Rocky Mountain Bicycles Issues Recall for Bicycles due to Fall and Injury Risks

Rocky Mountain Bicycles Issues Recall for Bicycles due to Fall and Injury Risks sue lawyer attorney compensation

On July 16, 2020, Rocky Mountain Bicycles issued a recall for their non-electric alloy frame bicycles – including the Instinct, the Instinct BC, and the Pipeline bicycles. According to the recall, number 20-150, the bicycles’ front frame triangle can crack, resulting in the separation of the head tube from the rest of the frame. This represents a fall and injury risk to consumers. The recall has affected approximately 1,530 products in the U.S.

The affected bicycles were available in small, medium, and large sizes; they had serial numbers starting with PRK17, PRK18, and PRK19-XXXXX. The defective bicycles were sold at independent bicycle stores throughout the country from August 2017 through June 2020. The bicycles were sold for prices ranging from $2,600 to $4,700.

According to the recall, the company has received at least 12 reports of the front triangles cracking; however, the company claims that there have been no reports of injuries. The company is urging all affected consumers to immediately stop using the recalled bicycles and contact them for further information on a free replacement of the front triangle.

Have you been affected by the recall? Do you own one of the bicycles included in the recall? If neither you nor a member of your family suffered any type of harm associated with the recall, it makes sense to simply contact the company for more information on receiving a replacement of the defective front triangle. However, if you or a member of your family suffered harm as a direct result of the defective bicycle, you should never agree to the suggestions made by the company; instead, you should consider your legal options.

Based on the details surrounding the incident and the harm that you or a member of your family suffered, you might have grounds to take legal action against the company that made the defective product available for purchase. Specifically, you might be eligible to pursue a product liability claim against Rocky Mountain Bicycles. If your claim is successful, you might also be eligible to recover monetary compensation for the harm resulting from the incident.

The Risks Associated with the Defective Product

As discussed above, the front frame triangle can cause and cause the head tube to separate from the frame. This poses a dangerous risk of fall and injury. Defective bicycles can lead to the most devastating injuries, specifically because the incidents occur when the bicycle is being used. If the head tube separates from the frame when the bicycle is being used, consumers could fall off the bicycles. Depending on the speed being traveled at the time that this occurs, the cyclist could suffer a number of injuries, some of which could occur the following:

    • Head injuries
    • Brain injuries
    • Neck injuries
    • Back injuries
    • Spinal cord injuries
    • Fractures
    • Sprains and strains
    • Nerve, ligament, and muscle injuries
    • Lacerations
    • Scrapes and bruises

Regardless of the specific type of harm resulting from the incident, affected parties and their families must remain aware of their rights as consumers. If you or a member of your family suffered harm associated with the defective bicycles, you might have grounds to sue for all the harm suffered. If the harm suffered leads to the death of a victim, surviving family members could also sue.

Understanding Product Liability – You Could Sue

Your right to pursue a claim after you or a member of your family suffered harm associated with a defective product is based on the concept of product liability. Based on product liability, companies owe their consumers a duty of care – specifically, a duty to ensure that their products are completely safe for consumers to use. This means that companies must test and inspect their products to, ultimately, be able to identify as well as address any hazards that could contribute to the harm that consumers suffered. When companies fail to identify and address the defects present in their products, they are breaching their duty of care towards their consumers, meaning that they are putting consumers at risk of injury.

Whenever a consumer suffers harm as a direct result of a breached duty of care (i.e. a company failing to ensure that their products are safe), the company could be liable for all the harm that the consumer suffered – this is strictly based on the concept of product liability. For more information about the concept of product liability and your right to sue, do not hesitate to seek legal assistance with the experts at our firm at your earliest convenience.

    What Could You Recover?

Based on the details surrounding your product liability claim, you might be eligible to recover monetary compensation (given that your claim reaches a successful outcome). What could you be eligible to receive? Some of the categories of compensation sometimes available for recovery include the following:

    • Medical bills
    • Lost earnings
    • Pain and suffering
    • Loss of consortium
    • Funeral and burial costs
    • Property damage
    • Punitive damages

The type and amount of compensation that you could be eligible to receive will always depend on the details surrounding your claim. Therefore, you should always discuss the possible compensation that you could recover with experienced product liability lawyers to ensure that you have a thorough understanding of the type and amount of compensation that you could receive. For more information about the compensation that you could recover, do not hesitate to seek legal assistance with the experts at our firm as soon as possible.

    What Should Affected Consumers Do?

If you or a member of your family suffered harm associated with a defective product, you should follow a number of steps to ensure that you can pursue a claim and hold the negligent company accountable for all the harm suffered. What should you do? Consider the following recommendations:

    • Seek medical attention as soon as possible
    • Take photos of the injuries suffered (before and after treatment)
    • Take photos of the defective product
    • Take photos of the scene of the accident
    • Contact the company to report the incident as well as the harm suffered
    • Do not agree to a free replacement or a free repair
    • Do not agree to store credit or a refund
    • Do not agree to return the defective product
    • Speak to witnesses and gather their testimonies/contact information
    • Gather any surveillance footage that might have captured your incident
    • Collect all relevant medical records associated with the harm suffered
    • Collect records surrounding the purchase of the defective product
    • Seek legal assistance with an experienced lawyer as soon as possible

You Should File Your Claim Quickly

In addition to following the recommendations listed above, you should also ensure that you pursue your claim as soon as possible. This is because your claim is subject to a statute of limitations, which determines the specific length of time that you have to sue. If you do not file your claim within the time allowed by the statute of limitations, you could lose your right to sue.

How long do you have to pursue your claim? In California, product liability claims are normally subject to a two-year statute of limitations; this means that claimants only have two years to file their claims. In addition to this deadline, it is important for claimants to be aware that exceptions to the deadline could apply; if any exceptions apply, the deadline could be tolled or paused for some time. To ensure that you have a thorough understanding of the time that you have to pursue your product liability claim against Rocky Mountain Bicycles, do not hesitate to contact the experts at our firm at your earliest convenience.
