On September 9, 2020, WHILL issued a recall for the Model Ci of their Personal Electric Vehicles (PEVs). According to the recall, number 20-177, the affected vehicles’ control pad can malfunction causing the power to turn on or off; additionally, the malfunction can cause the PEVs speed to either increase or decrease suddenly. This represents a significant crash and injury risk to consumers. The recall has affected approximately 1,160 units.
The recall specifically includes the WHILL Model Ci, which is a personal mobility device that is occupant-controlled and motorized; the product is powered by a lithium ion battery. The affected product is associated with serial number ranges C_1711188_US to C_1909011_US (the serial number can be found on a label that is located on the seat assembly). Both WHILL and Model Ci can be found printed on the vehicles’ battery compartment. The PEVs have one chair with a platform and four wheels. The product was available with white, red, black, and blue arm covers (the majority of the product, including the seat, is black).
The recalled PEVs were available online through a number of sites, including but not limited to topmobility.com, accessnsm.com, scootaround.com, and spinlife.com. The PEVs were sold from November 2017 through September 2019 for approximately $4,500 each.
According to the company, there have been at least 15 reports of the PEVs malfunctioning; however, allegedly no injuries have been reported.
The company is urging all affected consumers to immediately stop using the recalled products immediately and contact them for a free replacement of the control pad.
Have you been affected by the recall? If so, should you contact the company to get a free replacement of the PEV control pad? If the defective product contributed to the harm that you or a member of your family suffered, you should not agree to a free replacement of the control pad; instead, you should seek legal assistance immediately to explore the legal options available to you.
Based on the details surrounding your incident and the harm that you or a member of your family suffered, you might have grounds to pursue a product liability claim. If you are interested in learning more about your right to pursue a product liability claim, do not hestiate to seek legal assistance with the experts at our firm as soon as possible.

The Risk Surrounding the Defective Product
As explained above, the PEVs control pad can suddenly malfunction, causing the power to turn on or off as well as causing the speed to increase or decrease; this poses a crash and injury risk to consumers. Due to the sudden motions, unsuspecting consumers can potentially crash. Crashes on the PEV can contribute to a number of injuries, which could include some of the following:
- Head injuries
- Traumatic brain injuries
- Neck injuries
- Back injuries
- Spinal cord injuries
- Muscle, nerve, and ligament injuries
- Fractures
- Sprains and strains
- Bruises
- Lacerations
Regardless of the harm that you or a member of your family suffered associated with the defective product, you should explore the legal options available to you and your family. Depending on the details surrounding the specific situation, you might have grounds to sue.
About Product Liability
Do you have the right to sue for the harm that you or a member of your family suffered due to a defective PEV? Based on the details surrounding your specific situation, you might have grounds to pursue a claim. More specifically, you might have grounds to pursue a product liability claim.
Your right to sue is based on the concept of product liability. Based on product liability, all companies owe their consumers a specific duty of care – a duty to ensure that their products are completely safe for their consumers to use. They must test and inspect their products thoroughly to be able to identify and address any of the hazards present before making the product available to consumers. Unfortunately, companies can breach their duty of care; by doing so, they are actively putting their consumers at risk of suffering harm.
Based on the concept of product liability, whenever a breached duty of care (or a defect in a product’s design, labeling, or manufacturing) leads to harm, the company that breached the duty of care could be liable. In other words, affected victims and their families could pursue claims – product liability claims.
If you are interested in learning more about your right to pursue a product liability claim for the harm that you or a member of your family suffered associated with a defective product, such as the defective WHILL Personal Electric Vehicles, do not hesitate to seek legal assistance with the experts at our firm as soon as possible. Our lawyers will provide you with the guidance that you need to pursue your claim.
What Should You Do If You Were Harmed?
If you or a member of your family suffered harm associated with the defective Model Ci PEVs or any other defective product, there are a number of things that you should do to ensure that you could hold the liable company accountable for the harm that you or a member of your family suffered. What should you do? Consider some of the recommendations listed below:
- Seek medical care immediately
- Photograph all physical injuries suffered
- Photograph the defective product
- Photograph the entire scene of the accident
- Photograph any property damage resulting from the incident
- Contact the company to report the incident and any resulting harm
- Never agree to a free replacement or free repair
- Never agree to a refund
- Never agree to return the defective product

- Speak to any witnesses present at the time of the accident (collect their contact information for later reference)
- Gather any video footage (such as surveillance footage) that might have captured the incident

How long do you have to file your claim against WHILL for the harm that you or a member of your family suffered? In California, product liability claims are normally subject to a two-year statute of limitations; therefore, claimants only have two years to pursue their claims.
