Average Case Value Compensation of a Fetal Miscarriage Lawsuit

Unborn children only have the protection of their mother’s womb. In most cases, that is enough protection against any stumbles. However, some incidents can be too much for a pregnancy to be unaffected. Many pregnancies can end after incidents that cause the mother to become injured. Such incidents include car accidents, slip and fall accidents, trip and fall accidents, workplace injuries, and medical malpractice. Every day, Normandie Law Firm receives many calls asking questions regarding fetal miscarriages. Some of these questions include:

    • How much is a loss of pregnancy case worth?
    • How much do fetal miscarriage cases settle for?
    • How much is a miscarriage after a car accident worth?

It can be difficult even to consider filing a lawsuit after the loss of pregnancy. However, if the loss of your unborn child was a result of somebody else’s negligent behavior, you should inform yourself about the legal actions you can take against the responsible party. This article will explain the possible compensation you might be eligible to receive if you file a lawsuit for the loss of your pregnancy.

    Losing the Pregnancy
Many factors can lead to the loss of pregnancy. It is unrealistic to believe women pause their lives when they become pregnant. Pregnant women usually continue their day to day activities until they become physically impossible. That is, women continue to go to work, run errands, and drive around. Additionally, the majority of pregnant women receive routine medical attention throughout their pregnancy. So what can go wrong?

When a pregnant woman is anywhere outside her own home, there are many factors that she cannot control. These factors are what can lead to the loss of pregnancy. Here are a few examples of the outside factors that might cause a miscarriage:

    • Car Accidents—the loss of pregnancy after a car accident is always a possibility. Car accidents are the leading cause of traumatic fetal deaths. About 170,000 car accidents in the United States involved a pregnant woman. Severe car accidents can cause the mother’s body to jolt unexpected and forcefully. Additionally, the force of impact can lead the unborn child to suffer from a contra-coup injury, a result of a concussion or a blow. The force of the car accident can also result in an injury called a placental abruption. This occurs when the placenta separates from the walls of the uterus any time before the expected labor. Mothers who suffer from placental abruption suffer the risk of going into pre-term labor and experiencing severe blood loss. If severe, placental abruption can cause the death of the fetus. If the car accident was caused by a negligent driver, you might be eligible for compensation for the auto accident loss of pregnancy.
    • Workplace Injuries—in the workplace, it is possible that pregnant women are exposed to some uncontrollable factors that may result in the loss of their pregnancy. It is possible the women’s workplace exposes her to harmful chemicals. Additionally, the workplace might be somewhere with slip and fall hazards like slippery floors, liquid spills, obstructions blocking walkways, and misplaced mats. These hazards could have been addressed by employees or management, and any accidents could have been prevented. If the loss of your pregnancy was due to a slip and fall accident in the workplace, you have the right to sue. If you can prove that your accident and eventual loss of pregnancy was a result of employee or management negligence, you might be eligible to receive compensation.
    • Medical Malpractice—the loss of pregnancy can also be a result of medical malpractice. Miscarriage due to medical malpractice can happen after the negligent actions of a doctor or other medical staff. Miscarriage can be caused by medical staff failing to monitor and detect levels of fetal stress. This can cause medical staff to miss the need to perform an emergency C-section. Other possibilities include medical staff administering the wrong medication to a mother during delivery. Pregnant women go to medical professionals to make sure their unborn children are well taken care of. However, because of medical personnel’s negligent actions, pregnant women might experience miscarriages.

    Average Compensation for Miscarriage
You might still be wondering how much is a pregnancy loss case worth? The settlement value of a miscarriage lawsuit after an accident, whether a car accident or a workplace accident, will vary depending on each case. A miscarriage attorney can help you thoroughly understand the average settlement value of a fetal loss claim.

Here are a few examples of past settlement amounts:

    • $1.7 million—hospital staff failed to monitor and identify fetal distress in an infant as the woman was admitted for delivery. The infant was without oxygen for several minutes, leading to a development of spastic cerebral palsy and subsequently the infant’s death.
    • $1.35 million—a woman was unaware that she was HIV-positive. When she became pregnant, she began treatment with an OB-GYN who did not properly screen her for any diseases. Because the mother was never diagnosed or treated for HIV, the necessary precautions were not taken to ensure that the child would be born without the disease. The child was born HIV-positive and subsequently developed AIDS and died.

In general, parents who file lawsuits for the loss of their pregnancy are eligible to receive compensation for medical costs, burial and funeral costs, physical pain and suffering, and emotional pain and anxiety. If you were in a car accident, you likely would be eligible to receive compensation for your car’s damage. If you are unable to return to work because of the accident, you might be eligible to receive compensation for the wages you have lost.

As you can see, the settlement amounts for miscarriage cases can vary. A consultation with an attorney experienced in fetal loss will be able to provide a deeper analysis of the average lawsuit value of a fetal death case. Additionally, after reviewing your case, the attorney will be able to provide you with a projected cash settlement for a stillbirth lawsuit.

Hi my name is ivon and am 23 years old I have one son and experienced a miscarriage. 2 weeks ago I was working at the amazon warehouse in San Bernardino as a picker in the 3rd floor and was having bad cramps I went down to the first floor to the restroom and noticed I was spotting. I went back up to the 3rd floor to scan my last item and put my tote in the conveyer. I went down to the first floor and asked my manger to vto me so I can go to the hospital because I was cramping and spotting and she told me they would vto later that night. After that they vto 3 times and I wasn’t sent home. At around 3am I was starting cramping bad on the 3rd floor and went down to talk to the hr lady to see if she could help me get vto because of what I was going thru. She quickly sent a message to the manager requesting her to vto me and she finally did . I clocked out and went quickly to the emergency room where the doctors did many test on me. After 3 hours of waiting they finally told me that they were sorry but that I was going thru a miscarriage. I feel like the warehouse is to blame for mostly because of the stress they put me on and lifting heavy items and going up all those stairs.
