HON Recalls Office Chairs Due to Fall and Injury Risk
On June 17, 2020, The HON Company issued a recall for their HON Office Chairs. According to the recall, number 20-137, the chairs’ backs can break; this poses a fall and injury risk to users. The recall has affected approximately 13,400 units of the product.
The recall specifically includes the following chairs:
- HON Gateway Office Chairs (model numbers HGTMM and HGV1MM)
- Maxon MXMO series chairs (model numbers M-SEMO201 and M-SEMX101)
The chairs were manufactured from February 20219 through February 2020. The manufacturer’s name, relevant model number, as well as manufacture date are printed on a label that can be found on the seat’s underside. The affected office chairs have a black mesh back (see-through) and a five-star base (with wheels). Either HON or Maxon is printed on a label underneath the chair seat.
The recalled chairs were available at HON and Maxon dealers nationwide; they were also available online via Staples.com and OfficeDepot.com. They were available from February 2019 through February 2020 for prices ranging from $135 and $250.
According to the company, there have been at least 11 reports of chair backs breaking; this includes at least two reports of consumers suffering minor injuries. HON is urging all affected consumers to stop using the recalled chairs immediately and contact them for a free replacement back (including installation instructions).

The Defect Present in the Recalled Chair
As explained above, the recalled chair has an issue with the chair’s back. Specifically, the chair’s back can break. This defect represents a fall and injury risk to users. If the chair’s back suddenly breaks while a consumer is sitting on the chair, a consumer could fall. The fall could result in a number of injuries, some of which could include the following: head injuries, brain injuries, neck injuries, back injuries, spinal cord injuries, broken bones, sprains/strains, lacerations, and bruises, for example. Although most of the injuries mentioned above seem to be minor, the injuries could cause significant complications; some of the injuries can even be permanent. Regardless of the harm suffered due to the defective chair, it is important for affected consumers to know that they could take legal action for the harm that they suffered associated with the defective product.
Understanding Product Liability and Your Right to Sue
If the harm that you or a member of your family suffered was a direct result of the defective office chair, or any other defective product, you might have grounds to file a product liability claim against the company that negligently made the product available for purchase. This is based on the concept of product liability. Based on product liability, companies owe their consumers a duty of care. They must test and inspect their products to ensure that they only make safe products available to consumers. When companies fail to ensure that their products are safe for their consumers to use, they are breaching their duty of care. The breach of duty can put consumers at risk of suffering incidents, which can contribute to harm.
Based on product liability, whenever a breach of duty (the failure to ensure that a product is safe) directly results in harm to consumers, the company could be liable. Because the company is at-fault for the harm suffered (due to the concept of product liability), affected consumers could pursue product liability claims. If you would like to learn more about the concept of product liability and your right to sue, do not hesitate to seek legal assistance with the experts at our law firm at your earliest convenience.

Understand the Statute of Limitations
Are you aware of the statute of limitations that applies to your claims? When claimants fail to file their claims within the time allowed by the appropriate statute of limitations, they can lose their right to sue. A statute of limitations determines the total length of time that claimants have to pursue their claims. This ensures that claims are filed promptly (to remain fair to defendants). What statute of limitations applies to your claim? In the state of California, product liability claims, like other personal injury claims, are subject to a two-year statute of limitations; therefore, claimants only have two years to pursue their claims. The statute of limitations establishes a strict timeframe in which a claimant must sue; however, it is important for claimants to understand that exceptions to the statute of limitations could apply (exceptions will always be based on the details surrounding the claim). If any exceptions apply to your claim, the statute of limitations could be paused for a certain length of time.
