    Equestrian Accident Lawsuit – Horse Riding Injury Attorney

Defective product litigations is based on proving of the existence of a defective in the product which substantially increased the risk of harm to the end user. Generally there can be three ways one can prove the existence of a defect in a product. (1) Defect in the items initial design. (2) Defect in the manufacturing process of the product. (3) Defect in labeling; also know as failure to properly warn users of all known and or knowable dangers associated with its common use.

    1. Traumatic Brain Injuries – from impact to the head.

    2. Spinal Cord Injuries – resulting in paraplegia or quadriplegia.

    3. Facial injuries – including fractures, lacerations, broken nose and ocular damage.

    4. Fractures – including cracked ribs, broken legs and arm.

    My accident was Sept. 26, 2005 on the exercise track at the San Diego Polo Club. Although I was wearing a Lexington Helmet, the same one that appears on-line; Equestrian Helmet Crash-Testing, I was taken unresponsive by ambulance to the ICU at Scripps Memorial Hospital where I remained in a coma for 32 days. I’ve also been treated at Scripps, Encinitas, and completed their neuro rehab program.

    If you Google: Meg Wade Endurance Rider, you’ll notice in the shot of the Riders moving away from the camera, the bases of their skulls are exposed! I’m sure that’s where I hit a rock, causing my Traumatic Brain Injury.

    It’s been a long road. All this time, effort and therapies later, I have limited feeling and therefore the limited use of my body, mid-line vertically to the right. I have, however, become quite adept with my left!!

    The problem is, most of the helmets commonly used in the horse industry, haven’t been crash-tested and rated. They aren’t safe! From Polo’s ‘Argentine-Style’ Helmet, to Racing’s Cap, and Hunter/Jumper, using these helmets is like getting into a car, fastening your seatbelt, getting into a horrific wreck, and having your seatbelt fail!

    Hi,

    I family member had an accident at a local horse riding club. They have made her sign a liability waiver a few months before the accident occurred. Does this rule out the possibility of a lawsuit?
