did attempts by a board certified hand specialist who said that he didn't know what the surgeon did but that it was not a volar plate arthroplasty. My wife could not move her fingers and underwent more surgery in an attempt to get the fingers to work. She has been in acute pain for three years now and underwent five days of four hours of ketamine infusion in an attempt to get the pain to diminish. Our attorney has threatened to fire us because we have asked her to consider a battery charge and alleged that we were the worst clients she had ever had. Please note, that we never call, email or demand to be at depositions, which is our right. I know that we are so far into this that we may be stuck with the attorney but would like your opinion re: battery. The operative notes are illegible and make no sense to any of the doctors that have reviewed them. We have claims against all three doctors but little faith in our legal representation.
