Stargate Apparel Recalls Bunz Kidz Children’s Sleepwear Sets due to Burn Risk

Stargate Apparel Recalls Bunz Kidz Children’s Sleepwear sue liability lawyer attorney

On May 20, 2020, Stargate Apparel issued a recall for their Bunz Kidz Children’s Sleepwear Sets. According to the recall, number 20-125, the children’s sleepwear sets fail to meet the federal flammability standard for children’s sleepwear; the flammability standard requires sleepwear to be either snug-fitting or flame resistant. This poses a risk of burn injuries to children. The recall has affected approximately 6,600 products.

The recall specifically involves the Bunz Kidz-branded children’s sleepwear sets. The sleepwear sets include a robe, a top, and pants. The sleepwear sets were available in sizes 2 through 12. The robes and ants are 100% micro polyester fleece; they are white with a pink start print allover. The top is also 100% polyester; it is pink and has “Dream in Glitter” printed onto the chest (in gold). The robe is long-sleeved; it has a shawl collar, two side-seam pockets, and a sewn-on tie (located on the waist).

There is a blue sewn-in label with Bunz Kids printed on it. The labels also have the style numbers and GPU numbers printed on them. The style numbers included in the recall consist of the following: L23846, L43846, and L73846. The GPU numbers included in the recall consist of the following: 2017-246, 2017-446, and GPU 2017-746.

The defective children’s sleepwear sets were sold from August 2017 through December 2019; they were sold for prices ranging from $24 to $48. There were available online via Amazon.com as well as Walmart.com. The sleepwear sets were also available in-store at Boscovs, Century 21, Macy’s JC Penney, Marshalls, and TJ Maxx (as well as some other stores nationwide).

According to the recall, neither incidents nor injuries have been reported. The company is urging all affected consumers to immediately take the sleepwear sets away from children and contact them for a full refund. Should you follow these recommendations? If your child suffered harm associated with the recalled sleepwear sets, you should not follow the recommendations made by the company – rather, you should explore the legal options available to you.

Based on the details surrounding the incident and the harm that your child suffered, you might have grounds to sue; specifically, you might have grounds to file a product liability claim. If you would like to learn more about you right to file a product liability claim, do not hesitate to seek legal assistance immediately, you might have grounds to hold the negligent company accountable for all the harm suffered due to the defective product.

The Dangers Associated with the Recalled Sleepwear Set

Based on the U.S. Flammable Fabrics Acts (passed in 1953), children’s sleepwear must be either flame-resistant (and self-extinguishing) or tight-fitting. This law passed after hundreds of children suffered horrible injuries and even lost their lives due to highly flammable apparel. Some materials are highly flammable; because they ignite so quickly, severe burns are inevitable. Because the recalled sleepwear is so flammable, even the smallest spark can quickly cause the clothing to ignite. Children could suffer a number of burn injuries, ranging in severity. The fire could also spread via other flammable materials (such as furniture or decorations), resulting in property damage as well as smoke-inhalation injuries. Whether your child lost his or her life, suffered injuries resulting in temporary or permanent harm, you might have grounds to sue. You might also have grounds to sue for property damage resulting from the incident.

Understanding Product Liability and Your Right to Sue

Based on the concept of product liability, all companies (that make products available to consumers) owe their consumers a duty of care. These companies have the duty to ensure that all their products are completely safe for consumers to use. They must test and inspect their products to ensure that they are safe before releasing them to the public. When companies breach their duty of care, they are recklessly putting their consumers at risk of suffering harm.

A breached duty of care – a failure to ensure that products are completely safe for consumers to use – can result to an incident, which can contribute to harm. When a consumer suffers harm associated with a defective product, the company could be liable based on the concept of product liability. After all, the consumer would have never suffered harm if the company had ensured that the product was safe.

What does this mean? Based on the concept of product liability, companies could be liable for the harm caused by defective products. That is, affected consumers could sue. For more information regarding your right to sue based on the concept of product liability, do not hesitate to contact our firm today.

    You Must File Promptly

Undeniably, you might have grounds to sue based on the concept of product liability. However, you must file your claim as soon as possible to ensure that you preserve your right to sue. This is because all claims are subject to a statute of limitations – or a deadline. If claimants fail to file their claims within the time allowed by the statute of limitations, they will lose the right to sue. What deadline applies to your claim? In California, product liability claims are normally subject to a two-year statute of limitations; this means that consumers affected by defective products and interested in pursuing a claim will only have two years to sue. However, it is possible for exceptions to apply. Specifically, in cases that involve children, the statute of limitations could be tolled or extended until the injured child (if the child survives) reaches eighteen years of age or is legally emancipated.

To ensure that you file your claim within the appropriate length of time, do not hesitate to seek legal assistance with the experts at our firm immediately. Our lawyers will help you pursue your claim within the appropriate length of time.
